September 11, 2001 event deeply affected the international interactions in many areas. One of these areas affected by this event is the area of immunity issues, Including diplomatic and State immunity and also immunity of the Heads of States. These immunities give such condition to individuals that they would be immune from foreign States jurisdiction, and thus be protected from prosecution and enforcement. This position is in contradiction with other principles like human rights regulations, criminal international responsibility and self-defense. September 11, made the international relations more security- based and changed States priorities, so that between the observance of immunity and keeping their domestic security, they choose the later one and pay less attention to immunity rules. This non observance of immunity rules is such big that based on which some theoretical justifications have formed. These justifications are the collision between immunity and right to life, the principle of selfdefenseand hierarchy of jus cogens. With one analytic-descriptive method we can posit that the scope of immunity has changed and this can affect the rules of immunity and this evolution from legal perspective is based on States’ practices ,and till now it is not compatible with applicable rules of 1961 and 1963 conventions on diplomatic and consular relations.
