    اصولا هدف قواعد بین المللی حقوق بشر حمایت از ارزش هایی است که ریشه در کرامت ذاتی انسان دارند، و از این روی اساسا و ماهیتا تقید در مکان و زمان را برنمی تابند. اجرای این قواعد در فراسوی مرزهای ملی هر کشور، و تاکید بر اجرای متقارن آن قواعد با قواعد حقوق بشردوستانه بین المللی در زمان مخاصمات مسلحانه جلوه ای از آن ویژگی قواعد بین المللی حقوق بشر است. با این حال قواعد بین المللی حقوق بشر می بایست در ظرفی اجتماعی یعنی در قالب هر جامعه ملی به اجرا درآیند، جامعه ای که در آن دولت نه تنها موظف به احترام و تضمین رعایت حقوق بشر و آزادی های اساسی هریک از افراد است، بلکه مسوول حراست از منافع و مصالح عمومی نیز می باشد (حکمرانی مطلوب). بر این اساس، در نظام بین المللی حقوق بشر دولت واجد این حق و تکلیف است که در راستای حراست از نظم عمومی، امنیت ملی، سلامت یا اخلاق عمومی و یا رعایت حقوق و آزادی های دیگران، برخی از حق ها و آزادی های بشری افراد را طبق قانون محدود سازد. از سوی دیگر، به هنگام بروز یک وضعیت فوق العاده عمومی که حیات ملی را به مخاطره می افکند دولت می تواند با اعلام رسمی قبلی و منوط به قید و بندهای مختلف، به تعلیق اجرای برخی از قواعد بین المللی حقوق بشر مبادرت ورزد. بدیهی است که صلاحدید دولت در تشخیص مصالح جمعی و تعلیق اجرای شماری از قواعد بین المللی حقوق بشر مطلق نبوده و در احاطه قیود شکلی و ماهوی مختلفی قرار گرفته و از قابلیت کنترل قضایی (و یا شبه قضایی) برخوردار است. به نظر می رسد در عصری که اغلب جوامع ملی در احاطه عوامل مختلفی مثل جنگ، تروریسم، بلایای طبیعی، بحران های زیست محیطی و... قرار گرفته اند که بنیان های حیات جمعی آنها را در معرض خطر قرار داده است استفاده از حربه تعلیق اجرای تعهدات بین المللی در زمینه حقوق بشر وسوسه کننده و در عین حال خطرناک باشد. ادعای استمرار آن وضعیت ها برای مدت طولانی باعث شده که تعلیق قواعد بین المللی حقوق بشر همچنان بردوام بماند و این خود عاملی است که می تواند نظام جهانی حقوق بشر را که هنوز به ساز و کارهای پیشرفته نظارتی تجهیز نشده است، تهدید نماید.

    مبارزه با فقر از عمده بخش های فرایند توسعه اجتماعی به شمار می رود و در تحقق اهداف عالیه توسعه اجتماعی از جمله دستیابی به برابری، عدالت و انسجام اجتماعی و تامین صلح و امنیت جهانی موثر است. تحلیل اسناد بین المللی مربوط به توسعه اجتماعی نیز از اهمیت این مقوله در پروسه توسعه اجتماعی حکایت دارد و راهکارهایی برای رسیدن به وضعیت ایده آل حذف فقر مورد تاکید قرار گرفته است. بدیهی است که فقر در صورتی که مورد غفلت واقع شود، مشکلات عدیده ای گریبانگیر جوامع داخلی و جامعه جهانی می شود. زیرا فقر خود محرومیت و نابرابری و ناامنی می آفریند و ارکان توسعه اجتماعی بدین نحو با وجود معضلاتی چون تبعیض، عدم مشارکت، ناامنی و نیز آسیب پذیری در برابر بحران ها، فرو می ریزد. از این رو طی دستورالعملی برای توسعه اجتماعی می توان اهمیت سیاستگذاری صحیح در بعد داخلی برای توانمندسازی و ارتقای وضعیت اشتغال و نیز بهبود سیستم های حمایت اجتماعی برای تامین امنیت مردمان در برابر فجایع زندگی را قابل بررسی دانست. همچنین در بعد بین المللی، همکاری عنصر سازنده ای است که همواره مورد توجه اسناد معتبر جهانی واقع شده و ضرورتی برای تحقق توسه اجتماعی محسوب می شود.

