    یکی از مسائل مهم علوم دینی و علوم انسانی، فهم معنای متن است. هرمنوتیک یکی از شاخه های علوم انسانی است که به بح‍‍ث در مبانی نظری تفسیر و فهم متن می پردازد. علم اصول فقه نیز هدف مشابهی را دنبال می کند زیرا وظیفه ی آن، استنباط حکم شرعی از متون و منابع دینی است و از این روست که اصولیان - در بحث الفاظ - ناگزیر به کشف قواعد فهم متون هستند.
    با توجه به زمینه های مشترکی که میان این دو رشته علمی وجود دارد، مطالعه تطبیقی میان آن ها ضروری به نظر می رسد تا با شناخت مبانی مشترک، بتوانیم از اصول و موازین متقن فهم متن درک بهتری داشته باشیم.
    از آنجا که در میان شاخه های هرمنوتیک، هرمنوتیک کلاسیک نزدیکی بیشتری با اصول فقه دارد، در این پژوهش که به شیوه توصیفی-تحلیلی همراه با گردآوری اطلاعات اسنادی و کتابخانه ای انجام گرفته است، به بررسی مبانی مشترک میان اصول فقه و هرمنوتیک کلاسیک پرداخته شده است و از این رهگذر شش مبنای مشترک میان آن دو تبیین گردیده است؛ 1. مولف محوری 2. معیارگرایی 3. عینیت گرایی و تعین معنا 4. امکان عبور از موانع تاریخی فهم (اصاله عدم النقل) 5. تبعیت از قواعد عام فهم 6- پرهیز از تاثیر پیش فرض ها.

    حق حیات و زیست از جمله حقوق مشترک انسانی است که کرامت ذاتی انسان، آن را برای آحاد بشریت ایجاب می نماید و کسی اجازه ندارد آن را از دیگران سلب نماید. خروج از این قانون بشری که مستظهر به آموزه های متعالی اسلام نیز هست، نیاز به ادله ای متقن دارد. از این رو در صورتی که نسبت به تجویز اعدام تردید وجود داشته باشد باید اصل اولیه یعنی عدم مشروعیت سلب حیات، مبنای عمل قرار گیرد. در کیفیت مجازات زنا با محارم آن چه به عنوان مذهب جمهور امامیه تلقی شده و در متن قانون مجازات اسلامی نیز انعکاس یافته اعدام است. در اثبات این نوع نگرش به ظاهر روایات و نیز اجماع استناد شده است اما به نظر می رسد ادله ای که به منظور اثبات اعدام مورد تمسک واقع شده، در تامین این جهت کفایت لازم را ندارند. در این پژوهش نتیجه ای که از بررسی مستندات اعدام حاصل می شود عدم مشروعیت آن است.

    با نگاهی به ادله قاعده، آنچه از مفهوم موافق «کتاب» و «سنت» در خصوص سلطنت بر اموال بدست می آید حرمت تصرف دیگران در نفس انسان است که این ربطی به اثبات سلطنت او بر نفس خود ندارد و محدوده اعمال ولایت انسان بر اعضای خود در نزد عقلاء مبنی بر سلطنت بر هرگونه تصرفی و در هر عضوی مشخص نیست و سیره اجمال دارد.
    بر فرض مجمل نبودن سیره و اینکه سیره بر هر گونه تصرفی و در هر عضوی دلالت کند، مباحثی همچون حرمت «ضرر بر نفس» و «قتل نفس» و... به عنوان محدود کننده این سلطنت نمی تواند مورد استناد قرار گیرد، چه اینکه ادله آن، دلالتی بر این زمینه ندارند و نمی توانند حاکم بر قاعده باشند و مطلب از این جهت قابل خدشه نخواهد بود.

