    بیشتر رژیم های حقوق مدنی و مسوولیت مدنی بر اصل تعادل بین زیان و جبران خسارت زیاندیده تاکید می کنند. اصل جبران خسارت در حقوق  فرانسه، بدون استثناء بوده و در حوزه قراردادها و مسوولیت مدنی  کاربرد مشابهی دارد. در حقوق ایران، چنانکه خواهیم دید، این اصل مورد تردید است و بهتر است آن را اصل تعادل بین ضرر و جبران خسارت بنامیم. به نظر می رسد این اصل، به طور ویژه در خصوص شروط غیر منصفانه در قراردادهای مصرف، فاقد کارآیی لازم است. در حقوق فرانسه، این شروط در قراردادهای مصرف، که یک طرف آنها حرفه ای و طرف دیگر مصرف کننده است ممنوع است شرط ممنوع از قرارداد حذف می شود و مابقی قرارداد معتبر باقی می ماند و مصرف کننده می تواند خسارت را مطابق با اصل تعادل بین زیان و جبران خسارت، دریافت کند. در حقوق ایران، ادعای بطلان مستند به هیچ قانونی نیست و ضمانت اجرای موجود نیز بازدارندگی لازم را برای پیشگیری از وروود زیان ندارند. این مطالعه نشان می دهد که در هر دو نظام حقوقی، قانون حمایت از مصرف کنندگان به طور موثر از شروط ناعادلانه قراردادی، پیشگیری نمی کنند؛ زیرا اصل تعادل کامل بین زیان و جبران آن، سبب ایجاد انگیزه های کافی و موثر برای طرفین نمی شود. بنابراین ضرورت دارد خسارات تنبیهی در هر دو نظام حقوقی مورد مطالعه به عنوان یک وسیله انگیزشی کارآمد، برای جلوگیری از خطاهای سودآور مورد توجه قرار گیرد.

    وضعیت تعارض منافع که ناظر بر پدیداری اصطکاک میان الزامات شغلی و منافع شخصی کارگزاران نهادهای دولتی و عمومی می باشد از مهم ترین زمینه های بروز فساد در ساختار نظام اداری است که ممکن است افراد را به سوءاستفاده از موقعیت خویش و ترجیح منافع خصوصی بر مصالح عمومی سوق دهد. از همین رو طراحی یک سیاست جنایی جامع جهت مدیریت وضعیت مزبور امری لازم است. موفقیت مدیریت چنین وضعیتی در گروی تمرکز بر تدابیر کارا در جهت پیشگیری از بروز آن است. نظر بر اهمیت مطالعات تطبیقی در تحقیق حاضر با روشی توصیفی-تحلیلی به دنبال پاسخ به این مساله بوده ایم که کشورهای حوزه خلیج فارس چه رویکردی نسبت به مدیریت منافع تعارض و پیشگیری از مفاسد مترتب بر آن اتخاذ کرده اند. یافته های پژوهش نشان می دهد کشورهای ایران، بحرین و قطر تاکنون نتوانسته اند از طریق تقنین این مساله را به طور خاص و مستقل مدیریت کنند. در مقابل سایر کشورها با معماری سیاست جنایی تقنینی تلاش کرده اند از فساد ناشی از چنین وضعیتی پیشگیری کنند که این امر هم از طریق تدابیر پیشگیری اجتماعی، به ویژه در قالب کدهای اخلاقی و هم با تدابیر پیشگیرانه وضعی نظیر کنار نهادن شخص از موقعیت دولتی یا سلب منفعت خصوصی از او، الزام به خودداری از مداخله در موضوعی که نفع شخصی در آن دارد و نیز افشای منافع خصوصی که با کنترل پذیری وضعیت تعارض منافع، افراد را از سوءاستفاده بازدارد سامان یافته است.

