Using the achievements of this research, it should be acknowledged that the adequacy of the ability to determine not only the Islamic jurisprudence and the law of our country have well-documented documents, but today is accepted in the law of Egypt and the common law as a principle. And in their legislative system, it has been reflected in it. In this paper, by collecting information from library resources, analytical and descriptive methods are used to discover the sentence and analyze it and provide corrective suggestions.
