    آزادی های عمومی از طریق مجموعه مقررات الزام آور حقوقی به دنبال تضمین مجموعه امتیازاتی برای بشر می باشد که ذاتی انسان است و از خصوصیات طبیعی او محسوب می گردد و برخی اسناد حقوق بین الملل و حقوق داخلی نیز به بیان آن ها پرداخته اند. قواعد حقوق داخلی در ضمن بیان ضمانت اجراهای حقوق و آزادی های اجتماعی برای آن محدودیت هایی قائل می شوند. از جمع بندی اسناد مرتبط با حقوق و آزادی های عمومی می توان به دو محدودیت آزادی دیگران و منافع عمومی اشاره نمود. بر همین اساس مطالعه ی تفاوت محدودیت های آزادی های عمومی در حکومت اسلامی و حکومت های سکولار ضروری به نظر می رسد. بر همین اساس این مقاله، ابتدا به بررسی مفهوم حقوق بشر و آزادی های عمومی می پردازد و سپس به اثبات اصل وجود محدودیت برای آزادی های عمومی در حکومت های گوناگون اقدام می نماید. پس از آن به مطالعه تطبیقی آزادی های دیگران و منافع عمومی به عنوان محدودیت های حقوق و آزادی های عمومی در حکومت های سکولار و حکومت اسلامی خواهد پرداخت. به نظر می رسد در ضابطه های محدودیت آزادی های عمومی میان حکومت های اسلامی و حکومت های لیبرال تفاوتی وجود ندارد بلکه تفاوت در تعریف آزادی و منافع عمومی است که از عرصه علم حقوق خارج می باشد و نظام های حقوقی مبتنی بر ارزش های حاکم بر حکومتها از آثار تعاریف اصطلاحات مذکور در راستای ایجاد الزام حقوقی استفاده می نماید.

    انسان، موجودی عقل بنیاد، خودآئین و در نتیجه ارزشمند است که تنها به صرف انسان بودن و نه برخورداری از ویژگی خاص یا موقعیت ممتاز، از پاره ای استحقاقات ذیل عنوان حقوق بشر برخوردار می گردد. حق های بشری، حق ادعاهایی فراتاسیسی، غیر قابل سلب، اسقاط و انتقال بوده و از این رو، نقش دولت ها در رابطه با آنها، نقشی صرفا اعلامی است. با این همه، نیاز انسان ها به تعامل دائمی با یکدیگر برای تامین نیازهای خویش از یک سو، و واقعیت بروز تعارضات پی درپی در روابط بین الانسانی از دیگر سو، موجب می شود تا بقاء در صحنه منازعه آمیز اراده های بشری، مستلزم برخورداری از حمایت قدرت عالی سیاسی باشد. بر این اساس، افراد با صرف نظر کردن از بخشی از حقوق طبیعی خویش در چارچوب پیمان موسس، جامعه مدنی را پایه گذاری نموده و دولت را می آفرینند. افرادی که به این نحو اقدام به تاسیس دولت می کنند، شهروند قلمداد گردیده و از پاره ای حق های مدنی و سیاسی در محدوده جغرافیایی مشخص بهره مند می گردند. بنابراین از منظر مبانی موجهه ساز حقوق بشر که در ادبیات دینی ما نیز مورد تاکید است ، شهروندی، خود یک حق بنیادین بوده و فراتر از آن، پیش شرط برخوردای از تمامی حق های انسانی است.

    دیدگاه های کلانی که چارچوب اندیشه تفسیری را شکل می دهد با عنوان رویکرد می شناسیم. به طور کلی، رویکردهای تفسیری را می توان به دو دسته «اراده گرا» و «کارکردگرا» تقسیم نمود. رویکرد تفسیری در فقه اسلامی دو هدف اصلی دارد: انسجام نظام تفسیری، و کشف اراده شارع. انسجام تفسیری و منطقی که کمتر مورد توجه قرار گرفته است مبتنی بر نظریه صدق انسجام و با هدف جزمیت استدلال قضایی است. ابزارهای تفسیری این رویکرد نیز عبارت است از یکپارچگی تفسیر قوانین، ماهیت شناسی، حاکمیت اصول حقوقی و قیاس حقوقی. در برابر، تفسیر کارکردگرا مبتنی بر پراگماتیسم بوده و اساسا تکثرگرا است؛ لذا بهای کمتری به جزمیت و یکپارچگی تفسیر می دهد. همچنین قیاس گریز و ماهیت گریز است. از سویی، منبع تفسیر در فقه اسلامی اساسا متن و گاهی زمینه متن می باشد. در برابر، پراگماتیسم تفسیری اصولا زمینه گرا است. تحقیق حاضر تلاش دارد جنبه های کمتردیده شده و پر اهمیت تفسیر فقهی را از منظر روش شناختی بررسی نماید. در نتیجه، تحقیق مشخص می شود که وجه تمایز اصلی تفسیر فقهی و تفاسیر کارکردگرا، ناظر بر انسجام روش تفسیر اول است.

