Abstract:
The status of the issuance of sentences in our criminal system, especially in accordance with the sixty-seventh principle of the Constitution, is one of the issues that has been the scene of the diversion of opinions and opinions of scholars and critics. The existing ambiguities, the inadequacy of the principle, made the real understanding of the legitimacy of the legislature and made the courts competent in wandering, and this led to the issuance of contradictory and varied opinions that do not conform to any logical judiciary, and the ending of these differences There is nothing else to pay attention to in the above principle. In this brief essay, we try to make a more realistic look at us in the context of examining the factors that can clarify our judgment on Article 167 of the Constitution, and pave the way for reforming or changing it if necessary.