    شیخ مرتضی انصاری از بزرگ ترین فقی هان اصولی إمامیه و یکی از چهره های علمی و فقهی قرون متاخر به شمار می آید. تسلط، ابتکار و ظرافت وی در مسائل اصولی و فقه روایی-استدلالی بجامانده از وی موج می زند. در این میان تحقیقات ارزشمند وی پیرامون «نقد و بررسی سند حدیث» در میراث علمی وی که گویای تسلط و ابتکار وی در علم رجال و اصول نقد حدیث است از یک سو و اهمیت بازخوانی نظام فکری وی در عرصه فقه روایی به ویژه در ابعاد نقد سند حدیث و نیز جایگاه امروزی روش شناسی در علوم، ضرورت پژوهش در این عرصه را بیش از پیش نمایان می سازد. لذا این نوشتار که با تتبع بسیار و به روش توصیفی-تحلیلی در آثار اصولی و فقهی شیخ انصاری سامان یافته، به دنبال ارائه روش شناسی اندیشه نظام مند شیخ انصاری در «شیوه های نقد سند حدیث» در فقه روایی-استدلالی است. بررسی ها نشان می دهد که توجه به ویژگی شخصیتی راویان (همچون اصحاب اجماع، مشایخ الثقات، مروی عنه احمد بن محمد بن عیسی، بنی فضال)، توجه به اضمار حدیث، بررسی اتصال سند، اشاره به مجهول بودن راوی، توجه به اشتراک راویان، انجبار ضعف سند از مهم ترین شیوه های شیخ انصاری در نقد سند حدیث بشمار می آید.

    نظام حقوقی اسلام، نهادی تاسیس کرد که بر اساس آن، پیروان ادیان سه گانه- یهود، مسیحیت و زردشتیان- به شرط پذیرش قراردادی زیر عنوان «ذمه»، در بسیاری از حقوق و تکالیف شهروندی با مسلمانان، همانندی می جویند؛ در همین حال، هیچ گاه از حقوق برابر برخوردار نمی شوند. در سال های اخیر دانشیان مسلمان، تلاش کرده اند تا این حکم را توجیه کنند و تبعات منفی آن را به کم ترین اندازه فروکاهند.
    نگارندگان در این کوتاه سخن کوشیده اند تا ثابت کنند غالب احکام فقهی قرارداد ذمه، به واسطه تبدل موضوع، تاثیر زمان و مکان، فقه المصلحه و فقه حکومتی، بایسته تغییرند چرا که مفهوم ذمی و بسیاری از احکام پیرو آن، وابسته به دوران پیشامدرن است، دورانی که مفاهیم کشور، سرزمین، مرز، تابعیت و... هستی نیافته بودند یا در معانی امروزین آن، به کار نمی رفتند.
    البته این سخن به آن معنا نیست که هیچ گونه دوگانگی قانونی میان شهروندان مسلمان با اهل کتاب، وجود ندارد، چراکه هنوز در برخی از دامنه ها همانند: احوال شخصیه، هم چنان، می توان قائل به دوگانگی بود.
    متدولوژی اثر پیش رو، آمیزه ای است از نگاه درون فقهی (اجتهاد سنتی با ادله و مستندات فقهی) و نگاه برون فقهی که یک معرفت درجه دوم و به اصطلاح، فلسفه فقهی است.

    بر اساس فتوای مشهور بلکه اجماعی در میان فقهای اسلام، ازدواج مرد مسلمان با زنان کافر غیر اهل کتاب، جایز نیست. هرچند این فتوا، مبتنی بر دلیل های مستحکمی مانند برخی از آیات قرآنی، اجماع و شماری از روایات است، ولی به نظر می رسد مورد این دلیل ها، زنانی است که به کفر و شرک اعتقاد دارند و خود را نسبت به عقاید کفرآمیز و مشرکانه، متدین می دانند و از زنان فراوانی که اسلام و نیز ادیان دیگر را نمی شناسند و نسبت به دین حق، دشمنی نمی ورزند و به تعبیر روایات «مستضعف» محسوب می شوند، انصراف دارند و بر همین اساس، می توان دست کم، در موارد عسروحرج، ازدواج مرد مسلمان با این گونه زنان و نیز باقی ماندن مرد تازه مسلمان بر ازدواج با آنان را جایز دانست.

