صفحات 11-39در فقه توجه ویژه ای به مساله حفظ نفس محترمه شده به گونه ای که حکم وجوب یا حرمت در صورت تزاحم با حفظ جان خود یا دیگری در بسیاری از موارد تخصیص خورده است.
با وجود این فقها به شکل خاص به موضوع مسوولیت پزشک در قبال بیماران اورژانسی نپرداخته اند، لیکن مسوولیت پزشک در برابر بیماران اورژانسی از دو وجه در فقه قابل بررسی است.
بر این اساس بررسی دیدگاه آنان در این خصوص نیازمند کنکاشی عمیق است. نتایج پژوهش نشان می دهد که فقها به مساله تکلیف به نجات جان اشخاص در معرض خطر شدید عمدتا در قالب چند مثال سنتی پرداخته اند، لیکن از آنجا که می توان میان حکم تکلیفی با حکم وضعی ملازمه برقرار کرد، باید گفت فروض ذکرشده خصوصیتی نداشته و نظر اکثریت فقها بر وجوب چنین تکلیفی توسط پزشک در این شرایط است و تارک فعل را ضامن می دانند.
از طرفی هرچند در خصوص لزوم اخذ رضایت جهت شروع به درمان بیماران اورژانسی که ولی آن ها در دسترس نیست میان فقهای اهل سنت و شیعه اختلاف است، لیکن اکثریت فقهای امامیه به لزوم چنین شرطی حکم داده اند.

صفحات 41-74جانشینی در بارداری به عنوان یک شیوه نوین در درمان ناباروری مسائل حقوقی گوناگونی را با خود به همراه داشته که از جمله آن ها احکام وضعی طفل مزبور بالاخص وضعیت نسب او می باشد. این طفل از یک طرف با والدین ژنتیکی در ارتباط بوده و از تخمک و اسپرم آن ها ایجاد می شود و از طرف دیگر با مادر جانشین و شوهرش مرتبط می باشد که به نظر برخی زن صاحب رحم می تواند به عنوان مادر تلقی و حتی با بکارگیری اماره فراش در مورد اثبات نسب پدری در برخی فروض شوهر مادر جانشین نیز می تواند به عنوان پدر طفل به شمار آید. در این مقاله وضعیت نسب پدری و مادری طفل مورد بررسی قرار گرفته و مشخص می گردد که صاحبان اسپرم و تخمک والدین نسبی او می باشند.

صفحات 75-106سقط جنین به معنای از بین بردن جنین در رحم مادر می باشد. بی تردید نفس انسانی محترم بوده و کشتن آن از نظر عقل و شرع ممنوع و حرام است، ولی شرع در مواردی سقط جنین را مجاز شمرده است. آنچه در این پژوهش بدان پرداخته شده در مورد بررسی مبانی فقهی صدور جواز سقط و دیدگاه های موافقان و مخالفان می باشد. این پژوهش با رویکردی فقهی و با استفاده از منابع اربعه به آنالیز و تحلیل موضوع پرداخته است.
پژوهش نشان داد که در صورت به خطرافتادن جان مادر یا جنین قبل از دمیدن روح در کالبد جنین سقط بلامانع بوده، ولی بعد از دمیده شدن روح در جنین در صورت خطر مرگ برای مادر جایز، در غیر آن صورت جایز نمی باشد.
سقط جنین ناقص الخلقه و موارد خاص دیگر، مانند وجود اختلال شدید در جنین، در صورتی که روح در آن دمیده نشده باشد، طبق ادله عسر و حرج و قاعده لاضرر و بنای عقلا جایز است وگرنه مانند تمام انسان های دیگر حقوقی دارد، از جمله حق بقا و زندگی در نتیجه سقط آن جایز نیست.

صفحات 107-141پیشرفت علوم و تکنولوژی و اثرات و پدیده های ناشی از آن از یکسو و پیچیدگی و غموض احکام از سوی دیگر، موجب گردیده است، ادله اثبات احکام قضایی تحول جدی یابد و از روش های نو و ابتکاری بهره گیرد. به این سبب فقی هان و حقوقدانان برای کشف احکام و حقایق، از ابزارها و روش های تجربی کمک گرفته اند. یکی از این روش ها، تجزیه و تحلیل پزشکی است. تجزیه، انحلال شی مرکب به اجزای تشکیل دهنده آن است که از روش های تجربی برای اثبات احکام قضایی در آن بهره گرفته می شود. بنابراین تحولات علمی و گذر زمان تاثیر زیادی بر قضاوت و احکام مرتبط با آن گذاشته است تا آنجا که با تلفیق احکام قضایی با روش های علمی دقیق، قضاوت می تواند کارایی بیشتری داشته باشد و مشکلات و چالش های بسیاری را مرتفع سازد. این پژوهش کوشیده است جایگاه تجزیه و تحلیل را از طریق ادله شرعی تبیین کند و پس از نقل دیدگاه ها، به نقش آن در دستیابی قاضی به اطمینان نزدیک به علم از راه تجزیه و تحلیل بپردازد و حجیت تجزیه و تحلیل را در اثبات احکام قضایی به اثبات برساند.

