The trace of the “organized crime” in the Islamic jurisprudence with a look at the conspiracy of Efk (defamation)
Crimes nowadays are mostly committed organized and in groups so that these crimes due to their special characteristics are considered as substantial threats to the national and international societies, and therefore finding the roots of their criminalization in the jurisprudential sources is important. The findings of this research are attained by an analytic-descriptive method by collecting library information. We have tried to analyze the quality of being organized crime in the case of “Efk” (defamation) which was one of the most important political movements against the rule of the Holy Prophet Muhammad (PBUH) in the early years of Islam. The result of the research shows that although all the characteristics and components of organized crimes are not found in the above mentioned case, the substantial characteristics of these crimes can be elicited due to the condition of “Asabah” in the case, and this can be considered as a trace of organized crimes in the jurisprudential sources.
