برنامه عمل مشترک ژنو (توافقنامه هسته ای ژنو) میان ایران و گروه 1+5، هرچند سندی سیاسی بین المللی است اما به دلیل نوع پردازش حقوق و تعهدات ناشی از ان.پی.تی. و همچنین ارتباط با قطعنامه های شورای امنیت به ویژه اجراییسازی زمینه های اجرای تعدیلی قطعنامه 1929 و نهایتا تبلور اراده هفت دولت و پشتیبانی گسترده در سطح جامعه بین المللی دولتها، نمادی از رویه بین المللی از نوعی است که در ماده 38 اساسنامه دیوان بین المللی دادگستری به آن پرداخته شده است. بنابراین، جنبه های حقوقی این توافق و متن توافقنامه نیازمند واکاوی است و در این نوشتار، به برخی از ابعاد آن به صورت مختصر اشاره شده است.

نظام حقوقی سازمان جهانی تجارت، موافقتنامههای تحت پوشش را با تفاهمنامه حل اختلاف، درهم تنیده که این امر، تعهدات اعضاء را تابع فرآیند اجباری از مشورت، داوری، استیناف و اجرای موثر درآورده که مآلا هدف آنها، امحاء تخلف بدون صرف هزینه و عدم ایراد لطمه به روابط تجاری اعضاء است. سازمان با وجود تمام پیشرفتهای حاصله، نقایصی را نیز در نظام حقوقی خویش تحمل مینماید که برخی مفسران از این امر، تحت عنوان «بحران مشروعیت» یاد نمودهاند. ازاین منظر، چالشهایی اساسی پیشروی سازمان وجود دارد؛ از قبیل جهانشمولی سازمان و مشکل در یکپارچهسازی آزادسازی تجارت، فرسایش اصل عدم تبعیض، حاکمیت محوری دولتهای عضو، معضل عدم انسجام و هماهنگی لازم با سازمانهای بینالدولی، عدم شفافیت در تعامل با جامعه مدنی، نقایص نظام حل اختلاف، هندسه تغییرپذیر و ناپایدار، آثار منبعث از تصمیمگیریهای نهادین، ملاحظات سیاسی، آیینهای بعضا غیرموثر و نقش ضعیف مدیرکل سازمان. همچنین به طور خاص از رهگذر نقض موافقتنامهها، مشکلاتی نیز دامنگیر اعضاء و ارکان سازمان میشود که از یکسو به روابط معاهداتی اعضاء با یکدیگر، صدمه وارد میسازند و از سوی دیگر، بر کارکرد موثر و مطلوب سازمان و همچنین بر شیوههای جبران تاثیر مستقیم دارند. فلذا تحلیل چالشهای ناشی از نقض موافقتنامهها، موضوع اصلی تحقیق حاضر است.

«عدالت» همواره آرمان دیرینه بشریت بوده و خواهد بود به گونهای که ریشه بسیاری ازاختلافات و مخاصمات را باید درعدم دستیابی نوع بشر و یا جوامع بدان جستوجو نمود. انسان به مقتضای ذات خویش همواره خواهان عدالت در هر زمان و مکان و در روابط اجتماعی خویش بوده است. سازوکارهایی که در این مسیر در حقوق داخلی جوامع مختلف صورت گرفته تا حدود زیادی تضمین کننده عدالت گردیده است اما به دلیل فقدان، نقصان و یا عدم کارایی چنین سازوکارهایی در حقوق بینالملل، اجرای کامل و مطلق عدالت با مشکلات خاص خویش روبهرو بوده و راه دشواری را در پیش رو دارد. اگر چه نمیتوان به ضرس قاطع مبنای الزامآور بودن حقوق بینالملل در حال حاضر را، عدالت و تحقق آن دانست با این حال نمیتوان منکر رویکرد و تمایل جامعه بینالمللی به این موضوع و وضع اصول و مقرراتی بر این مبنا گردید و این روند در حال تکامل است.

