Jurisprudence Deduction from Hanbali s Viewpoint

One of the important matters in principles of religious knowledge among Islamic Usul religions is the argument about Deduction as one of the recognition sources in religious law, and its value in Ijtihad process. Distinct views and different opinions are presented by Imamieh and Sunnite scholars. Hanafi religion was going to excess and gave priority to Deduction over Tradition, and another group such as Zaherian dissipated and cancelled Deduction and forbade it. Imamieh scholars at first thrown away any suspicious Deduction that had no true document or no based on demonstrative jurisprudence. In contrast, they gave particular credit and value to Deduction that has demonstrative jurisprudence. It seems that the basic dispute is to rise an argument or not in one of the elements of Deduction, that is the same reason or the combination between Usul and Forro. But there is no argument in Deduction which has demonstrative jurisprudence, that is, understandable from The Book, Tradition or consensus of the community (Ijtihad) among different Islamic schools. This article is attempting to clarify the Hanbaliُs views in suspicious Deduction in accordance with the opinions and thoughts of their jurisprudence and principles.
