Prevention of Recidivism in Iran and US Criminal Law

Abstract:
Preventing recidivism depends on the proper studies to identify the risk factors which affect the offender to re-commit the criminal behavior. Influencing the situational, social, and individual factors requires the application of some different instruments. In spite of the fact that before and after the revolution some acts and articles are approved to prevent crime, in general, and recidivism, in particular, to solve to problem of ambiguity existed in such laws, the legislator of Iran added an act to the Islamic Criminal Law in 2008; it is sometimes considered as an example of a risk-based criminal policy.United states also have been encountered with a high rate of recidivism. To decrease the problem, since 1968, a variety of rules and regulations with the help of the latest technologic inventions have been put into account by US policy makers. In addition to corrective policies, US measures to combat recidivism include some severe, retributive reactions for re-committing crimes by the offenders. In this article, the authors aim to discuss about the proper model of preventing recidivism in Iran, considering divers policies and measures applied by both Iran and United States.