    بخش قابل توجهی از گزاره های موجود در ابواب مختلف فقه شیعی مبین وظیفه عملی مکلفان نسبت به مخالفان مذهبی است. مقصود از مخالفان مذهبی در معنای عام آن تمام افرادی اند که از نظر عقیدتی، اعتقادی جز باور شیعه اثناعشری دارند. در این میان اهل سنت به عنوان گروه عمده ای از مخالفان مذهبی امامیه در لسان فقهای شیعی به طور خاص مخالف نام گرفته اند. یکی از مهم ترین، بحث انگیزترین و در عین حال پرکاربردترین گزاره های فقهی مربوط به مخالفان در باب عبادات، مسئله شرکت در نماز جماعت و اقتدا به ایشان است. تمام فقهای امامیه حکم اولیه شرکت در جماعت مخالفان و اقتدا به آنان را منع و عدم جواز دانسته اند. اما در مقام بیان حکم ثانویه میان ایشان اتفاق نظر نیست. برخی فقط قائل به جواز شرکت در جماعت مخالفان و همراهی با آنان در صورت تحقق شرایط خاص اند. در حالیکه برخی دیگر مثل امام خمینی و شاگردان مکتب فقهی ایشان افزون بر جواز شرکت، اقتدا به مخالفان را هم جایز دانسته اند.
    در این مقاله ضمن بازخوانی اقوال و آرای فقهی درباره این مسئله، به بررسی ادله فقها در حکم اولیه و ثانویه پرداخته شده، دیدگاه و نظریه مختار درباره کیفیت حضور در جماعت مخالفان در شرایط خاص، با رویکرد ویژه به دیدگاه امام خمینی بیان شده است.

    One of the important issues in the humanities in general and in religious studies in particular is the comprehension of the meaning of the text. Dealing with the theoretical bases of interpretation and comprehension of the text, hermeneutics is a branch of the humanities which fully serves this objective. The same objective is likewise followed in the study of the principles of jurisprudence (usūl-i fiqh) whose function is the inference of religious precepts from the existing religious texts and resources. Dealing with the words and terms in these resources, the scholars of principles of jurisprudence are thus obliged to discover the rules for text comprehension. Concerning the common grounds shared between hermeneutics and the principles of jurisprudence, the conduction of a comparative study seems
    necessary for the better understanding of definite principles and standards of text comprehension in light of the common foundations of the two disciplines. Since among all branches of hermeneutics the classical hermeneutics has the closest affinity to principles of jurisprudence, the present descriptive analytical study, applying library data and textual references, investigates the common foundations shared between the two disciplines of classical hermeneutics and principles of jurisprudence and describes the following six common foundations: 1.The centrality of the author 2.Normalism 3.Objectivism and meaning determination 4.The possibility of surpassing the historical obstacles of comprehension (the principle of non-transference of meaning) (isālat-i ‘adam-i naql) 5.Following the common rules of comprehension 6.prevention of the influence of the presuppositions.

    The right to live is a common human right, which is essential to every individual human being due to the inherent dignity of the human person. No one is allowed to take this right from another human being, and the transgression of this human law, which is also supported by the transcendent teachings of Islam, requires perfect reasons. Therefore, in case of uncertainty about whether to sentence an individual to death or not, one should observe the primary principle, that is, the illegitimacy of taking an individual’s life. Concerning the punishment for incest, what is considered to be the opinion of the dominant majority of the Imamite school is the
    necessity of the convicts’ execution, which is also reflected in the Islamic Penal Law. This view has been supported by the exterior of the traditional narratives as well as the consensus of the Shiite jurists. It seems, however, that the reasons put forward in justification of this punishment do not necessarily suffice. Our investigation of the related textual references, in the present study, shows the illegitimacy of execution as a prescribed punishment for incest.

    With regard to the evidences of the rule, what is inferred from the Qur’an and the Tradition (sunna) about the matter of authority over possessions, is the impermissibility of other’s invasion of human self, which is totally unrelated to the assertion of one’s authority over oneself. The realm and the quality of human’s authority over his own organs are not known to the wise, as the relevant points about this matter are insufficient in biographical literature of the Prophet (sīra).
    In case that one considers the biographical literature of the Prophet as sufficient for proving the permissibility of every kind of man’s authority over his own organs, the issues such as the prohibition of “causing harm to oneself”, “killing oneself” and etc. cannot be applied to restrict this authority, for the proofs of the prohibition of such acts have no implications with respect to this authority, and cannot rule it out. Thus it will cause no flaws in the argument.

