This paper examines the problem of separation of powers in the two structures of the European Union and Iran after the revolution, and analyzing the challenges posed by the application of this theory, compares this to the two structures. The main question of the research is, what challenges does the implementation of separation theory in the European Union and Iran? The research hypothesis is that, due to the formation of the European Union in the context of Western thinking, the implementation of the separation of powers faces less administrative difficulties, but in Iran, faced with theoretical difficulties due to the implementation of a Western theory in the Islamic system based on the idea of the Velayat-e faqih. This paper deals with an analytical, comparative and descriptive approach compare the implementation of this theory in these two domains. The results of the research show that the EU, apart from the jurisdiction of the Court of Justice.