    اینترنت تیغ دولبه ای است که از یک سو موجب ترویج حقوق بشر شده است و از سوی دیگر عرصه ای شده است برای نقض حقوق بشر. نقض حقوق بشر در فضای سایبر جلوه های ویژه ای به خود گرفته است و لازم است برای جلوگیری از نقض و جبران آن مکانیسم مناسبی یافت شود. برای انتساب نقض های حقوق بشر به دولت نظریات گوناگونی مطرح می شود که می توان به نظریات اقتدار دولتی، ماهیت عمل و تعقیب فوری اشاره نمود. در فضای سایبر احتمال نقض حقوقی چون آزادی بیان، آزادی اجتماع، آزادی دسترسی به اطلاعات، حق تعیین سرنوشت، حق مالکیت، حق بر حریم خصوصی و غیره وجود دارد. سازمان های حقوق بشری مجازی و سایت های ثبت شکایت اینترنتی از جمله ساز و کارهای حمایت از حقوق بشر در فضای سایبر هستند که از آن به «خودگردانی اینترنتی» یاد می گردد. همچنین کشورهای بالادستی اینترنتی می توانند در «تضمین حقوق بشر از سوی ثالث» نقش مهمی در حمایت از حقوق بشر در فضای سایبر داشته باشند.

    ایران به عنوان دارنده دومین ذخایر بزرگ گازی و سومین دارنده ذخایر نفتی جهان، ظرفیت مناسبی جهت جذب سرمایه گذاری در صنعت نفت و گاز دارد. نظام قانونی ایران رویکرد ثابتی در فرایند سرمایه گذاری خارجی نداشته و روش های متفاوتی توسط قوانین مختلف به فراخور مقام و موضع مقنن اتخاذ شده است. در این مقاله رویکردهای ثابت و موقتی قانونگذار ایران در این خصوص تحلیل می شود و با بررسی قوانین مختلف با توجه به تفکیک فعالیت ها در بالادست و پایین دست نفت، مشخص می گردد که مقنن در رویه ثابت خود نگاه خوشبینانه ای به سرمایه گذاری خارجی ندارد اما در برنامه های موقت توسعه ای، رویه مسالمت آمیزی در پذیرش سرمایه خارجی اتخاذ نموده است و با حصول شرایطی امکان جذب سرمایه خارجی را ممکن دانسته است. در نهایت تلاش می شود تا به قانونگذار پیشنهاد اتخاذ رویه ای مبتنی بر تسهیل ورود سرمایه گذاری خارجی در صنعت نفت ارایه گردد.

    بر اساس مواد 146 و 147 قانون اجرای احکام مدنی هرگاه شخص ثالث نسبت به مال توقیف شده اظهار حقی نماید، اگر ادعای مزبور مستند به حکم قطعی یا سند رسمی باشد که تاریخ آن مقدم بر تاریخ توقیف است، توقیف رفع می شود در غیر این صورت عملیات اجرایی تعقیب می گردد و مدعی حق برای جلوگیری از عملیات اجرایی و اثبات ادعای خود می تواند به دادگاه شکایت کند. شکایت شخص ثالث در تمام مراحل بدون رعایت تشریفات آیین دادرسی مدنی و پرداخت هزینه دادرسی رسیدگی می شود. مفاد شکایت به طرفین ابلاغ می شود و دادگاه به دلایل شخص ثالث و طرفین دعوا به هر نحو و در هر محل که لازم بداند رسیدگی می کند و در صورتی که دلایل شکایت را قوی یافت قرار توقیف عملیات اجرایی را تا تعیین تکلیف شکایت صادر می کند. اگر معترض ثالث خواهان رفع توقیف باشد دادگاه می تواند با اخذ تامین مبادرت به صدور دستور رفع توقیف نماید و در صورتی که محکوم له از مال معرفی شده صرف نظر نماید رسیدگی به دعوای اعتراض ثالث موقوف خواهد شد.

