One of the conditions that is necessary for adequate independence is separating the judiciary of the other branches .the judiciary separating of the other branches, that is the first step for its organizational independence, can be seen in both of IRAN and USA constitution. Nevertheless, but it's not meaning that judicial independence is sufficient and adequate both of the countries. Moreover the judges must be independent and impartial.
