    با توجه به اینکه شبکه بانکی کشور در حال گسترش بانک های خصوصی و تجربه ورود بانک های خارجی است، میزان تمرکز در شبکه بانکی کشور و اندازه گیری درجه رقابت پذیری بانک های کشور دارای اهمیت است. در همین راستا در این مقاله سعی شده است با استفاده از شاخص های تمرکز و هرفیندال، درجه تمرکز در شبکه بانکی کشور در دوره زمانی 1380-1391 اندازه گیری شود. همچنین برای اندازه گیری درجه رقابت پذیری از روش غیرساختاری پانزار و راس پویا در دوره زمانی 1375-1391 استفاده شده است. نتایج حاصل از بررسی حاکی از تمرکز تقریبا 60 درصدی دارایی در 5 بانک بزرگ کشور است که در دوره مورد بررسی روند کاهشی داشته است. علاوه بر آن 5 بانک بزرگ کشور سهم 51 درصدی در تسهیلات غیرجاری را در سال 1391 داشته اند که لزوم توجه مدیریت ریسک اعتباری در این گروه از بانک ها را بیش از پیش می سازد. همچنین شاخص پانزار و راس پویا نیز بیانگر بیشتر بودن درجه رقابت پذیری بانک های بزرگ در مقایسه با بانک های کوچک و همچنین بانک های خصوصی در مقایسه با بانک های دولتی می باشد.

    تکانه های قیمت نفت، عمده ترین منبع نوسانات اقتصادی در کشورهای صادرکننده ی نفت همچون ایران می باشد. همچنین، سیاست پولی مناسب می تواند در کاهش نوسانات نامطلوب چنین تکانه هایی، نقش مهمی را ایفا نماید. در این مقاله، با هدف شناسایی قاعده سیاست پولی بهینه در مواجهه با تکانه ی قیمت نفت، یک الگوی تعادل عمومی پویای تصادفی چندبخشی تحت رویکرد کینزی جدید، با تاکید بر بهینه سازی بخش نفت و لحاظ یارانه بر قیمت انرژی برای اقتصاد ایران طراحی شده است. الگو به روش بیزین تخمین زده شده و سپس برای ارزیابی تاثیر قواعد سیاست پولی متفاوت استفاده شده است. نتایج نشان می دهد که در دوره زمانی 1367:1 تا 1391:1، از میان سه قاعده پولی مختلف مورد ملاحظه یعنی هدف گذاری تورم مصرف کننده، هدف گذاری تورم تولیدکننده و هدف گذاری نرخ ارز حقیقی، هدف گذاری تورم تولیدکننده موثرترین قاعده در تثبیت تورم بوده است. به علاوه چنین قاعده ای، کمترین زیان رفاهی را به همراه داشته است.

    در این مطالعه به نقش ذخایر ارزی بر متغیرهای کلان اقتصادی در چارچوب یک الگوی خودرگرسیون برداری ساختاری با استفاده از اطلاعات و آمارهای داده های سری زمانی گردآوری شده از بانک مرکزی ج.ا.ا و بانک جهانی برای سال های 1360-1392 پرداخته می شود. نتایج تجربی نشان می دهند که تکانه های انباشت ذخایر ارزی اثر مثبت و معناداری بر نرخ ارز و تورم گذاشته است. این نتایج حاکی از آن است که دولت با تزریق نقدینگی حاصل از درآمدهای نفتی باعث افزایش پایه پولی و تورم، در جامعه شده است. همچنین توابع واکنش آنی و تجزیه واریانس، تاثیر مثبت تکانه های انباشت ذخایر ارزی بر تورم و نرخ ارز را تایید می کنند.

    قاعده مصونیت حاکمیت و ارگان های وابسته که شامل هم مصونیت قضایی و هم مصونیت از اقدامات اجرایی می باشد علی رغم تحولات رخ داده طی دهه های اخیر، همچنان در حوزه اعمال حاکمیتی جنبه مطلق خود را حفظ کرده است. در برخی موارد از جمله اعمال تصدی گری و شبه جرم های فراسرزمینی با استثنائاتی روبرو گردیده است. کنگره آمریکا استثناهای قاعده مصونیت حاکمیت را با تصویب قانون استثنای مصونیت در سال 1996 گسترش داد. طی سالیان اخیر با استناد به این قانون و قوانین مشابه، دولت ایران و ارگان های وابسته محکوم به پرداخت بیش از 12 میلیارد دلار خسارات ترمیمی و تنبیهی شده و برخی از احکام و آراء صادره منجر به توقیف و اقدامات اجرایی علیه اموال و حساب های بانکی و دارایی های خارجی به خصوص اوراق بهادار بین المللی متعلق به بانک مرکزی ایران گردیده است. هدف این مقاله آن است تا به این موضوع مهم بپردازد که آیا اینگونه اقدامات آمریکا و رسیدگی ها و احکام صادره توسط محاکم آمریکایی علیه دولت ایران و ارگان های وابسته به حاکمیت ایران به خصوص بانک مرکزی ایران در انطباق با قواعد و مقررات حقوق بین الملل و همچنین در چارچوب قوانین و مقررات حاکم در ایالات متحده آمریکا می باشد یا خیر؛ و اینکه موثرترین راهکار جلوگیری از استفاده از ذخایر خارجی بانک مرکزی ایران در آمریکا در اجرای احکام صادره توسط محاکم ملی آمریکا چیست.

