Judicial security in the initial researches in judicial system of Afghanistan with a look at Imamiah jurisprudence
Judicial security safeguards the rights of all those who are involved in a criminal case. The present paper at first has studied the common safeguards of judicial security in Imamiah jurisprudence and criminal law system of Afghanistan, and then the special safeguards of judicial security in the initial researches stage have been studied in the criminal justice system of Afghanistan and the viewpoints of Imamiah jurists also have been explained where needed. According to the findings of the research, popular principle like legality of the crimes and punishments, presumption of innocence, equality before the law and personality of criminal liability are ruling on judicial security and must be applied in all the stages of trial, otherwise the judicial security is not established. Furthermore, there are some criteria in the initial researches stage which is one of the most important stages in the secular systems of trial disregarding of which endangers judicial security. The defendant has also rights in this stage, ignorance of which is ignorance of fair hearing and consequently lack of judicial security.
