Abstract:
The present study has been conducted in relation to civil liability of government employees in Iranian jurisprudence and law. Responsible for damages. However, if the damage caused by their actions is not related to the defects of the equipment of the mentioned departments and institutions, then the compensation of the damage is the responsibility of the relevant department or institution. In the field of medicine, the responsibility of the government is realized due to the actions of the employees when the damage is not documented and attributed to the action of the employee, it is due to the defect of the structure of the office or institution and the weakness of management and means of providing public services. Given that the shortcomings of the government organization are ultimately due to the poor performance of its officers and employees, and that it is the people who decide everything, the responsibility of the government for the actions of its employees can be indirectly under Article 5 of the Civil Liability Law. Contract.
