The Role of International Judicial Collaboration in Transferring Convicts to Imprisonment from the Perspective of Transnational Documents and Iran's Criminal Law
Some crimes are related more than one state for reasons such as the specific nature of conduct or personality of perpetrators or crossing borders of commission place state and require cooperation and assistance of states to fight against these kinds of crimes. Achieving this goal needs bilateral or multilateral treaties and agreements which clarifying the framework of these cooperation's. In the past, known traditional tools such as extradition and legal assistance used to achieve it. Nowadays one of the modern tools of international cooperation is transfer of criminal convicts which used to transfer the convicts whom sentenced to imprisonment in the other state to their national state, as one of the tools of international assistance in criminal matters. This approach has been adopted recently in inter- state relations and international documents as a means to transfer convicts from convicted place to their national or residential state. This article explains and analyzes the place of this subject from the view of international instruments and Iranian criminal law regulations