    ارجاع پرونده به مرجع قضایی در موارد تعدد شعب مرجع ذی صلاح، در هریک از مراحل دادرسی، پیش شرط بررسی وجود صلاحیت و اعمال صلاحیت توسط مرجع مرجوع الیه است. تضمین استقلال واقعی و ظاهری نظام قضایی مستلزم آن است که ارجاع پرونده به شعبات مرجع قضایی از امور مدیریتی داخلی قوه قضاییه تلقی شده و مصون از مداخله اشخاص بیرون از قوه قضاییه و بالاخص قوه مجریه و اصحاب دعوا باشد. ارجاع پرونده می بایست توسط شخص صلاحیتدار قضایی و یا تحت نظارت او باشد. ارجاع پرونده می تواند در اشکال مختلف انجام شود که در این مقاله اشکال مختلف ارجاع پرونده از منظر استقلال قضایی مورد بررسی قرار گرفته است. ترتیبات مختلفی برای ارجاع پرونده وجود دارد، ترتیبات ارجاع بر دو رویکرد عمده «ارجاع تصادفی» و «ارجاع تخصصی» می باشد که مقررات نظام حقوقی ایران بر رویکرد دوم تاکید دارد. استقلال قضایی مستلزم آن است که با ارجاع پرونده به شعبه مرجع قضایی جز در موارد استثنایی مقرر به موجب قانون امکان بازپس گیری آن وجود نداشته باشد. این مقاله کوشیده است به تبیین مقررات حاکم بر ارجاع با تطبیق آنها بر استانداردهای بین المللی دادرسی منصفانه (و بالاخص استقلال قضایی) بپردازد.

    اهمیت و ارزش میراث تاریخی، فرهنگی، حفاظت و حراست از این آثار را به وسیله ضمانت اجراهای کیفری موجب شده است. این مسئله در کشور ما، با توجه به پیشینه تمدنی کهن و وجود میراث فرهنگی غنی اهمیت بیشتری می یابد. قانونگذار پس از انقلاب نیز با توجه به تاکید اصل هشتاد و سوم قانون اساسی مبنی بر حفظ نفایس ملی و نیز به منظور حفظ میراث تاریخی کشور مقررات جزایی را پیش بینی نمود. با این وجود «قانون مجازات اسلامی» (بخش تعزیرات و مجازات های بازدارنده (1375)) این جرایم را در زمره «جرایم قابل گذشت» به حساب آورده بود. به نظر می رسد در مورد این جرایم باید به فلسفه و حکمت جرم انگاری و نیز مصالح اجتماعی توجه نمود. این مهم، بررسی سیر تحولات قانونگذاری و توجه به نقش شاکی خصوصی و دادستان را در این جرایم ضروری می سازد. نگاه قانون مجازات اسلامی (1392) و نیز قانون آیین دادرسی کیفری (1392 با اصلاحات 1394) گویای توجه مقنن به این امر است. به ویژه قانون آیین دادرسی کیفری (1392)، با توجه نمودن به نقش سازمان های مردم نهاد در زمینه جرایم گوناگون از جمله جرایم علیه میراث فرهنگی گام بلندی را در راستای تحول و کارآمدسازی امر تعقیب مجرمان و رسیدگی به این جرایم برداشته است.

    در حال حاضر میزان آلودگی محیط زیست سطح کره زمین به مرز بحرانی رسیده است، منظور از آلودگی محیط زیست در اصطلاح تخصصی همان حضور مواد نامطلوب در محیط است. صرف نظر از آثار آلودگی ها بر حیوانات و نباتات، این آلودگی ها آثاری بر اشیاء و ساختمان ها از جمله آثار تاریخی و فرهنگی بر جای می گذارند. با توجه به اینکه اکثر آثار تاریخی و فرهنگی به صورت سنگ و بناهای سنگی می باشند، آلاینده های موجود با خورندگی آثار تاریخی و فرهنگی، سایش و تغییر شکل آنها در نهایت باعث تخریب این آثار می گردند. طی دهه های اخیر آثار تاریخی و فرهنگی درگیر آلودگی های متعددی از آلودگی های نفتی و مواد شیمیایی تا آلودگی هوا از طریق ریزگردها و مواد سایش کننده شده است. تاکنون برای مقابله با آلودگی های زیست محیطی در سطح منطقه ای و بین المللی اقدامات زیادی صورت گرفته است، تا جایی که صدها کنوانسیون و پروتکل در سطح بین المللی و منطقه ای در این مورد به تصویب رسیده است. آنچه که دارای اهمیت وافری می باشد، این است، که کشورهایی که از لحاظ آثار تاریخی و فرهنگی غنی می باشند، متاسفانه از محیط زیست سالمی برخوردار نیستند و توجه اساسی به آلودگی ها و تخریب آثار تاریخی و فرهنگی ندارند. خوشبختانه بشر امروز به اهمیت آثار تاریخی و فرهنگی پی برده ولی برای حمایت از این میراث مشترک بشریت تاکنون گام مهمی را برنداشته است. این مقاله بر آن است تا با بررسی مبانی حقوق بین الملل محیط زیست و نیز معاهدات مربوط به آثار تاریخی و فرهنگی موجود پیشنهاداتی را راجع به حمایت از این آثار در حوزه حقوق بین الملل ارایه دهد.

