Collusion against national security in criminal law

Collusion against national security in both Iran and England legal system has been accepted as an independent crime and associated with criminal severe response. Committing this crime as a preparatory action is against the national security that if you find that in actuality, it is not possible to be controlled and dealt with by government. In this paper, using a descriptive-analytical approach, while investigating different elements of crime, some more appropriate approaches to criminal policy are suggested. Comparison of the two legal systems of the England and Iran is to make it clear that Criminalization of conspiring against the national security, both in terms of material element of crime and the amount of the penalty prescribed by law has some restrictions that removing the restrictions can be considered as more effective fight against the factors behind the crime; and thereby, during applying the appropriate response to the people who collude, it can also help to reduce crimes against the security. Especially considering that the Iranian legal system in the collusion criminalization was influenced by the Roman-German legal system, while the UK as the cradle of the British legal system adapts them in presenting the gaps and legal shortcomings of this crime in Iranian law. It will be very fruitful.
