The present article tries to define custody clearly and specify its different aspects.The researcher is to clarify whether the custody is right or is responsibility or is itwaiver or nonwaiver. The author maintains that custody is a right for mother andis right and responsibility for father; so it is waived from mother and is not waivedfrom father. Period of time of the custody of mother and father is another subjectthat has been dealt with in detail. The conclusion is that despite the common ideaof jurists, the right of custody is for mother up to 7 years, be a boy or a girl and afterthat it is with the father, unless the interests of the child requires different decision.Also it has been revealed that the claim that after mothers’ marriage her custody islost is undocumented