    این مقاله به ارزیابی ساختار بازار وام و تسهیلات بانکی ایران و سنجش ضریب قدرت انحصاری بر اساس رویکرد برسنان و لئو می پردازد. پژوهش جاری وضعیت بازار متشکل پولی ایران در بازه زمانی 92-1384 که شامل 18 بانک فعال می باشد را موردبررسی قرار داده است. با استفاده از مدل قدرت بازاری برسنان مشخص شد درجه بالایی از رقابت در بازار وام و تسهیلات برای 18 بانک فعال در صنعت بانکداری وجود ندارد. ضرایب برآوردی با استفاده از روش گشتاوری تعمیم یافته فرضیه وجود رقابت کامل برای کل بازار وام و تسهیلات بانکی را رد می کند.

    در این مقاله با توجه به طبیعت متفاوت سپرده های سرمایه گذاری، روش های تامین مالی و ریسک های فعالیت بانکداری منطبق بر شریعت نسبت به بانکداری متعارف، با تاکید بر معرفی انواع ریسک ها و مدیریت آن در نظام بانک داری اسلامی به شناسایی و چگونگی تطبیق و اجرای استانداردهای مقرراتی و نظارتی بین المللی برای بانک های اسلامی خواهیم پرداخت. در پایان نیز بر مبنای استانداردهای کمیته بازل برای نظارت بانکی، سه اصل کفایت سرمایه، فرایند بازرسی (بررسی نظارتی) و نظم بازار را به عنوان چارچوب جدید و قابل کاربرد در بانک های اسلامی معرفی خواهیم نمود.

    According to banking network has experienced the expanding of private banks and entry of foreign banks, Concentration in the banking network and to measure the degree of competitiveness of banks is important. In this regard, this paper, using the Herfindal and concentration index, measure the degree of concentration in the banking network in the period 1380-1391. Also to measure the degree of competitiveness we use the dynamic Panzar and Ross model in the period 1375-1391. The results of the survey showed that the five largest banks have almost 60 percent of the assets of the banking network in 1391, that this decrease in the period. In addition, five largest banks in 1391, have 51 percent of non non performing loan. It make more Importance of credit risk management in this group of banks. Panzar and Ross dynamic index indicates the competitiveness of large banks are more competitiveness than small banks and private banks are more competitiveness than public banks.

    Oil price shocks are the major source of economic instability in oil exporting countries, as well as Iran. Also the appropriate monetary policy can play an important role in decreasing these undesirable variations. In this paper, to investigate the optimal monetary policy rule after an oil price shock for the economy of Iran, a New Keynesian Multi sectors Dynamic Stochastic General Equilibrium framework model with emphasis on oil sector optimization and considering the subsidy of energy price, is designed. The model is estimated by a Bayesian method and then it is used to evaluate the effect of different monetary policy rules. Our main findings reveal that among three different monetary policy rules under consideration i.e. CPI inflation targeting, PPI inflation targeting and real exchange rate targeting in the 1367:1-1391:1 period, PPI inflation targeting policy rule is more effective in stabilizing the inflation. Moreover compare to other policy rules, It is accompanied by the lowest welfare losses.

    In this study the effect of exchange reserves on the macroeconomic variables is probed and so as to achieve the goals here, we have used the data gathered during 1981-2013 and all the required information for this research has been received from Central bank Of Islamic Republic of Iran and World Bank. Results show that shocks of exchange reserves have had a positive and meaningful effect on exchange rate and inflation. They also show that the government has increased monetary base and inflation by injecting the liquidity from oil revenues.

    Sovereign immunity, which includes both types of jurisdictional immunity and immunity from attachment and execution of property of a foreign state, despites its variations in recent decades, is still fully applied in any sovereign act, but not in some aspects such as commercial activities of a foreign state and its extraterritorial torts. Following the adoption of restrictive immunity and in consequence of the enactment of Foreign Sovereign Immunities Act in 1976, the Congress has expanded the list of sovereign immunity exceptions. In recent years, relying on the provisions of this Act and other similar enactments, U.S. Federal Courts have rendered money judgments against the government of I. R. of Iran and its agencies for payment of more than 12 billion dollars as compensatory and punitive damages in favor of the U.S. plaintiffs. For the purpose of enforcement of these judgments, US courts have issued some attachment and execution orders against the assets especially security entitlements owned and/or held by the Central Bank of Iran in the U.S. Considering these facts, this paper aims to explore whether these claims and measures against the state of I. R. of Iran and its agencies especially the Central Bank of Iran are complied with the established rules in international law as well as the governing federal and state laws and regulations in the U.S.; and finally the major contribution is to show what is the best effective solution to submit to the U.S. courts to prevent enforcement of the executions ordered against the assets of the Central Bank of Iran situated in the United States.

    This article deals to evaluate the loan market structure and Iran banking facilities and power factor monopoly based on Bresnahan’s Lau approach. Current research was studied Iran's monetary market status during 2005–13 which contains 18 active banks. They all formed the money market situation in Iran by making use of Bresnahan's market power model, was determined that there is no loan market for the active banks in Iranian banking industry. The estimated coefficients of the research model using generalized method of moments (GMM) show that the hypothesis of perfect competition without any withholding rates and loan rates can be rejected for the entire market.

    In this Article, due to the nature of investment deposits, modes of financing, and risk profiles are different from those of conventional banks as a result of the need to comply with the Sharī‘ah, we want to addresse primarily the crucial question of how to apply the international regulatory standards to Islamic banks and whether the existing international standards of best practices are adequate or whether anything more is also needed in view of the relatively different risk (risk management) perspective of these institutions. Finally, the paper reviews the standards set by the Basel Committee for Banking Supervision (BCBS). It finds the three pillars of the new Basel framework, namely capital adequacy, supervisory review process, and market discipline to be equally relevant to Islamic banks.