بدون تردید برقراری صلح و امنیت بینالمللی، در گرو آن است که دولتها به طور تام و تمام به تعهدات بینالمللی خود پایبند باشند. یکی از این تعهدات را باید تعهدات حقوق بشری دولتها دانست که دولتها چه در زمان صلح و چه در هنگام درگیریها اعم از داخلی و بینالمللی ملزم به گردن نهادن به موازین و اصول آن هستند. بحرین یکی از کشورهایی بود که از سیل دموکراسیخواهی جوامع عرب دور نماند و دستخوش حوادثی گشت که در کلیت آن عنوان «بهارعربی»[1] را به خود اختصاص داده است. مردم کوچکترین کشورعربی خلیج فارس هم در تکاپوی دموکراسی به پا خواستند و گرچه بیش از چهار دهه بر سر مطالبات خود با حکام بحرین در نزاع بودند، اما اعتراض جدی مردم بحرین علیه حاکمیت از 14 فوریه 2011 شروع شد و شکل عمومی یافت. در مقام پاسخگویی به حرکت نوپای مردم، حکومت به مقابله و رویارویی با جنبش روی آورد و سعی در خاموش نمودن صدای مردم نمود. در این بین، حاکمیت بحرین گاهی تعهدات بینالمللی خود و به طور خاص تعهدات حقوق بشری خود را از یاد برد و بسیاری از حقوق اساسی معترضان را زیر پا گذاشت. این مقاله در ابتدا موارد نقض حقوق بشر را به صورتی متقن برشمرده و سپس با بررسی تعهدات بینالمللی آن کشور، موارد تخطی از این مقررات و تعهدات را تشریح نموده است.

قوانین متعدد، اسناد و معاهدات کثیر بینالمللی در سطوح مختلف در حقوق محیط زیست به وجود آمدهاند و به جنبههای مختلف از محیط زیست پرداختهاند. حقوق محیط زیست همیشه و همواره در یک تلاش و مبارزه مستمر برای حل معضل آلودگی بوده، با منشا آن مبارزه کرده، میزان آن را معین نموده است و همیشه به دنبال یافتن راه حل بوده است. چالشهای متنوع و متکثر زیستمحیطی سیاره ما را احاطه کرده است. گسترش آلودگیها و حرکت آن از مناطق تحت صلاحیت یک کشور به مناطق خارج از آن نشاندهنده وابستگی متقابل اجزای مختلف محیط زیست در مفهوم عام آن است و دیگر در این دیدگاه، محیط زیست تنها در محیط زیست یک ملت، محصور در یک سرزمین نخواهد بود چون غالب فعالیتهای انسانی در یک کشور، ممکن است آثاری فراتر از کشور منشا آن فعالیت داشته باشد. کشفیات علمی نکات مهمی را در حوزه محیط زیست اثبات نموده است. نکته اول یکپارچگی کره زمین است. آلودگی بخشی از کره زمین میتواند به بخش دیگری تسری پیدا کند. آلودگی آب باعث آلودگی خاک میشود. نکته دوم این است که آلودگی ماهیتا مرزگذر است و مرز نمیشناسد. پرندگان، آبها، جریانات جوی، ناقل آلودگیاند. و بالاخره نکته سوم، تاثیر انواع آلودگی بر یکدیگر است. و باید بر این نکات، موضوعی به نام انتقال و صدور آلودگی را نیز افزود که میتواند یکی از موضوعات مهم و نگرانکننده جامعه بینالمللی باشد. به عبارتی صدور و انتقال آلودگی موضوع میافزاید، یعنی علاوه بر اشاعه و نشر آلودگی به لحاظ ویژگیهای یکپارچگی زیستکره و ماهیت خود آلودگی که هرگز نمیتواند ساکن و بیتحرک باشد، جابهجایی، انتقال و صدور مواد آلاینده به قصد اینکه از منشا آن دور شده و به نقطه دیگر منتقل شود و یا اینکه بدون وجود چنین قصدی، آلودگی با دخالت عامل انسانی به همراه منشا آن، به نقاط دیگر منتقل میشود، واقعیتی انکارناپذیر است. بنابراین تبیین مفهوم و خاصه مقایسه آن با آلودگیهای فرامرزی بسیار ضروری است.