    Sheikh Murtaza Ansārai is regarded as one of the greatest Imamite jurists, and one of the prominent scholarly and juristic figures of the last centuries. His proficiency, originality and gumption are evident in his surviving works regarding problems in principles (usūl) and traditional-demonstrative jurisprudence. His precious researches on “investigation and criticism of chain of transmission of hadīth”, which manifest his skill and innovation in the science dealing with the transmitters (‘ilm al-rijāl) as well as principles of criticism of hadith, on the one hand, and the significant function of academic methodology in the present time, on the other hand, necessitates, more than any time before, a rereading of Sheikh Ansāri’s system of thought regarding traditional jurisprudence in general and the criticism of hadith in particular. The present descriptive analytical study, which is done with a lot of research on Sheikh Ansāri’s works on jurisprudence and its principles, seeks the introduction of Sheikh Ansāri’s methodology of systematic thinking concerning “the techniques of the criticism of chain of transmission of hadith” in traditional-demonstrative jurisprudence.
    Our investigations show that the most important techniques Sheikh Ansari applied in his criticism of chain of transmission of hadīth consist of the following items: paying atterntion to the personality characteristics of the transmitters (like the people of consensus (ashab al-ijma‘), trustworthy sheikhs (mashāyikh al-thiqa), Ahmad b. ‘Isā narrated from him (rawī ‘anh), sons of faḍḍāl (banī faḍḍāl)), paying attention to the concealment of the original teller of the hadīth (iḍmār-i hadīth), cohesion of the chain of transmitters (ittiṣāl-i sanad), mentioning the anonymity of the transmitters, paying attention to the sameness of the names of the transmitters, and compensation (injibār) for the weakness of hadīth.

    The Islamic legal system established an institution based on which the followers of the triple religions, that is, Judaism, Christianity and Zoroastrianism, under the condition of accepting an agreement entitled as “dhamma”, could seek equality with Muslims in many citizenship rights and obligations; whereas, they have never enjoyed those equal rights. During recent years, Muslim scholars have tried to justify this rule and to reduce its negative consequences to the least possible extent. Considering the transformation of the case, the effect of time and place, and with regard to prudential jurisprudence as well as governmental jurisprudence, the authors of this brief article have attempted to prove that juridical laws regarding dhamma need to change, for the concept of dhamma and the many laws coming after that belong to the pre-modern era, when the concepts such as country, land, border, nationality and etc. either did not exist at all, or were not applied in their present sense. This doesn’t mean, however, that there is no legal dichotomy between the Muslim citizens and the People of the Book (ahl al-kitāb), for in many domains such as personal status (ahwāl al-shakhsīyya), one can still consider the dichotomy. The methodology of the present research is a combination of two
    different approaches: intra-jurisprudential ‒concerning traditional independent reasoning (ijtihād-i sunnatī) which uses juridical proofs and evidences‒ and extra-jurisprudential; a second degree knowledge which is so called a juridical philosophy.

    According to the famous or, better said, the unanimous judicial decree (fatwa) of the Muslim jurists, the marriage of a Muslim man to an unbelieving woman who adheres to any faith other than those of the People of the Book (ahl al-kitāb) is prohibited. Although this judicial decree is based on definite evidences such as certain verses of the Qur’an, consensus of the jurists, and a number of traditional narratives, it seems the women meant by these sources are those who believe in infidelity (kufr) and polytheism (shirk) and consider themselves as devotees to pagan and profane cults. Thus this judicial decree leaves out those many women who are not familiarized with Islam and other [Abrahamic] religions and have no animosity toward the True Religion, and as described by traditional narratives, are considered helpless (mustaḍ‘af). Therefore, at least in cases of distress and constriction, one can identify the marriage of a Muslim man to such a woman, and also the subsistence of the marriage of a newly converted Muslim man to his wife, as permissible.

    A considerable part of the statements in different Shi’ite jurisprudential chapters expresses the practical obligations of the obliged (mukallafīn) with respect to the denominational dissidents. The concept of denominational dissidents, in its general sense, refers to all those people who have any faith other than the Twelve-Imam Shiism. Among all such dissidents, the people of the tradition (ahl al-sunna), as the major group of the dissidents of the Imamīs, are specifically referred to, by the Shiite jurists, as “the dissidents”. One of the most important, most controversial, and at the same time, most applicable jurisprudential statements about the dissidents in the chapter on the acts of devotion (bāb al-‘ibādāt), regards the participation in their communal prayers and following their leadership (iqtidā). All the Imamī jurists have identified the primary legal precept for this question as prohibition and impermissibility. But they do not agree with each other about the secondary precept. Some maintain the permissibility of participation in the dissidents’ communal prayers as well as their companionship, in special circumstances. While, some others like Imam Khomeini and the students of his jurisprudential school permit not only participating in the dissidents’ communal prayers, but also following their leadership (iqtidā), in special circumstances.
    Reconsidering the jurisprudential sayings and views about the above-mentioned question, and with special regard to Imam Khomeini’s viewpoint, the present article investigates jurists’ proofs of the primary and secondary precepts, and explains the chosen view on the quality of presence in the dissidents’ communal prayers in special circumstances.