    تالاب ها از مهم ترین زیستگاه های طبیعی جهان و نظام های حیات بخش و از جمله مولدترین محیط های جهان به شمار می روند که در طول تاریخ زندگی بشر، همواره در معرض تهدید، تخریب و مخاطرات فراوان قرار گرفته اند. همزمان با رشد تکنولوژی و صنعت در اوایل قرن بیستم و توجه دولت ها و ملت ها به مسئله محیط زیست و حیات وحش، نمایندگان دولت ها با انگیزه آشنایی با این اکوسیستم غنی و در جهت مشارکت جهانی در حفاظت از تالاب ها و استفاده معقول از آنها به عنوان سرمایه های عظیم کشورها، کنوانسیون «تالاب های بااهمیت بین المللی به ویژه به عنوان زیستگاه پرندگان آبزی» را که با عنوان محل برگزاری خود، رامسر شهرت یافت، خلق نمودند. ویژگی منحصر به فرد کنوانسیون تالاب های مهم بین المللی رامسر آن است که نخستین معاهده نوین بین دولت هاست که هدف آن حفاظت از منابع طبیعی می باشد. از جمله اهداف کلان کنوانسیون رامسر جلوگیری از تخریب جهانی تالاب ها و همچنین حفاظت از تالاب های باقیمانده از طریق استفاده معقول از این منابع طبیعی می باشد که این مهم از رهگذر همکاری های بین المللی، سیاستگذاری مناسب، ظرفیت سازی و انتقال تکنولوژی میسر خواهد شد. در این پژوهش به بررسی ساز و کار رامسر و تعهدات دولت ها در انطباق با این کنوانسیون پرداخته می شود.

    یکی از صلاحیت های شوراهای شهر، وضع عوارض است و مصوبات شوراها به دلیل شناسایی در منبع مقررات حقوق، مطابق اصل 170 قانون اساسی، در هییت عمومی دیوان عدالت اداری، قابل ابطالند. امری که در این پژوهش، طی سال های 1388 تا 1394 از منظر لحاظ نمودن حق بر مالکیت اشخاص با ملاک قانونی بودن اخذ عوارض نقدی و غیرنقدی توسط نمایندگان محلی حکومت، در صدور آرای ابطالی، بررسی و نتیجه، آن شد که دیوان در دفاع از حق بر مالکیت با معیارهای پیش گفته، در حد ابطال مصوبات شوراها، موفق بوده، اما تا جایگاه «احقاق حقوق» مذکور در اصل 173 قانون اساسی، فاصله دارد. همچنین برای رفع کاستی های دیوان در این خصوص پیشنهاد می شود: در بعد رویه، با استفاده از ظرفیت قسمت دوم ماده 13 قانون دیوان، ابطال مقررات محدودکننده حق بر مالکیت، به زمان تصویب، تسری یابد و تصویب مجدد مصوبه ابطالی نیز، عدم اجرا، تلقی و از همان ضمانت اجراها برخوردار شود. در بعد تقنین نیز، در کنار اصلاح مواد 13 و 92 قانون دیوان، برای داشتن نصی صریح در این زمینه، نظر به مشغله اداری و قضایی رییس دیوان؛ دادستان اداری، حداقل در سطح هییت عمومی در جهت حمایت از حق ها و آزادی های مردم، پیش بینی شود.

    نظام حقوقی کامن لا دارای مفاهیم، نهادها و سازمان های پیچیده ای است که درک آن برای حقوقدانان نظام حقوقی سیویل لا چندان ساده نیست. این امر بدان دلیل است که اولی مبتنی بر سنت و تاریخ و دومی مبتنی بر عقل و منطق است. بدیهی است که توجیه مفهوم تاریخی یا نهادی سنتی با ابزار عقل و منطق مشکل باشد. «دعوای جمعی» (Class Action) یکی از این مفاهیم است که به لحاظ اهمیت و تاثیری که در سرعت حل و فصل اختلافات دعاوی گروهی دارد، مرزهای نظام کامن لا را درنوردیده است و هم اکنون کشورهای نظام حقوقی سیویل لا به دنبال الگوبرداری از آن هستند. دعوای جمعی متضمن تعدد اصحاب دعوا و همچنین تعداد فراوان اوراق پرونده است که به طور بارز در دعاوی مسوولیت مدنی توده ای نظیر سوانح قطار و یا آلودگی محیط زیست و همچنین تولید دارویی که بر روی جمع زیادی آثار سوء به جا می گذارد، کاربرد دارد. در این مقاله پروفسور آنتونیو جیدی که دانش آموخته برزیل به عنوان یک کشور عضو نظام حقوقی سیویل لا است، قصد دارد با توجه به تجربه سایر کشورها الگویی را برای قانون دعوای جمعی کشورهای این نظام معرفی کند که با توجه به تعلق کشورمان به این نظام حقوقی می تواند برای قانونگذاری کشور ما در آینده در این زمینه راهگشا باشد.