این مقاله با هدف بررسی و شناخت بیشتر وظایف و مسوولیتهای متصدی حملونقل در قبال خسارت کالا میباشد. از آنجایی که حملونقل بینالمللی کالا نقش اساسی در تجارت بینالمللی ایفا میکند، علاوه بر فروشندگان و خریداران کالا، متصدیان حملونقل در این خصوص به عنوان یکی از ارکان اصلی و اساسی، تلقی میشوند. همچنین متصدیان حملونقل دریایی در جابهجایی کالا در عرصه بینالمللی نقش ویژهای دارند. تعریف وظایف و مسوولیت آنها درابعاد بینالمللی خصوصا در زمینه مراقبت از کالا و ایمنی آن، قانونمند شدن فعالیت آنها را به دنبال دارد. کنوانسیون هامبورگ به طور مفصل در مورد مسوولیتها بحث کرده است اما چون حملونقل دریایی کالا که امروزه به شیوههای مدرن انجام میگیرد خصوصا با ظهور مبادلات الکترونیکی، تجدید نظر در مسوولیتها برای هماهنگی و مراقبت از کالا در روابط متصدیان حملونقل با صاحبان کالا از اهمیت ویژهای برخوردار است که به نظر میرسد کنوانسیون روتردام نیز در این راستا تنظیم شده است و به بررسی و تکمیل و شفافسازی این موضوع (حملونقل) میپردازد. نتایج این پژوهشها نشان میدهد که مسوولیت حمل کنندگان کالا و محمولات با توجه به قراردادهای منعقده فیمابین آنان و صاحبان کالا و... جمیع شرایط تاثیرگذار بر مسوولیت آنها نیز دارای اهمیت شایانی است و برای توسعه و پیشرفت در این زمینه ضروری است که مقررات کاملتر و دقیقتری وضع شود که به نظر میرسد کنوانسیون روتردام تا حدی توانسته است به این مهم دست یابد.

The idea of arbitration as an important tool of peaceful settlement of disputes and realization of justice is and universal and continuous notion and is deeply rooted in the history and cultures of most civilizations. Not surprisingly, the universality and continuity of the concept of arbitration, in the context of maintaining international peace and with particular emphasis on the institutional aspects of international arbitration. It is also worth pointing out that a considerable degree of convergence among various arbitral mechanisms as to core elements of arbitral process such as the principle of competence-competence, observance of due process, independence and impartiality of all arbitrators, obligations of the parties to comply with the procedure, the binding nature of the award, and the finality of the award is noticeable.

The joint plan of Action agreed in Geneva on November 24, 2013, between the p5+1 nations and Iran (JpA or "Iran and 5+1 Nuclear Agreement") is a politically binding instrument but with important legal indirect implications on legal rights and duties of the parties in international nuclear law. Whereas the inapplicability of the Security council Resolutions on Iran's nuclear issue, a decade crisis directed the relevant parties to partially restrict and implement the SC regulatory and punitive provisions. Terminate (unlawful) sanctions (multilateral and unilateral) and also resolve some misunderstandings on Iran nuclear program. These developments opened a window to revise past safeguards problems within the IAEA and the UN. At a practical viewpoint, this agreement is a state practice, a concept related to international law sources in the ICJ Statute , Art . 38. This practice, substantiated the sufficient degree of participation on the part of states whose interests are likely be most affected. This paper analyzes the JPA in light of international legal order especially international nuclear law and UN law.

WTO law links covered agreements with Dispute settlement Understanding rules. This matter makes the member commitments to compulsory process of negotiation, arbitration, appeal and effective enforcement that ultimately their goals are elimination of violation without costs and damage to the trade relations. With regard to all WTO achievements, rather there are some obstacles in WTO laws, so that some scholars have mentioned them as a (legitimacy crisis). in this view there are some fundamental challenges for World Trade organization; such as, WTO universality and the problem of integrating trade liberalization, erosion in the non-discriminations principle, state sovereignty base of members, lacking Solidarity and coordination with governmental organizations, lacking transparency in relation with Civil society, deficits in the dispute settlement system, unstable and mutable from, effects arising from official Decision making, political Considerations, some process that are Occasionally ineffective and the weak role of WTO director general. Furthermore when Agreements are violated, in particular, it has some challenges between members and WTO Organs that damages contractual relations between members. The violation has direct effect on WTO favorable function and compensation. Therefore in this article analyzing challenges arising from violation of the WTO agreements is the main debate.

