The Mechanisms and System of Social Control Based on Imamiyah Jurisprudence
The emergence of jurisprudential management in the modern world has brought about serious challenges and questions about the encounter of jurisprudence with human science and experience on social issues. On one hand, the capacities of jurisprudence in controlling the followers in individual level by mandating the religious rulings and preventing from sins is known to everyone. On the other hand, the study of “social jurisprudence” is so nascent. The present study adopts the interdisciplinary approach of Jurisprudence, Punitive Law, Criminology, and Sociology in order to recognize a part of jurisprudence’s potential with emphasis on Imamiyah jurisprudence, and comparing it with Sociology. In the jurisprudential system, “worship” as the main purpose of creation with its various forms is considered to be the preventative force against anomalies in societies; in case of deviance by individuals, the “enforcement of virtue and prevention of vice” acts as a lever to void any deviance and if it fails, the state intervenes by implementing “punishment” for the correction of vile and “re-socialization” as the last resort, as prescribed by jurisprudence.
