    اعمال و رفتار های مشروع انسان در شریعت اسلام، گاهی  برگرفته از رفتار های عرفی است و عرف حدود و ثغور آن را مشخص می کند و  گاه توقیفی بوده و نیازمند بیان شارع است. حج از آن جمله  عبادات است که توقیفی بوده و در جای جای آن نیامند بیان شارع هستیم. آنچه در این نوشتار به پژوهش در این باره پرداخته ایم که آیا فاصله میان یک عمل و یا میان اعمال مانع کلیت و صحت این عبادت مرکب می شود یا خیر؟ به بیان دیگر هیات اتصالی بین اعمال و حرکات در حج واجب است یا خیر؟ طبق فحص و جستجویی که انجام گرفت، به این نقطه رسیدیم که در برخی از اعمال موالات واجب بوده و در برخی دیگر خیر. ملاک در تشخیص تحقق موالات و یا عدم آن، عرف است.

    یکی از مسایل مهم و مستحدثه فقهی بررسی حکم معذوران جسمی است؛ مسلوس و مبطون شدن، یکی از معلولیت هایی است که به موجب آن شخص قادر به حبس بول یا مدفوع خود نیست. این اشخاص برای انجام برخی عبادات همچون نماز، طوافو نماز طواف دچار مشکل می شوند که در این مقاله تلاش شده حکم فقهی اعمال ایشان با توجه به ادله مشخص شود. از آنجا که معذوران انواع مختلفی دارند، بالتبع احکام متفاوتی نیز دارند که پس از بررسی سندی و دلالی روایات، این احکام روشن می گردد. در مورد حکم طواف هم هر چند برخی افزون بر انجام طواف توسط فرد معذور، به لزوم نایب گرفتن نیز فتوا داده اند اما مقتضای ادله آن است که نیابت لازم نیستو در مورد حکم نماز طواف و لزوم تحصیل طهارت جدید نیز بین فقها اختلاف وجود دارد که هرچند احتیاط در تجدید وضوست، اما نتیجه بررسی ادله عدم لزوم آن است.

    زیارت اهل قبور و اهل بیت (علیهم السلام) مانند هر کار دیگری که انسان انجام می دهد آثاری بر روی شخص و اطرافیان او بر جای می گذارد. این تاثیرها گاهی از لحاظ فردی بررسی می شود و گاهی از لحاظ اجتماعی مورد دقت قرار می گیرد و گاهی از دید دیگر ادیان زیارت اهل قبور بررسی می شود.در این جستار برآنیم که ابتدا از باب مقدمه به چرایی انجام زیارات در جهت صحیح اشاره کرده و بیان کنیم که از نظر شرع و عقل چرا نباید از این جهت خارج شد و در نهایت ابعاد تربیتی زیارت را از لحاظ شخصی و اجتماعی و نیز تاثیر آن بر افراد خارج از دین اسلام و تشیع را بررسی کنیم و نیز اثرات منفی و مضر بدعت ها و خرافات را در بحث زیارت مورد واکاوی قرار دهیم؛ همچنین از آنجا که زیارت، آداب و رسوم و بایدهاو نباید های خاص خود را دارد و دارای آثار تربیتی فراوان است در این نوشتار برآنیم تابه مهم ترین ابعاد تربیتی زیارت اهل بیت (علیهم السلام) و اولیای الهی اشاره نماییم.

    یکی از اعمال حج احرام قبل از میقات است و از آنجا که توقف حایض و نفسا به مسجد شجره (میقات اهل مدینه) ممنوع است و ورود به نحو عبور از یک درب و خروج از درب دیگر مسجد به جهت شلوغی جمعیت، عادتا امکان پذیر نیست ضروری است با بررسی فتوای فقها و ادله مستند ایشان تکلیف زن مشخص گردد که از کجا و به چه نحو باید محرم گردد؛ آیا واجب است قبل از میقات با نذر، محرم گردد و از میقات بگذرد و برای صحت نذرش اذن شوهر لازم است یا نه؟پاسخ به این پرسش، موجب تسهیل امر احرام به عنوان اولین عمل مناسک حج بر زنان معذور (حایض و نفسا) است.در این نوشتار با بررسی فتوای فقها و ادله مورد استناد ایشان، تنها جواز نذر قبل از میقات با رعایت شروط نذر به فتوای مشهور فقها برای زنان معذور  به دست آمده و وجوب نذر احرام قبل از میقات اثبات نمی شود؛ هرچند برخی نیز به عدم جواز احرام قبل از میقات فتوا داده اند.

    فاطمیان (567 297ق) خلافتی شیعی بودند که پس از فعالیت های تشکیلاتی مخفی توسط سازمان دعوت اسماعیلیان و با استفاده از ظرفیت های موجود درمیان قبایل بربر شمال آفریقا دولتی تشکیل داده و با فتح مصر و بنای شهر قاهره چشم انداز خود را در فتح شرق اسلامی آشکار کرده و به رقابت با خلافت عباسیان پرداختند. نگاه و عملکرد فاطمیان در دوره مغرب (297-362ق) و مصر (632-567ق) از چند جهت متفاوت بود. این تحقیق با روش تحلیلی و رویکرد تاریخی و با استفاده از منابع کتابخانه ای درصدد پاسخ به این پرسش است که فاطمیان در دوره مغرب و مصر درخصوص حج گزاری و آیین های مربوط به حج و حرمین چه تفاوت هایی داشتند؟ یافته های پژوهش نشان می دهد که حج به عنوان نقطه اشتراک امت اسلامی و حرمین به عنوان مناطق مورد احترام همه مسلمانان بود؛ ولی این موضوع برای فاطمیان مغرب به عنوان حکومتی محلی دور از مرکز جهان اسلام و فاطمیان مصر به عنوان یک خلافت، امپراطوری رقیب عباسیان در یک پایه نبود. فاطمیان مغرب مشکلات اجتماعی و درگیری هایی که با امویان اندلس داشتند و حج و حرمین در اولویت مسایل این دولت نبود؛ فاصله جغرافیایی از مرکز جهان اسلام نیز آن را تشدید می کرد. در مقابل، فاطمیان مصر به دلیل تثبیت در مرکز جهان اسلام و رقابتبا عباسیان به تسلط سیاسی برحج وحرمین و برگزاری آیین های اجتماعی مربوط به آن اهتمام داشتند. نگاه جهانی واقدامات راهبردی ناشی از آن نیز در توجه به این مساله موثر بود. از طرفی ضرورت مرزبندی با قرامطه و نزدیک شدن به افکار عمومی امت اسلامی بویژه اهل سنت نیز ایجاب می کرد به مساله حج وحرمین اهمیت زیادی نشان دهند.

