    کار کودک پدیده ای است که در جهان امروز قابل پذیرش نیست آن هم بدان دلیل که کودکان را از دوران کودکی خود محروم ساخته و برای رشد فیزیکی و روانی آن ها زیان آور است. عوامل گوناگونی همچون فقر و خلاءهای قانونی منجر به کار کودک می گردند. کار کودکان پیامدهای مختلفی همچون پیامدهای منفی فیزیکی، روانی و اجتماعی با خود به همراه دارد. کودک به عنوان یک انسان دارای حقوق اساسی و مشترک با سایر انسان ها هست. از سوی دیگر محرومیت از تحصیل هر کودک می تواند آسیب عاطفی، ذهنی و اجتماعی را برای وی به همراه داشته باشد، کودک را از قابلیت های زندگی آینده اش محروم نموده، در بلندمدت نیز موجب افزایش آسیب ها و ناهنجاری های اجتماعی گشته و هزینه گزافی را به جامعه تحمیل نماید. در همین چارچوب در این مقاله به ویژه علل و پیامدهای کار کودکان و نقش آموزش در حذف کار کودک و در رشد و توسعه شخصیت آن ها بررسی گردیده و اهداف برنامه بین المللی حذف کار کودک تحلیل می شوند.

    هر گاه از منظر تاریخ به مفهوم «حقوق بشر» بنگریم، در می یابیم که این مفهوم همراه با تحولات و متغیرهای گوناگون دستخوش بسط و تکامل بسیاری بوده است، از مرحله بی حقوقی به مرحله حقوق انگشت شمار «طبیعی» و محدود به ملت های مشخص، تا مرحله حقوق فراگیر. مهم ترین زمینه نهادینه شدن مفاهیم حقوق بشر در عرصه جهانی و نیز تبدیل این مفاهیم به رویه های بین المللی، از زمان تاسیس سازمان ملل متحد به وجود آمد. اصولا سنگ بنای سازمان ملل بر اساس پذیرش مفهوم حقوق بشر است. مقدمه منشور ملل متحد از حقوق بنیادین انسان ها و لزوم احترام به این حقوق، به میان آمده است، «همکاری بین المللی به منظور تشویق همگان به رعایت حقوق بشر و آزادی های اساسی... » ذکر شده است. شورای حقوق بشر در سال 2006 به عنوان نوپا‎ترین رکن فرعی حقوق بشری سازمان ‎ملل‎ متحد تاسیس گردید که هدف آن ارتقاء و حمایت از حقوق بشر در تمام کشورها می‎باشد. دولت جمهوری اسلامی ایران علاوه بر منشور ملل متحد که برخی مواد آن به موضوع حقوق بشر اختصاص دارد، بسیاری از معاهدات بین المللی حقوق بشر را امضاء و تصویب نموده است. در نوشتار پیش رو، سعی گردیده است که ساختار شورای مذکور و تعاملات جمهوری ‎اسلامی ‎ایران با آن مورد بررسی قرار گیرد.

    تحقیق حاضر در زمینه یکی از اساسی ترین مباحث در حوزه تعلیم و تربیت سیاسی و برنامه درسی تحت عنوان آموزش حقوق بشر انجام شده است. هدف اصلی این تحقیق را دو مسئله تشکیل داده است که عبارتند از: شناسایی مفاهیم و مولفه های حقوق بشر و میزان توجه به مفاهیم و مولفه های حقوق بشر در برنامه های درسی مدارس متوسطه در نظام آموزشی ایران. در این تحقیق در زمینه مولفه های آموزش حقوق بشر سه حیطه اساسی دانش، توانش و نگرش حقوق بشر مد نظر قرار گرفته است و میزان توجه به این مولفه ها در سه حیطه طراحی، اجرا و ارزشیابی برنامه های درسی بررسی شده است. سوالات این تحقیق پیرامون نظرات معلمان، دانش آموزان و کارشناسان سازماندهی شده و روش تحقیق از نوع تحقیقات توصیفی پیمایشی بوده است. ابزار جمع آوری اطلاعات پرسش نامه محقق ساخته با آلفاکرنباخ 88% می باشد. جامعه تحقیق مشتمل بر 420 نفر از دبیران رشته علوم انسانی دوره متوسطه شهر کاشان در سال 1388-1389 می باشند که با استفاده از جدول تعیین حجم نمونه و فرمول کوکران تعداد دویست نفر از دبیران رشته علوم انسانی با روش نمونه گیری تصادفی طبقه ای و تعداد 27 نفر از متخصصان تعلیم و تربیت با روش نمونه گیری تصادفی ساده به عنوان آزمودنی انتخاب شده اند و نیز با استفاده از روش نمونه گیری تمام شماری تعداد پانزده نفر از کارشناسان برنامه درسی دوره متوسطه در دفتر برنامه ریزی و تالیف سازمان پژوهش در برنامه ریزی آموزشی به پرسش نامه ها پاسخ دادند. برای تجزیه و تحلیل داده ها در سطح آمار توصیفی (از جدول توزیع فراوانی، نمودار، میانگین و... ) و Tو F در سطح آمار استنباطی (آزمون و تحلیل واریانس یکراهه) استفاده شده است. نتایج نشان داد که دانش آموزان، معلمان و کارشناسان برنامه ریزی درسی با آموزش مفاهیم مطروحه حقوق بشر در حیطه های دانش، توانش و نگرش موافقند. کارشناسان برنامه درسی میزان توجه به مفاهیم و مولفه های حقوق بشر را در حیطه طراحی برنامه درسی بسیار و نسبتا کم ارزیابی کرده اند. بین نظرات دانش آموزان، معلمان و کارشناسان در خصوص آموزش صلح تفاوت معنی داری وجود ندارد.