    هرگاه دعوایی ناشی از تحریم های وضع شده توسط کشورثالث بین طرفین یک قرارداد به مرجع حل اختلاف ارجاع شود، مرجع رسیدگی کننده فقط در صورتی می تواند در چهارچوب «قواعد آمره برتر» این تحریم ها را بر قرارداد و تعهدات طرفین اعمال کند که سه شرط مهم محقق باشد: «شایستگی اعمال تحریم»، «رابطه نزدیک بین قرارداد مورد اختلاف وکشور واضع تحریم» و «تفوق حکم به اثربخشی به تحریم بر نادیده گرفتن تحریم». عدم تحقق هریک از این شروط مانع اعمال تحریم های وضع شده توسط کشور ثالث می گردد. این تحقیق به این پرسش پاسخ می دهد که «شرط شایستگی اعمال» در تحریم های وضع شده ازسوی کشورهای ثالث و معیارهای موثردر احراز آن چیست؟ زمانی تحریم های وضع شده توسط کشور ثالث به عنوان یک قاعده آمره برتر شایسته اعمال است که هدف و موضوع تحریم توجه به آن را ایجاب کند. یعنی بر اساس استانداردهای کشورمقر(دررسیدگی های دادگاهی) و استانداردهای قابل قبول ازنظر جامعه بین المللی (در رسیدگی های داوری) منافع تامین شونده به وسیله تحریم ها باید «مشروع و شایسته حمایت» باشند، همچنین تحریم باید ابزاری «ضروری» و «متناسب» برای دستیابی به هدفش باشد.

    کیفر شناسان معتقدند طبقه بندی زندانیان در صورتی که براساس نظریه بازپروری صورت گیرد، می تواند با کاهش خشونت، امنیت زندان را تامین و به واسطه دسترسی زندانیان به برنامه های بازپرورانه، اصلاح و درمان را محقق و در نهایت مشکل تورم جمعیت کیفری را برطرف کند. ایالات متحده امریکا و کشورهای حوزه اسکاندیناوی از جمله کشورهایی هستند که با توسعه مدل های مختلف زندان به ظرفیت طرح های طبقه بندی و ارزیابی و اجرای درست آنها به منظور کنترل جرایم تمرکز کرده اند. به موازات اهمیت این مساله در مطالعات اخیر، پژوهش حاضر بر آن است تا به بررسی فرایند طبقه بندی زندانیان در نظام عدالت کیفری ایران با جهت گیری تطبیقی بپردازد. برای انجام این امر از دو روش تحقیق تحلیل اسناد و مدارک و مصاحبه عمیق (با زندانیان و کارکنان زندان ها) استفاده شد. یافته های پژوهش بیانگر آن است که به رغم تحولات موجود در آیین نامه سازمان زندانها (مصوب 1400)، آزادی عمل قابل توجهی در چگونگی توزیع زندانیان وجود دارد و حتی رویه های موجود وضعیت بازطبقه بندی زندانیان را تعیین می کند. علاوه بر این، تورم جمعیت کیفری بر چگونگی طبقه بندی بزهکاران سایه انداخته و حتی موجب تغییر کارکرد زندان های باز و نیمه باز شده است.

    مقاله حاضر به بررسی نظام حقوق مالکیت فکری ایران درخصوص صنایع دستی، با تاکید بر مقررات موافقت نامه جنبه های تجاری حقوق مالکیت فکری سازمان تجارت جهانی (تریپس) پرداخته است. صنایع دستی به عنوان موضوعی که می تواند مشمول حمایت نظام حقوق مالکیت فکری باشد تاکنون چندان مورد توجه قرار نگرفته است. از طرفی این نوع آثار هنری درسطح جهانی هم ازلحاظ مالکیت فکری و هم ازنظر تجاری اهمیت فزاینده ای پیدا کرده است. سوال اساسی که دراین مقاله مطرح و مورد بررسی قرار گرفته این است که رویکرد نظام حقوق مالکیت فکری ایران و توافقنامه تریپس نسبت به صنایع دستی چیست و چگونه می تواند به حمایت موثر از این آثار بپردازد؟  یافته های مقاله حاکی از آن است که صنایع دستی از مصادیق هنرهای تجسمی بوده و در نظام حقوقی ایران و توافق نامه تریپس و سایر اسناد بین المللی رویکرد یکسانی در خصوص آنها وجود ندارد. حقوق ایران می تواند در نظام های حق مولف (کپی رایت) و یا طرح صنعتی، نشانه جغرافیایی و علامت تجاری مورد حمایت قرار گیرد. در توافقنامه تریپس نحوه حمایت به صورت کلی و بیشتر به جنبه های تجاری حقوق مالکیت فکری پرداخته شده و درخصوص حقوق ادبی هنری به کنوانسیون برن ارجاع داده است.

