Abstract:
The legitimacy of the ruling against the person who is absent from the meeting due process, considered one of the issues important from judicial jurisprudence. On the one hand can not be subject to any court session was attended by the parties. Because some people do not have the possibility or intention to appear in court. And on the other hand, trial against the absent should not result to wastage of his rights. Shia scholars (jurists) have different opinions to solve this dichotomy. Some according to the principle of plurality province Judgments against absent where doubts have been limited to the narrative. And others based on generalities and public order by binet and truth and justice, the condition unknowingly and judgment is absolutely legitimate and legal.
These studies showed that the allocation of the first principle of lack of guardianshipIt is permissible verdict against absent on the rights of people And the right of Allah, there is no reason to permit proceedings.