    ایقاع عمل حقوقی یک جانبه است؛ از آنجا که اختیار تصرف در حقوق دیگران امری استثنایی است، دولت ها لازم می بینند، سلامت و نفوذ اراده ی کسی که به تنهایی تصمیم می گیرد را مورد بازرسی قرار دهند. لذا قانون گذاران در نظام های حقوقی، تشریفاتی را در عرصه ایقاعات مقرر می دارند. اما تشخیص این که این تشریفات تا چه اندازه آزادی اراده ایقاع کننده را نشانه می رود، و چه مرحله از مراحل اراده وی را درگیر می کند و یا این که صرفا جنبه مقدماتی و یا اثباتی دارد، امری است که تا کنون بررسی جامعی نسبت به آن صورت نپذیرفته است. مقاله پیش رو، به این مساله، با بررسی تطبیقی در حقوق ایران، حقوق کشورهای اسلامی (به ویژه مصر) و نیز حقوق کشورهای غربی (به ویژه فرانسه و انگلیس به عنوان سردمداران دو نظام حقوقی رومی ژرمنی و کامن لا)، پرداخته است. بدین ترتیب که با پژوهش استقرایی-تطبیقی، تشریفات را در ایقاعات، بر اساس زمان رعایت آن - حین فرآیند اراده ایقاعی، قبل یا بعد از آن- دسته بندی، و ذیل هر یک، با تشخیص نوع تشریفات، مصادیقی از ایقاعات مربوط را به همراه مستندات قانونی داخلی و خارجی ارائه می نماید.

    برداشت های متناقض از اصل ضرورت نظامی و وجود ابهام در ماهیت و آثار و شرایط این اصل در حقوق مخاصمات مسلحانه، منجر به حملات مکرر به مناطق مسکونی و اهداف غیر نظامی به ویژه در جنگ های اخیر شده است. این واقعیت، بررسی دوباره اصل مذکور در مقررات بین المللی و ابهام زدایی از آن را ضرورت بخشیده است. یکی از بهترین روش ها برای رفع این ابهام ها، می تواند یک مطالعه تطبیقی درخصوص ضرورت نظامی در حقوق مخاصمات مسلحانه بین المللی با نظام های دیگر، باشد. نظام حقوقی اسلام یکی از این نظام هاست. پس سوال اصلی مقاله حاضر این است که «رویکرد دو نظام حقوقی اسلام و حقوق مخاصمات مسلحانه به ماهیت، شرایط و آثار اصل ضرورت نظامی چیست؟» با روش تحقیق توصیفی تحلیل و با استناد به مقررات معاهداتی حقوق مخاصمات مسلحانه و رویه قضایی دیوان های بین المللی و منابع حقوقی اسلام و عملکرد جنگی پیامبر (ص) و با استفاده از روش های تفسیری و اصولی و تطبیقی، به این نتیجه رسیدیم که این دو نظام، مشترکات بسیاری در این حوزه دارند اما در برخی موارد مانند لزوم وجود اصل مصلحت و محدودیت قابلیت استناد به ضرورت نظامی به جنگ های مشروع، و همچنین آثار حقوقی این اصل، تفاوت هایی وجود دارد؛ از جمله این که حقوق اسلام ضرورت را جزئی از عناصر جرم تلقی نکرده و آن را صرفا سالب مسئولیت می داند.