    جامعه بین المللی به رغم پیشرفت های شگرفی که در عرصه های مختلف حقوق بین الملل و به ویژه در زمینه حقوق بشر داشته است، متاسفانه هنوز شاهد وقایع و بحران های دهشتناکی می باشد؛ این بحران ها علاوه بر نابودی جان و مال و امنیت بسیاری از انسان ها، حاکمیت و امنیت ملی برخی از کشورها را نیز در معرض تهدید و آسیب قرار داده است. ناکارآمدی روند مداخله بشر دوستانه و عدم انطباق آن با مقررات حقوق بین الملل و همچنین ناکارآمدی نظام امنیت بین المللی موجود، اندیشمندان حقوق بین الملل را بر آن داشت تا با ارائه نظریه مسئولیت حمایت، باب مفاهیم جدیدی را در عرصه حقوق بین الملل، بگشایند. مسئولیت حمایت مبنای اقدام شورای امنیت و برخی کشورها در بحران هایی همچون دارفور سودان، عراق، یوگسلاوی سابق و گرجستان و غیره بوده است. این نظریه که از اواخر دهه نود قرن گذشته مطرح و در سال 2005 مورد تصویب سران جهان قرار گرفته و پس از آن در سال های 2009 و 2011 مورد استقبال و حمایت جامعه بین الملل قرار گرفته است، در احکام و مقررات نظام حقوقی اسلام نیز محمل های قوی داشته و به نحو قاطع و ملموسی در قرآن و سنت به منصه ظهور رسیده است. بدیهی است توجه و پذیرش این نظریه و یا عدم اعتناء به آن بر نظام امنیت جهانی و نیز امنیت ملی دولت ها تاثیرگذار بوده و هست.

    در موضوع جرم انگاری، حقوق بشر با چالشی آشکار مواجه است؛ از یکسو تاکید بر خوداستقلالی انسان ها، راه را بر هر گونه ایجاد محدودیتی بسته است و تنها اصل ضرر را یگانه معیار جرم انگاری معرفی می کند. از سوی دیگر تصریح به اخلاق عمومی و مقتضیات صحیح اخلاقی در متن اعلامیه و میثاق، موهم این امر است که شاید بتوان از اصل ضرر فراتر رفت و پدرسالاری قانونی و اخلاق گرایی قانونی را نیز به عنوان معیارهای جرم انگاری مورد پذیرش قرار داد. نویسندگان حقوق بشر به چنین چالشی توجه نداشتند، اما به مرور خوداستقلالی، اصل ضرر را به عنوان یگانه معیار جرم انگاری مبتنی بر حقوق بشر مورد پذیرش قرار داد و به حذف جرم انگاری های مبتنی بر سایر معیارها همت گمارد. در این مقاله به بررسی چالش خودمختاری و مقتضیات صحیح اخلاقی که هر دو مورد تاکید اعلامیه حقوق بشر هستند، خواهیم پرداخت و نتایج هر یک را مورد واکاوی قرار خواهیم داد.

    Child Labour is a phenomenin not any more acceptable in the modern world, mainly because it deprives children of their childhood and because it is harmful to their physical and mental growth.Different factors such as poverty, lack or non-enforcement of regulations lead to child labour. Child labour has different consequences such as physical, mental and social consequences. Deprivation of a child from education leads to social, mental and emotional damages; in addition to depriving the child from his/her future capabilities in life, it results in social disorders and damages in a long-term period and it incurs high costs on society. So, in this article, causes and consequences of child labour and the role of education in eliminating child labour and development of their personality will be addressed and the goals and objectives of International Programme on Child Labour will be analyzed.