    According to human rights conventions and the relevant case-law, a state of emergency can be justified only by an exceptional situation of crisis which affects the whole population and constitutes a threat to the organized life of the community of which the state is composed. The threat must be imminent; its effects must involve the whole nation; the continuance of the organized life of the nation must be threatened; the crisis or danger must be exceptional in the sense that the normal measures or restrictions permitted by the Convention for the maintenance of public safety, health and order, are plainly inadequate. In a state of emergency measures can be taken that derogate from the protection normally afforded by human rights. Rights are not absolute and may legitimately be limited by law. But derogation must be proportional to the emergency. People can only be detained without trial for the specific purpose of restoring peace and order during an emergency. The government will have to justify the continued detention of such people to a court, and there are still certain rights that it is not permissible to derogate from.

    All people deserve the inherent right to an adequate standard of living. Thus when some people are suffering from poverty, some economic - social rights of human beings are being breached. Fighting against poverty is one of the most important parts of social development process in order to reach the goals such as equality, justice, social coherence and global peace. The factor is recognized by the international law documents and some solutions are provided to eliminate poverty. By ignoring the existence of poverty, there will be much more problems in both national and international levels. Poverty will give rise to deprivation and insecurity. Therefore in a programme for social development the importance of policy making in order to gain empowerment and improving social protection systems should be noted. Moreover, at international law cooperation is one of the main elements of social development which can remove poverty.

    Internet has two contrary aspects: as a mean for promoting human rights and as a mean for violation of human rights. Violations of human rights law in cyberspace have special kinds and it is necessary to find appropriate mechanisms for protection of human rights. There are some theories for attribution of human rights violations to a State like authority power, nature of act, hot pursuit, et. It's possible some individual and human freedoms be breached in cyberspace like freedom of speech, freedom of access to information, freedom of assembly, right to self-determination, right property, right to privacy, et. There are some mechanisms for protection of human rights in cyberspace like cyber international organizations and cybercrime complaint submission websites, these are called cyber self-government. Also it is possible for Root Server State to guarantee human rights in other States as a third party for protection of human rights.

    Iran as second gas and third oil world power, has a good capacity to absorb international investment but its legislation hasn’t took a fixed policy for investment in petroleum. International investment in recent decades take account as an acceptable method in petroleum however, it was forbidden by some particular laws in oil and gas field. In parallel with normal laws, there are some temporary laws, which are performed in specified period. In performance period of these kind of laws (which are nominated as development acts), any contrary law don’t be execute. In this article firstly, it is tried to distinguish between available investment methods in up-stream and down-stream. Secondly, it is in attempt to find appropriate legal way to contracting and finally, some suggestion to Iranian parliament have be presented in order to take some easier approach for petroleum investors.

    On the strength of articles 146/147 of the law execution of Civil judgements, Whenever the third person asserts a right with regard to attached property, Should the said claim is supported with final judgement or natural document dated prior to date of attachment, the attachment will be discharged otherwise the execution operation will be followed and the claimant may litigate for suppression of execution operations and proving the claim concerned. Third person complaint at all stages will be heard without observing civil procedure code and paying any legal costs whatsoever. The text of complaint will be served to both parties and the court will examine evidence of both parties as well as third party in any manner and place it may deem appropriate and if the court finds that grounds of complaint is plausible, an stay order is issued pending the complaint in finally adjudicated. If third party wants to eliminate the arrest, court can issue the arrest elimination order by taking the security and if the condemned person neglects the mentioned property, Investigation of third protest claim will be cancelled.

    Assignment of cases to judicial authorities where there are multiple branches of court is the prerequisite for checking existence of jurisdiction and exercise of it. Ensuring actual and apparent independence of the judicial system requires that assigning of cases to the courts would be in jurisdiction of authority that placed in the judiciary and the executive and the legislature powers and parties of dispute should not be able to interfere in this issue. Assignment of cases must be made by a competent judicial authority or supervised by him. Assignment of cases can be made in various forms that in this paper they has been studied from the perspective of judicial independence. There are different arrangements for the assignment of cases that can be summarized on two kinds: “random assignment” and “specialized assignment”. The second kind is the kind that Iranian law emphasizes. Judicial independence requires that with assignment the case to the court, except in cases prescribed by law, there is no possibility of returning it. This paper has attempted to explain the rules governing the assignment of case with their adaption with international standards of fair trial (and especially judicial independence).