    حفظ صلح و امنیت بین المللی جز از طریق تامین صلح و امنیت منطقه ای که آن هم خود منوط به وجود ثبات و امنیت در جوامع داخلی است، ناشدنی به نظر می رسد. فراز و فرودهای تاریخ حاکی از آن است که حمایت از اقلیت ها برای تامین ثبات، صلح و امنیت بین المللی ضروری بوده و تبعیض علیه اشخاص متعلق به این گروه ها، همواره ثبات داخلی و صلح و امنیت منطقه ای و بین المللی را در معرض خطرات جدی قرارداده است. فلسفه وجودی اصلی تشریع عقد ذمه در دین اسلام، همانا ایجاد همزیستی مسالمت آمیز میان اقلیت های دینی و اکثریت مسلمان در جامعه اسلامی است. همچنین، هدف ابزاری نظام حمایت از حقوق اقلیت ها، پیشگیری از جنگ و درگیری میان اشخاص متعلق به اقلیت ها و گروه های اکثریت کشورهای مختلف در پرتو حفظ یکپارچگی سرزمینی دولت ها و در نتیجه حفظ صلح و امنیت منطقه ای و بین المللی است؛ پس برای تامین صلح و امنیت منطقه ای، باید از اقلیت ها حمایت به عمل آورد و بهره مندی این گروه ها از حقوق خویش را تضمین نمود. نگارندگان در این نوشته بر این باورند که حمایت از اقلیت ها و تضمین حقوق آن ها در حقوق بین الملل و تاسی به رویکرد اسلامی مبتنی بر زیست جمعی مسالمت جویانه گروه های مختلف اجتماعی، به مثابه راه کاری اصولی و پیشگیرانه در برابر بروز منازعات قومی، در تحقق صلح و امنیت منطقه ای، از اهمیتی حیاتی برخوردار است.

    اصل منع توسل به زور برای حفظ و تقویت صلح جهانی، عنصر محوری در نظام بین المللی مبتنی بر منشور ملل متحد است. در پی ممنوعیت جنگ و تکرار این قاعده در اسناد بین المللی متعدد، مساله ممنوعیت تبلیغات برای جنگ تجاوزکارانه نیز در حقوق بین الملل مطرح گردید. با بروز مخاصمات بین المللی و داخلی متعدد و متنوع پس از جنگ سرد، به ویژه در منطقه غرب آسیا و شمال آفریقا، موضوع تبلیغ برای جنگ اهمیت بیشتری یافته است. در این مقاله، ممنوعیت تبلیغ توسل به زور در نظام منابع حقوق بین الملل بررسی شده است و ممنوعیت آن خصوصا با توجه به تصریح برخی معاهدات محرز است. بر این اساس، دولت ها نباید با کاربرد ابزارهای مختلف از جمله رسانه، به این عمل مبادرت ورزند. در دیدگاه اسلامی نیز، موضوع در قرآن و سنت ارزیابی شده است. در این قسمت، علاوه بر شواهد متعدد قرآنی و روایی، از اصول کلی مستنبط از این منابع استفاده می شود که اقتضای اصالت صلح و منع شروع به جنگ، ممنوعیت هر گونه تبلیغات برای جنگ تجاوزکارانه نیز هست. سیره نبوی (ص) و رفتار امام علی (ع) در آغاز کردن جنگ ها، پشتوانه مهمی برای این برداشت است و نقطه مثبت و متمایز رهیافت اسلامی در این قلمرو تلقی می شود.

    Public freedoms are, through a set of obligatory legal regulations, sought to guarantee the inherent body of human privileges which are considered as natural characteristics of mankind, and dealt with in some international legal documents and municipal law. In municipal law, while expressing the sanctions of rights and social freedoms, some restrictions are imposed on them. Referring to the international documents concerned to public rights and freedoms shows that there are two kinds of limits: respecting others freedom and public interests. There are some differences between Islamic and secular governments in this field which studied in the present article. Accordingly, at first, we review the concept of human rights and public freedoms, and then go on to prove the principle of the existence of restrictions on public freedoms in various governments. Subsequently, the freedoms of others and the public interests as tow main restrictions on the rights and public freedoms will be studied comparatively. It seems that there are no differences in the norms of the restriction of public freedoms between Islamic government and liberal governments, but the difference is in the definition of “freedom” and “public interests”, that is not a subject of legal science, and the legal systems based on the ruling values of governments, use those conceptions and definitions in order to create a legal obligation.

    Man is a rational-minded, autonomous and therefore valuable entity that is entitled to some privileges as human rights solely for the sake of human existence, not having any particular qualifications or privileged status. Human rights are extra constitutional, indisputable, unbreakable and non-transferable claim-rights and hence the role of governments in relation to them is a purely declarative role.Nevertheless, the need of humans to engage in constant engagement with each other in order to provide their own needs on the one hand, and the reality of successive conflicts in mutual relations, on the other hand, leads to the fact that survival of human beings will requiring the support of supreme political power. Accordingly, individuals, by disregarding some part of their natural rights under the constituent contract, establish civil society and create the state. The people who set up the state in this way are considered as citizens and enjoy certain civil and political rights within a particular territory. Therefore, from the standpoint of the human rights- justifying foundations that are also emphasized in our religious literature, citizenship itself is a fundamental right and besides that, it is a prerequisite for all human rights.