"justice" has always been ancient ideal of human and will be continue in such a way that root of many disagreement and conflicts ought to look for in none achievement kind of human or communities to it. Human has been always seeking justice as instinct mood in everywhere and every time and in self social relationship. The efforts and structures that for this purpose are done in domestic law of different society, in so much has guaranteed justice but because of absence or defect or none efficiency of such efforts and structures in international law, perfect and absolute implementation of justice be faced with itself specific problems and has difficult way in affront. Although, we can not imply crucially that binding basis of international law in current situation is justice and achievement to it, but we cannot ignore attitude and tendency of international community toward this issue and approval of principle and regulations on this basis and yet this process is continued.

International peace and security cannot be established unless the states respect their International obligations thoroughly. One of these obligations is the human rights; norms Which must be respected both during peace and war times. As in many Arab countries of the region, Bahrain experienced the torrents of democratic movements and protests generally known as the "Arab Spring" In pursuit of democracy, the People of the smallest Arab country of Persian Gulf region revolted. Though their demands Had roots in more than four decades ago, but their widespread protests against the Bahraini regime started on 14 February 2011. Bahrain government, in its turn, encountered the protesters harshly and suppressed the movements.In this context the government of Bahrain, ignoring its human rights obligations, tremendously violated citizens' basic rights. In this article we have first enumerated the some Of the most important cases of human rights violations, and then these violations are compared to the relevant treaty obligations of Bahrain.

Numerous laws, international documents and treaties at different levels were created on environment law and the various aspects the environment were addressed. Air, soil and Water as the main elements of environment have been targeted. Environmental law has always been in constant effort and struggle to solve the pollution problem, has fought its origin, has determined its rate, and is always looking for the answer to the question of what must be done. All this is done because'' the pollution is the primary goal of environmental law.Varied and diverse environmental challenges have surrounded our planet in such a way that the environment, in its general sense, is caught in it. The spread of pollution and its move from areas under the jurisdiction of a country to outside the region represents the interdependence of various components of the environment in general. And in this view, environment would not be an issue of a single nation and would not be bound to a single region, because most human activities in on state may have effects on states beyond its original state, whether bilateral, regional, meta- regional or international. "Scientific discoveries have proved important points in the field of environment. The first point is the integrity of the Earth. The Earth is unified; i.e; pollution of part of the earth can spread over other parts, water pollution results in soil pollution. The second point is that the contamination is border crossing, it's blind to borders. Birds, water and climate flows are carriers of pollution. Third and finally is the influence of kinds of pollution on each other. To these points; transfer and export of pollution, which can be one of the important and worrying issues of the international community, must be added. In other words, export and transfer of pollution adds to the complexity of the issue, namely in addition to dissemination of pollution, integration features of biosphere and the nature of pollution itself which can never be settled, and transporting and exporting pollutants together with it's origin with human intervention will be transferred to other locations, whether deliberate or unelaborated, is an indisputable fact. Therefore, it is necessary to explain its meaning and compare it with transboundary pollution.

The Purpose of this article is study and more understanding of duties forwarding agent's duties and responsibilities for goods damage. Since international goods transport plays essential role in international trade, in addition to goods sellers and purchasers, forwarding agents are considered one of principal pillars in this regard. Also, sea carriage agents internationally have a special role in transfer of goods. Definition of their duties and responsibilities from international aspects especially with regard to taking care of goods and their safety has a consequence the regulation of their activities. Hamburg convention discusses in details these responsibilities, but since sea carriage of goods which today is carried out through modern ways particularly with emergence of electronic exchanges, revision in responsibilities for coordination and care of goods is of especial importance in relationship of forwarding agents with commodity owners. It seems Rotterdam Convention, by study and completion of this matter (transportation) and making it transparent, is drawn up in line with the above legal objectives.
