The Jurisprudential Evaluation of the Sale of Silver and Gold considering Conditionality of Exchanging Good and Price in the Place

The mutual sale of silver and gold (Bei Sarf) is a contract in which silver and gold, ornamental or coinage, are exchanged for each other. There are three main conditions regarding such contract: equality in amount of two Congruent considerations (Meslan be Mesl) dealing in cash (Yadan be Yaden) and conditionality of exchanging good and price in the place (Taghaboz dar Majles). There are discrepancies among jurists on the conditionality of exchanging good and price in the place of deal. Some jurists consider it as a necessary condition in the sale of silver and gold while some others believe that it does not render a null and void contract. In this study, different viewpoints and the evidences are evaluated with a descriptive-analytical approach. Here considering the rational and Islamic narrated reasons, we distinguish them in such a way that in a deal in which mutual considerations are not of the same kind, exchanging good and price in the place is considered as a necessary condition, but in a deal with the same considerations, exchanging good and price in the place is not considered as a necessary condition. Of course, dealing in cash, in order to keep the deal away from usury is a necessary condition and this does not related to the conditionality of exchanging good and price in the place.
