Study of Judicial Independence in Iran by Looking at the Judicial System of the United States

Abstract:
The judiciary power is one of the branches of government where people refer there for their petition Thus if it doesnt have adequate independence, we cant hope justly verdicts. One of the conditions that is necessary for adequate independence is separating the judiciary of the other branches .the judiciary separating of the other branches, that is the first step for its organizational independence, can be seen in both of IRAN and USA constitution. Nevertheless, but it's not meaning that judicial independence is sufficient and adequate both of the countries. Moreover the judges must be independent and impartial. It means that the judge for his voting must attend the law and justice merely and don’t scare for his behavior and decision from extrusion or downgrading. This independence must be in whole its features.
