Abstract:
One of the most prominent and long-standing examples of crimes against security is spy crime, which is usually an organized, yet transnational, crime because it involves the vital intelligence of a country in the field of military, security and political affairs through an organized system. It is made available to the country or countries by the use of human resources (not the information tools that are not the subject of our discussion). Traditionally, espionage is also a betrayal of the country, first of all Foreigners, and the second, can be committed by nationals of a country against that country (Mir Mohammad Sadeghi, 1977: 86). In both Iran and France, lawmakers have paid special attention, and at times, to spy crime. This article includes two topics that we deal with in the first section on the elements of espionage crime and in the second topic we discuss the criminal responses to espionage crime from the perspective of Iranian and French Criminal law.
