Explaining the Legitimacy of the Democratic System based on the constitution and the Islamic Republic of Iran

Abstract:
Legitimacy is one of the most important issues of the government that all political systems require and the system of the Islamic Republic of Iran is no exception. In democratic systems based on the constitution, Legitimacy is based on the common law and the will of the public and granting legitimacy by the people to the government, Freedom of the people within the framework of legality in question is limited and subject to the constitution Freedom of the people within the framework of legality in question is limited and subject to the constitution .These political systems try to do that in various ways that would legitimize their rule and sovereignty for the people and otherwise they will face a crisis of lack of legitimacy. According to the principles contained in the constitution of the Islamic Republic of Iran, the category of legitimacy and rightness of the state is determined on the basis of religious and rational criteria and the legitimacy of the government puts the person in a position of potential, but its validity depends on popular acceptance.
This article, with a descriptive-analytic approach, seeks to explore the concept of legitimacy and its relation with modern democracy in a constitutional-democratic system and to study legitimacy in the Islamic Republic of Iran. This research indicatives that constitutional democracy has a direct relation with the concept of legitimacy, both in Western systems and in the Iranian legal system, that legitimacy is based on divine principles of the people.
