Necessity of protecting humanity in manner of the treatment of the deprived of freedom; from theory to action

The right of people deprived of freedom is one of the fundamental human rights that was considered in article 10 of the international covenant on civil and political rights for the first time. Due to that deprivation of freedom makes a person specially vulnerable and exposes his dignity and rights to violation, this right is absolutely necessary for respect to people`s inherent dignity. But international documents have not defined it and have only expressed the obligation of “prohibition of torture and other cruel, inhuman and degrading treatment or punishment“. However, this prohibition is just a minimum duty of respect to human dignity and human treatment in situations of deprivation of freedom. Realization of human treatment of the deprived of freedom needs a higher level of duties and active actions from governments.
