Comparative Study of the Position of Wilayah Al-Faqih and Leadership of the Society by Women in Jurisprudence of Islamic Denominations and Iranian Law

Abstract:

One of the issues discussed in Islamic jurisprudence, is permission or the lack of permission for women to hold positions like the leadership of the government. This descriptive-analytical study paid to comparative study of this issue in Jurisprudence of Islamic Denominations and Iranian Law. In Jurisprudence of Islamic Denominations, except one sect (Shabibiyyah), all consider that women are not authorized to hold this position. In the legal system of Iran, it is best to reconcile the rule of Islamic law (the will of God) and the rule of law (the will of the people) and the management of the society that based on the rules of the Islamic jurisprudence has been placed on Wali al-Faqih and management of society that based on the rule of law has been placed on the elected leader of the people. The prohibition of leadership of women has just been put in the jurisprudential aspect, and it is the position of Wilayah al-Faqih. There are no prohibitions on the subject in this regard.