صفحات 143-166بعد از مداقه و پژوهش در مورد اصل پیوند اعضا و دست یافتن به شیوه های جدید نگهداری اعضا به قصد پیوند، پرسشی نو را در اذهان پدید آورد؛ با فرض جواز اصل عمل پیوند عضو، آیا این جواز می تواند به نگهداری اعضا به عنوان مقدمه و یا عملی از پیش تعیین شده، جهت تسهیل و انجام به موقع عمل پیوند، تسری یابد؟ بررسی و تبیین ادله عدم جواز نگهداری اعضا، شامل روایات حاکی از نهی و نیز آثار ناگوار نگهداری عضو و پس از آن، نقد و بررسی میزان دلالت هر کدام از ادله دیدگاه های رقیب و سنجش قابلیت استناد و میزان کاربرد آن ادله، فرآیند نوشتار پیش رو است. دلایل جواز نگهداری، مستفاد از برخی ادله اصل جواز عمل پیوند و نیز تطبیق گام بعدی است. تلاشی اجتهادی و فقهی به منظور رسیدن به نتیجه مناسب در راستای استنباط حکم نگهداری اعضا شده است. ارائه شرایط خاص و ذکر چگونگی امکان جواز نگهداری اعضا سرآغازی جدید بر مساله ایی نوظهور است. این جستار مدعی است با لحاظ و تحقق شرایطی خاص، جواز و روایی نگهداری اعضا به قصد پیوند، متکی و مستند به ادله است. این حکم جواز می تواند کمک قابل توجهی به نجات جان انسان ها داشته باشد.

صفحات 167-191در پیوند عضو از مبتلایان به مرگ مغزی و متوفیان، قانون و برخی آرای فقهی، اذن قبلی فرد یا اولیا را شرط می دانند. از نظر ماهیت، چنانچه اذن، تشریفاتی تلقی شود، پیوند بدون اذن مانع شرعی نخواهد داشت و اگر اذن مجوز شرعی باشد، پیوند بدون اذن را نمی توان مشروع به حساب آورد. نیز بر فرض منوط بودن مشروعیت پیوند به اذن، هنگامی که اولیا رضایت بر پیوند را اعلام می کنند، چنانچه اذن ماهیتا کاشف از رضایت قبلی میت باشد، همسر و دیگر کسانی که با میت خویشاوندی دارند می توانند از جانب متوفا رضایت خود را اعلام کنند؛ در حالی که اگر اذن اولیا ماهیتی مستقل از اذن میت داشته باشد، اعلام رضایت منوط به ولایت شرعی خواهد بود که در این صورت اذن زن و شوهر نسبت به همدیگر موثر نخواهد بود. به دلیل اختلاف آرا و وجود مبانی مختلف، مقاله حاضر به بررسی ماهیت اذن از زوایای مختلف و تاثیر آن بر تفسیر شرعی از قوانین موجود می پردازد.

Pages 11-39Religious jurisprudence has been paid special attention the issue self-respect protection so that obligation and prohibition order have been emphasized in case of interference with self- life or else in many cases. However the jurists have not thought about, the issue of physician responsibility for emergency patients in particular. But the physician responsibility for emergency patients can be studied in two aspect in religious jurisprudence. Therefore, investigation of their view point requires a deep study. The results show that religious jurisprudence have mostly thought about the rescue of risky patients in many traditional examples. But regarding to relationship between duty and statute order; it can be said about the above mentioned assumptions are not property and the majority opinion of religious jurisprudence is on the necessity of this order in these conditions. Who is leaving it she or he will be held accountable. Although, there is dispute Between Sunni and Shiite religious jurisprudence about necessity of getting consent to begin treatment of emergency patients who their family are not available, but the majority Shiite religious jurisprudence have ordered on the necessity of this term.Keywords: Shiite, Sunni Figh, Liability of Physicians, Emergency Patients

This baby is related to genetic parents and was created by their egg and sperm, and on the other hand, is related to surrogate mother and his husband that according the some opinion, the surrogate mother is mother. Even with employment of mattress evidence in proving the father genealogy in some case, husband of surrogate mother is the father of this baby. Pages 75-106Abortion means destroying the embryo. The human soul is respected, undoubtedly and killing is prohibited rationally and religiously however the religious law allow to do abortion in some cases. In this study we investigate Licensing and views of Supporters and opponents of abortion jurisprudence. This study uses jurisprudence approach and four sources to analyze the issue. Research showed that if the life of the mother or fetus is in danger before of blowing the soul in the body is permitted to doing abortion but if the life of the mother or fetus is in danger after of blowing the soul in the body is not permitted to doing abortion by religious jurisprudence. Abortion of malformed fetus and other special cases like sever disorder of fetus, in the case the soul is not blown, is lawful according to distress and constriction proofs, rule of negation of injury, and rational principles, otherwise it has the same rights as other people including right of survival and life. Pages 143-166Consideration of the principle of body organ transplantation and the achievement of the new methods of the organ preservation for transplantation has led to the emergence of a new research question. Given the principle of organ transplantation is permitted, can this permission allow for the prior preservation of organs to facilitate the operation of transplantation? The current study is intended to carefully clarify and investigate the reasons of the ban on the preservation of the body organs such as the traditions and the unwholesome consequences of organ preservation. Likewise, the paper tries to analyze the opposite views and assess the applicability of the relevant reasoning. Moreover, the study is an attempt to investigate the reasons for organ preservation derived from the principle of organ transplantation and their compatibility. The present study is, therefore, a jurisprudential attempt to deduce the permission order of body organ preservation. The emergence of the special conditions and the possible methods of organ preservation have resulted in a new research question. This study claims that, in some special conditions, the permission for and the legitimacy of the preservation of body organs for transplantation is highly supported by jurisprudential reasoning. Pages 167-191In organ transplantation from dead body and who has brain death, according to law and some opinions, prior permission is necessary. If the nature of permission is ceremonial, organ transplantation without permission will be legal but if it is necessary by Sharia, it will be illegal. Also depend on the assumption of nature of permission, when relatives are pleased to announce the permission it essentially returns the prior consent of dead person and his wife/ her husband and other relatives are able to announce the consent. However, if relative's permission is independent, consent will be subject to religious province and will not be effective for another couple.
