Granting asylum to political criminals in documents and International Judicial Procedure

Granting asylum, especially diplomatic asylum to political criminals is one of the most important debates in international political and law in the last two centuries and nowdays it has become so important because of wars, coups and revolutions. According to the Universal Declaration of Human Rights (1948) and the Convention on the Status of Refugees (1951), someone who has been forced to flee his or her country because of persecution, and has a well-founded fear of persecution for reasons of political opinion , they seek sanctuary in another country, they apply for asylum – the right to be recognized as a refugee and receive legal protection and material assistance. If they have not committed a war crime or major non-political crimes, they can apply for asylum. Notwithstanding in the general principles and principles of international law is not considered granting diplomatic asylum to political offenders. But this right has been recognized on the basis of specific international Latin American regional documents, such as the Montevideo Diplo- matic Refugee Convention (1933) and Caracas (1954). So that, some lawyers believe that, not the duty of the embassies, the right is recognized as a tradition regional in Latin American. The main question in the study is, how is granting asylum to political criminals in documents and International Judicial Procedure?
