Abstract:
Background and objectives
One of the most important educational points for the criminal justice system is the officers' attention to the progressive principles of human rights in fulfilling their missions. Islam has human rights and education teachings, and dynamic jurisprudence as an indicator of this religion can be a guarantee of human rights. The principles of human rights have been set forth as the necessary directives for lawyers in European and Iranian law, which are discussed in this paper. Recognizing, developing and paying attention to the rights of accused persons (under supervision) as principles of human rights is the purpose of writing this article.
Methodology
Considering that the study of the principles of human rights is one of the theoretical studies, the method of this research is an analytical-descriptive study that has addressed the mentioned principles from the three perspectives of Islam, Europe (based on the French rules) and Iran through the library studies.Findings and
results
The research showed that the educational system of Islam in the observance of human rights by the officers and its reflection in the sources and principles of jurisprudence has the necessary clarity especially at the stage of crime detection. The above mentioned principles are the best example of this claim, but the rules of Islam regarding the right meetings with a doctor and the right to contact the family are not explicit. In European law (especially in the French Criminal Procedure Code), these principles are set out with the finest standards of criminal procedure, but in some cases, we are witnessing a distinction between the principles of human rights in Islamic and European law. Considering that most of the laws of Iran have come from the principles of human rights of Islam, there is no mention of the difference between the principles mentioned in the regulations of Islam and Iran, while the non-compliance of the rules of Iran's criminal procedure with the Sharia and the Constitution By the Guardian Council, it has given Islamic weight on the laws of Iran.