    در رسیدگی به دعاوی خصوصی بین المللی، اقامه دعوای مرتبط با دعوای اصلی توسط طرفین دعوا یا شخص ثالث دور از انتظار نیست. بروز دعاوی مرتبط که ممکن است در صلاحیت دادگاه رسیدگیجکننده به دعوای اصلی نباشد منجر به طرح سیوالات مختلفی می شود. در همین زمینه دو سیوال مهم این است که آیا دادگاهججهای ایرانی و مصری در دعاوی خصوصی بین المللی، صلاحیت رسیدگی به دعوای مرتبط را به تبعیت از دارا بودن صلاحیت رسیدگی به دعوای اصلی دارند؟ آیا صلاحیت دادگاه خارجی برای رسیدگی به دعوای اصلی، مانع اعمال صلاحیت دادگاه ایرانی یا مصری برای رسیدگی به دعاوی مرتبط با آن است؟ نوشتار حاضر با روش توصیفی-تحلیلی و رویکرد تطبیقی موضع نظام های حقوقی مصر و ایران در خصوص این مسایل را مورد توجه قرار می دهد. مقاله نشان می دهد که دادگاه مصری و ایرانی در صورت صلاحیت برای رسیدگی به دعوای اصلی، صلاحیت رسیدگی به دعاوی مرتبط با آن را نیز دارند. در مقابل، در حقوق ایران صلاحیت دادگاه خارجی برای رسیدگی به دعوای اصلی مانع رسیدگی دادگاه ایرانی صالح به رسیدگی به دعوای مرتبط نیست اما در این خصوص در حقوق مصر اختلاف نظر مشاهده می شود.

    Most civil law and civil liability regimes emphasize the principle of balance between loss and the amount of damages awarded to the injured party. The principle of compensation in French law is without exception and has a similar application in the field of contracts and civil liability. In Iranian law, as we will see, this principle is questionable and it is better to call it the principle of balance between loss and compensation. This principle seems to be ineffective, especially with regard to unfair terms in consumer contracts. Under French law, these terms are prohibited in consumer contracts, where one party is a professional and the other party is a consumer. The forbidden term is removed from the contract, the rest of which remains valid. In Iranian law, the claim of invalidity is not documented in any laws and the existing enforcement sunctions does not have the necessary deterrent to prevent the losses. This study shows that in both legal systems, consumer protection laws do not effectively prevent contractual unfair terms, because the principle of full balance between loss and compensation does not create sufficient and effective incentives for the parties. Therefore, it is necessary to consider punitive damages in both legal systems as an effective incentive to avoid Lucrative faults.

    Conflict of interest, which is related to the conflict between public duties and private interests of officials of public institutions, is one of the most important areas of corruption in the structure of the administrative system that may lead people to abuse their position and prefer private interests over Lead public interests; Therefore, designing a comprehensive criminal policy to manage this situation is necessary. The success of managing such a situation depends on focusing on effective measures to prevent its occurrence. Considering the importance of comparative studies in the present study, we have sought to answer the question with a descriptive-analytical method of what approach the countries of the Persian Gulf region have taken towards managing the interests of conflict and preventing corruption. The research findings show that Iran, Bahrain and Qatar have not been able to manage this issue specifically and independently through legislation. On the other hand, other countries have tried to prevent corruption caused by such a situation by formulating legislative criminal policy, which is done both through social prevention measures, especially in the form of ethical codes, and through situational prevention measures such as Depriving persons of public office or deprivation of private interest, the obligation to abstinence from interfering in a matter in which they have a personal stake, and the disclosure of private interests which, by controlling the conflict of interest situation, prevent individuals from abusing.