    Interpretive approach refers to the main ideas which construct the interpretive method of a judge or a jurist. We classify the interpretive approaches as intentional and functional attitudes. Feqh (Islamic jurisprudence) proceeds two purposes in interpretation; discovery of divine rules and integrity of interpretation. for these aims, Islamic jurists leads to the text and they are mostly textualist. However, sometimes the context helps the jurist to understand the hidden rules. In other hand, they attend to systemic interpretation, legal essentialism, sovereignty of legal principles and legal deduction. In contrast, pragmatic interpretation justifies the plural views, does not need to deduction and is anti-essentialist. this article tries to state these dimensions of the approaches and study the interpretation of Feqh in a methodological way. In that way, we define the meaning of approach. then introduce the characteristics of each approaches. The result is that, every approach has it’s own advantages and disadvantages. The jurist must choose the one which is more useful for his/her society.

    In Unilateral Legal Acts, only one party's volition is creative. As it is exceptional to seize the rights of others, the legislators need to inspect the perfection and influence of the volition. So they provide some formalities for Unilateral Legal Acts. But the most essential issue is “the effect of these formalities on determinant's volition”: whether they are terms to create Unilateral Legal Acts or terms to prove them. To answer this necessity in present article, a comparative study on all kinds of unilateral legal acts, in Iranian law, other Islamic countries law (especially Egypt) and also Western countries law (mostly French and English Law as the leading examples of the two legal systems: Romano-Germanic and Common Law), has been done. By an inductive and comparative research, we classify these formalities, according to the phase (time) of regarding the formalities: “in the process of volition to create” unilateral legal act, and, “before” or “after” that. We also make formalities of various unilateral legal acts classified and distinguished, by presenting their legal related provisions in internal and foreign laws.

    Contradictory interpretations, which are sometimes contrary to the purposes of International humanitarian law, on the principle of military necessity and the existence of ambiguities in nature, conditions and effects of this principle in the law of armed conflicts, have resulted in repeated attacks on residential areas and nonmilitary objectives, especially in recent wars. This situation has made re-examination and disambiguation of the mentioned principle, in international regulations, necessary. One of the best methods to resolve this ambiguity can be through a comparative study with other systems, of them is the Islamic legal system. So, our main question is: "what are the approaches of the Islamic legal system and the law of armed conflicts to the nature, conditions and effects of the principle of military necessity?" Through descriptive research methods based on treaty provisions of the law of armed conflicts and the jurisprudence of international tribunals and the sources of Islamic law and combat performance of the holy Prophet (PBUH) and by using interpretive and comparative methods, we came to the conclusion that these two systems have much in common in this area, but there are differences in some cases, such as the need for the principle of discretion and limitations of referring to military necessity in legitimate wars and the legal effects of this principle.

    Maintenance of international peace and security seems to be impossible without having regional peace and security, which itself is dependent upon the stability and security in national societies. The historical upheavals demonstrate that the protection of minorities is essential for regional and international stability, peace and security, and discrimination against persons belonging to these groups, always has subjected internal stability and regional and international peace and security into serious danger. Both the principal philosophy of Tribute Contract in Islam and the instrumental aim of minoritie's protection system are to prevent war and conflict between persons belonging to minorities and those of majority populations in the light of territorial integrity of the states, and consequently maintenance of regional and international peace and security. Therefore, due to securing peace and security, minorities should be protected and the enjoyment of these groups from their rights must be assured. The authors in this article believe that protection of minorities and guarantying their rights and resorting to pacific approach of Islam regarding the co-existence of different social groups, as a principal instrument for preventing the outbreak of ethnic conflicts, is of vital importance for the maintenance of regional peace and security.

    The principle of "Prohibition of resorting to force" for maintaining and strengthening world peace, is the pivotal element in the international system based on the UN Charter. Following to prohibition of war and repetition of this rule in numerous international documents, the issue of propaganda prohibition for aggressive war was raised also in international law. With the occurrence of various international and domestic conflicts after the cold war especially in the West Asia and North Africa regions, the subject of propaganda for war has become more important. In this article, the propaganda prohibition of resorting to force in the system of sources of international law has been investigated and this prohibition especially with attention to affirmation of some treaties is clear and on this basis, governments shall not do this with the use of various tools including the media. Also in Islamic perspective, this subject in Quran and Sunnah has been evaluated. in this part, in addition to numerous Quranic and Hadith evidences, from the general principles that comprehended from these sources is used that also is necessity of the originality of peace and prohibition of beginning to war, prohibition of any propaganda for an aggressive war. Prophetic Method and Imam Ali's behavior in beginning to wars, is an important backing for this comprehension and is distinctive point and the positive approach of Islam in this realm.
