Ruling on Buying and Selling Government Drugs Outside the Regulatory System from the Perspective of Shiite Jurisprudence

Today, the purchase and sale of government drugs outside the monitoring system is secretly manifested in the community, which leads to disruption of the drug distribution system, harm to the patient. In this regard, it demands that a step be taken in search of an internal and external deterrent to such action, so in this article, it seeks to explain the jurisprudential ruling on buying and selling government drugs outside the regulatory system so that the divine ruling on its extraction and inference It is possible that in the light of the divine laws, sharia transactions will be enlightened and it will be prevented from continuing.

In this article, with a descriptive-analytical method and with reference to books, traditions and reason, the ruling on buying and selling government drugs outside the regulatory system has been extracted and inferred.

Following the opinions of some contemporary jurists, the ruling prohibiting the purchase and sale of government drugs outside the supervisory system is based on verses, hadiths, and reason, and on verses 29 and 59 of Nisa and 2 Ma'idah and Sunnah. And the rule of the obligation to maintain the system and the sanctity of disrupting the system, the obligation of justice and fairness, no harm, the denial of hardship and embarrassment, and the rule of the sanctity of donations on sin are not permissible.

The conclusion is that the purchase and sale of government drugs outside the regulatory system according to the principles of Shiite jurisprudence, since it is contrary to the rules of the Islamic Republic and the example of property is void and also leads to disruption of the system and with Fairness and justice are not compatible or are the source of harm and hardship, it is not permissible.