    Once, between parties to a contract, a dispute arising out of sanctions imposed by a third country is raised before dispute resolution authority, the authority can apply the sanctions to the contract and obligation of the parties thereto as “overriding mandatory rules” only if three significant requisites are fulfilled: “application worthiness of the sanction”, “close connection between the disputed contract and enacting state” and “prevalence of the benefit of a decision to give effect to a sanction over a decision to disregarding it”. Lack of each of the requisites will preclude the application of the sanctions enacted by a third country. This research will provide an answer to this question: concerning a sanction enacted by third countries what the nature of “application worthiness requisite” is what the criteria to fulfill this requisite are. Sanctions enacted by a third country will be worth applying as an overriding mandatory rule only if the object and purpose of the sanctions require considering it. I.e., according to the standards of the state of seat (in court proceedings) and the standards acceptable by the international community (in arbitral proceedings) benefits secured by means of sanctions must be “legitimate and be worthy of protection”, and the sanction must be a necessary and proportional means to achieve its purpose as well.

    Criminologists have always believed that the classification of prisoners can improve the effectiveness of the prison, if it is based on the rehabilitation theory. By implenting this process, prison security can be secured and prisoners will have access to treatment programs. For these reasons, criminal justice authorities have also focused on evaluating and strengthening the classification system. Given the importance of the issue, the present study aims to study the process of classification of prisoners in the Iranian criminal justice system with a comparative approach. To do this, two research methods of document analysis and in-depth interviews (with prisoners and prison staff) have been used. The findings indicate that despite the changes done by new regulation in 1400, there is considerable discretion in distributing prisoners, and even practices determine the re-classification of prisoners. In addition, prison population inflation has affected the classification of criminals and even changed the function of open and semi-open prisons.

    The present article examines the Iranian intellectual property rights system regarding handicrafts; emphasizes the provisions of the Agreement on Trade-Related Aspects of Intellectual Property Rights (WTO). Handicrafts as a subject that can be supported by the intellectual property rights system has not received much attention so far. On the other hand, this type of artwork has become increasingly important both globally and commercially. The main question raised in this study is what is the approach of the Iranian intellectual property rights system and the TRIPS agreement to handicrafts? And how can it effectively support these works?
    The findings of the article indicate that handicrafts are examples of visual arts and there is no uniform approach to them in the Iranian legal system and the TRIPS Agreement and other international documents. In Iranian law, it can be protected in copyright or industrial design systems, geographical indications and trademarks. The TRIPS Agreement addresses the commercial aspects of intellectual property rights in general and in particular, and refers to the Berne Convention on literary and artistic rights.

    While principal private international actions are pending before a court, there is a possibility for arising related actions. However, if the court doesn’t have jurisdiction over related actions, two important questions may arise; the first one is if the Iranian or Egyptian courts have jurisdiction to decide the principal dispute, can they take the jurisdiction to decide the related actions? Also, if the foreign court has jurisdiction over the principal action, is the Iranian or Egyptian court required to dismiss jurisdiction in favor of the foreign court?  The article with the descriptive-analytical method and a comparative approach examines the approach of Iranian and Egyptian laws in this area. The article shows that where the Iranian or Egyptian court has jurisdiction over the principal action, it can take jurisdiction to decide the related actions. Nevertheless, if the Iranian court has jurisdiction to decide the related actions, the jurisdiction of the foreign court over the principal action does not prevent the Iranian court to exercise the jurisdiction over related actions. However, on this question, there are contradicted views in Egyptian law.