    Whenever we look at the concept of "human rights" from historical point of view, we can see that this concept with different changes and variables, has been much developed and evolved. From the lawlessness to a period with a few natural rights and limited to some specific nations, to a period with universal rights. The most important concepts underlying the institutionalization of human rights in the world and also converting these concepts into the international practices, came into existence since the founding of the United Nations. Basically, the cornerstone of the United Nations is based on the acceptance of the concept of human rights. The introduction of the United Nations Charter indicated to the fundamental human rights and need to respect these rights, as noted: the international cooperation in promoting and encouraging respect for human rights and for fundamental freedoms... . Human Rights Council was established in 2006 (1384 SH) as the first human rights subsidiary organ of the United Nations with the aim of promotion and protection of human rights in all countries. Islamic Republic of Iran, in addition to the UN Charter which some of its articles are dedicated to human rights, has signed and ratified many of international human rights treaties. The present article tries to study the structure of the UN Human Rights Council and interactions of the Islamic Republic of Iran with it.

    The present study has been carried out on one of the most fundamental issues in the field of political pedagogy and curriculum as human rights education programs within schools. The main objective of this study consists of two issues that include, identifying concepts and components of human rights as well as assessment of the amount of attention that has been paid to the concepts and components of human rights in the curriculum and educational system of high schools in Iran. In this study, regarding components of human rights education, three basic areas of knowledge, skills and attitudes in human rights education have been considered and the amount of attention to these components in the three areas of design, implementation and evaluation of curriculum have been reviewed. The questions of the research have been structured to examine teachers, students and expert's opinions. The research method is descriptive – analytical. The result collected by researcher - administered questionnaire based on Cronbach's alpha is %88. The study population includes 420 humanities teachers of high schools in the city of Kashan from 2009 – 2010. A total of 200 humanities teachers have been selected through using stratified random sampling and a number of 27 educators with simple random sampling as subjects of study have been selected through using sample size table and Cochran's formula. Also by using census sampling [2], a total of 15 curriculum experts of high school working in the Office of Planning and Compiling of Organization for Educational Research and Planning answered the questionnaire.
    To analyze the data at the level of descriptive statistics (frequency distribution tables, graphs, averages, etc.) and T & F in inferential statistics (ANOVA analysis test) was used.
    The results showed that there is agreement between students, teachers and curriculum experts regarding teaching the discussed concepts of human rights in areas of knowledge, skills and attitudes. Curriculum experts have evaluated the amount of attention to human rights concepts and components in the areas of curriculum designing relatively low. There is no significant difference among the opinions of students, teachers and experts regarding peace education.

    In spite of that international community have seen very huge progress in different aspects of international law , especially in humanitarian law , but unfortunately it is in front of a lot of big crisis yet ; these crisis had attacked the body, wealth and security of many humans and also had attacked the authority and national security of many countries. Insufficiency of humanitarian introversion and its contrary with international regulations and also insufficiency of international security had forced international jurists to open new notions as the responsibility to protect in international area. according to this theory that criticized in the articles of 138 and 139 of the 2005 world summit outcome , each country has the responsibility to protect of it nationals against Genocide , war crimes , race cleansing and crimes against humanity an in the case of failure of responsible country , international community through united nation organization has responsibility to protect of humanity by restore to peaceful diplomatic and humanitarian instruments including other peaceful instruments mentioned in the sixth and seventh chapter of the charter of the united nations against Genocide , war crimes , race cleansing and crimes against humanity . The Security Council and some countries based their actions of intervention on the responsibility to protect in the crisis such as Sudan, Iraq, former Yugoslavia and Georgia. This theory that commenced during 90th decade recognized by the 2005 and 2009 world summit outcome and also welcomed by the international community has very strong bases in Islamic rules and we can find some roots for it in holy Quran and holy prophets jurisprudence. it is obvious that the acceptance and applying with the responsibility to protect or non observance to it ,will influence the national and international security.

On the one hand, putting emphasis on individual autonomy of human beings has blocked any attempt to impose any restrictions, the harm principle being the only criterion of criminalization. On the other hand, putting stress on public morals and proper moral norms in the text of the UDHR and ICCPR implies that we may go beyond the harm principle and adopt legal patriarchy and legal morality as additional criteria in criminalizing human rights issues. Authors on human rights have failed to address this issue and as a result the harm principle has been gradually adopted as the only criterion in criminalizing human rights issues and this has resulted in the failure to take other criteria of criminalization into account. This article aims to address and explore the challenge between individual autonomy and proper moral requirements, both of which have been stressed in the UDHR. Each perspective will be analyzed critically.
