Legal Position of Preventing the Crime of Goods Smuggling by Customs and Police Agencies

Complexity of committing goods smuggling and the position of combating approach to control this phenomenon have caused the comprehensive preventive approach to gain attention merely by admitting multi-source approaches or multi-agency cooperative approaches and its everyday significance turns to a concern considered by judicial and para-judicial activists. In this regard, the Islamic Republic of Iran’s Customs Organization is not an exception to this issue and one of the agencies that can play an effective preventive role is police forces. That in what aspects police forces should take preventive measures and use what methods to help the Customs Organization has all been investigated in this article. This article has been prepared with the aim of descriptive-analytical method. And it has been written through applying library studies, Internet sources, Persian articles and inclusion of practical experiences, as well. The information gathering method was note-taking. The present writing attempts to express preventive cooperative stages first through investigating police models and legal documents of predicting police partnership with the Customs Organization and eventually by reviewing Customs duties and finding out their commonality within the framework of situational preventive approach and social preventive approach. Finally, it is necessary to predict a special task for customs police in a particular format or by proposing an amendment to the Customs Law 1390 and in this regard, cooperation mechanism, bilateral interaction methods and eventually executive guarantees for lack of fulfillment to preventive duties should also be determined. Therefore; systematizing partnership of these two organizations in order to fulfill the combat-centric approach to the phenomenon of goods smuggling is also indispensable.