    The importance and value of historical and cultural heritage caused protection and preservation of this heritage by criminal sanctions. This affair in our country becomes more important given the history of ancient civilization, plenty of rich cultural heritage and historical monuments. After revolution, the legislator predicted penal provisions with regarding to the constitution in order to maintain the historical and cultural heritage. Nevertheless, the Islamic Penal Code in 1996 considered these offences as forgivable. It seems that we should pay attention to social interests and philosophy of criminalization about these offences. This is necessary to consider the evolution of legislation and role of private complainant and the prosecutor in these offences. New Islamic Penal Code and new criminal procedure act are worth noting in this context. Especially new criminal procedure act with regard to the role of NGOs is considered a big step towards the development of the prosecution and the investigation into these crimes.

    At present the environmental pollution at the earth has reached alarming border. The environmental pollution, as a technical term, means the presence of undesirable substances in the Environment. Apart from the effects of pollutions on animals and plants, they leave effects on objects and buildings including historical and cultural monuments. Given that the majority of historical and cultural monuments have been built in stone or they are stone monuments, available pollutants through making corrosion historical and cultural monuments, rubbing and deforming them cause damages. In recent decades, historical and cultural monuments have faced various pollutions from oil and chemical pollution to air pollution through dust particles and pulverizing material. So far, numerous attempts have been conducted to deal with environmental pollution at regional and international level coming to approving hundreds of conventions and protocols on international and regional level in this case. Fortunately, modern man realized the importance of historical and cultural monuments, but he has not taken an important step on to protect the common heritage of mankind. The current paper, through investigating fundamentals of the international environmental laws as well as treats associated to the available historical and cultural monuments, is to introduce suggestions on protecting such heritage at the domain of international laws.

    Native plants and animals, including certain species, grow in wetlands. Due to their potential economic, cultural, scientific and recreational value, it is highly important to protect them. Wetlands not only provide part of the aquifers and groundwater, but provide a favorable environment for birds and fisheries. Despite these valuable benefits, these rich ecosystems are threatened by different risks. One of the major causes of wetland degradation and destruction is the human factor. Today, destruction of wetlands and pollution of coastal waters, such as ozone depletion crisis, deforestation and the extinction of many plant and animal species have become global environmental crisis. This study seeks to explain the role of wetlands in international environmental rights and obligations of States regarding their protection, with an emphasis on the Ramsar Convention.

    One of the main duties of city council is enacting local duties and according to 170th principle of the Constitution, the resolutions of city council due to recognition as regulation, may be voidable in court of administrative justice judges council. This issue is examined from viewpoint of regarding ownership right of people with legitimacy of receiving cash and non-cash local duties by local agents of government from 2009 to 2016 and issuing void judgments and it was concluded that, court of administrative justice was successful for defending ownership right based on previous criterions for revocating the resolutions of city councils; nevertheless, it is very far away from status of “adjudication” as mentioned in 173th principle of The Constitution. In order to solve the shortages of court of administrative justice the following recommendations are offered: From viewpoint of precedent, by using the capacity of second part of article 13 of law of court of administrative justice, revocation the regulation limiting the right to property shall be extended to time of revoke, and re-confirmation of voided resolution recognize non-performance, and shall have the same sanctions. From viewpoint of legislation, it is recommended first, amendment articles 13 and 92 of law of court of administrative justice in order to obtain clear text. Second, from viewpoint of administrative and judicial busy work of chief of court of administrative justice, to refer to administrative prosecutor’s office at level of judge’s council for supporting freedoms and rights of people.

    The author proposes the enactment of a Class Action Code in civil law countries. The proposed model code extensively regulates all aspects of modern class actions, including standing, adequacy, prerequisites, certification, notice, proof, settlement, judgment, res judicata, lis pendens, attorney fees, injunctive class actions, class action for damages, calculation of damages, distribution of the award, fund for group rights, defendant class actions, etc. The objective is to inspire the creation of the best possible code for class action suits, in light of the needs and peculiarities of civil law countries and the international experience with class actions. Although the proposal is focused primarily on civil-law countries, it may also prove useful to common law countries considering the adoption or improvement of class action rules.
