Juridical system ruler on separation of private and Public economy departments

Economic is an important matter which political system of country had formed on it. On this basis sovereignty system of Iran which had to establish its economic system according to Islamic standards and doctrines had approved principles that shows governance attitude to economic and economic manner dominate on country. On one hand economic and political tasks are that much intertwined that they affecting each other in every aspect because lawyers try to optimize society welfare by achieving economic welfare with codification. On the other hand they analyze rights by viewing economic approach. By prophecy of 44 principle general policies, constitution trace economical departments and their construction. And forecast public, private and cooperative ownership. That in this way importance of private and public section had determined. This dissertation goal is studying economic situation of country and private, public and cooperative economic parts. Separation of private section from public section and effort for implementation of general 44 principle policies resulted in providing context of fight against corruption and increasing efficiency in economic by national economic development expend ownership in public level in order to supply social justice, enhance of business enterprise efficiency, national economic competitiveness increase, increase of private and cooperative section share in national economy, reducing government financial burden, encouraging investment and saving and reducing governmental enterprise. Before codification 0f 44 principle political economic approach was based on being governmental. Position of private and cooperative section in economic enterprise of country got stronger with modification of rules and privatization birth.