    حضرت ابراهیم (علیه السلام) به امر خداوند، همسر و فرزند خردسالش را در سرزمین بی آبو آبادانی مکه به امان خدا رها کرد. پس از تمام شدن آب و غذای مادر و فرزند، طفل خردسال بی تاب از تشنگی، پا بر زمین می سایید و مادر در پی یافتن آب از صفا به مروه و از مروه به صفا می شتافت، ولی چیزی جز سراب نبود. ناامید به سمت کودک خود بازگشت که دید خداوند به قدرت خود، چشمه آبی در زیر پای کودکش روان ساخته است که موجب روشنی دیدگان او گردید.اکنون پس از هزاران سال، حاجیانی از سراسر جهان به زیارت خانه خدا می آیند و از آن آب متبرک هم خود می نوشند و هم برای دیگران به عنوان هدیه و تبرک می برند. در طول هزاران سالی که از این پدیده شگفت حرم الهی گذشته، زمزم شاهد تحولاتی بوده و در رهگذر حوادث، مسیری طولانی طی کرده است.نوشتار پیش رو به شیوه توصیفی در پی آن است که با مراجعه به آثار نگاشته شدهدر این باره، به صورت مستقیم نگاهی به اخبار تاریخی مربوط به این پدیده منحصربه فرد در روایات مستند تاریخی و نیز روایات اسلامی داشته باشد و در این زمینه، متون متقدم و معاصر را از نظر گذرانده است.

    جهت تحقیق و بررسی مسایل حقوقی حاکم بر حج قبل از معاهدات، عرف ها و حقوق بین الملل و قبل از توجه به حقوق داخلی عربستان؛ باید به بازخوانی احکام ویژه مسجد الحرام و ظرفیت های تشریعات و آموزه های فقهی مرتبط با حج همچون حرمت قتال، امنیت حرم، اعلام برایت، صد از مسجدالحرام و مساوات و برابری حج گزاران پرداخت؛ آموزه هایی که از جانب وحی است، خطا در آن راه ندارد و مورد قبول همه مسلمانان است و بی شک مراجعه به این قواعد اسلامی زمینه ساز استیفای حقوق حج گزاران در جریان برگزاری این عبادت بزرگ خواهد شد.

    The legitimate actions and behaviors of human beings in Islamic law are sometimes derived from customary behaviors and custom determines its limits and limitations, but sometimes it is forbidden and requires the expression of the shari'ah. Hajj is one of those acts of worship that are forbidden and do not appear in its place. The purpose of this article is to investigate whether the distance between an action or between actions hinders the totality and correctness of this worship or not? In other words, is the connection between actions and movements obligatory in Hajj or not? According to the search, we came to the point that in some cases it is obligatory and in others it is not. The criterion in determining the fulfillment of duties or not is custom.

    The study of the rulings of the worship acts that physically-excused pilgrims of Hajj and Umrah perform is one of the major and innovative jurisprudential concerns. Being mabtun or maslus describes a condition in which man cannot control his urine or feces. Some acts of worship in Hajj and Umrah such as prayer, Ṭawaf, and Ṭawaf prayer are difficult for these excused people to perform. This article will use evidence to determine the jurisprudential rulings of these pilgrims’ worship acts. Since the excused pilgrims’ justifications vary, they are subjected to distinct rulings, which will be discussed here following the documentary and logical evaluation of the narrations. Regarding the ruling on Tawaf, while, some issue fatwas on the necessity of hiring an agent to perform Tawaf on behalf of the excused pilgrim besides his own performance, the evidence finds this agency unnecessary. Also, with regards to Tawaf prayer and the necessity of renewing ablution, jurisprudents provide different ideas; despite the precaution of renewing ablution, examining the evidence finds it unnecessary.

    The pilgrimage of the dead people and Ahl-Beit (P.B.U.T) has some effects on the person itself and his/her relatives (entourages) like any other things that a human does. Such effects are sometimes investigated individually and sometimes are subtilized socially and sometimes are studied in terms of the other religions’ viewpoint on these actions. In this research, we are aiming at mentioning firstly an introduction into the reasons why we go on a pilgrimage in the right direction and at stating that why we shouldn’t get out of this direction in terms of sharia and wisdom, and ultimately, we will study the educational aspects of pilgrimage individually and socially as well as its impact on non-Muslim and non-Shiite people. We also will investigate the negative and harmful effects of heresies and superstitions in pilgrimage. Also, since the pilgrimage has its own customs, do’s and don’ts and huge educational effects, we are going to mention the most important educational aspects of Ahl-Beit pilgrimage (P.B.U.H) and divine saints.

    The Importance of Political Practice - The Hajj is Not Covered, and the remarkable presence of women in the Hajj doubles the need for scrutiny of the Hajj-related religious and religious rulings of women, with research focusing on women's religious and religious issues. While examining how women vow in Imamiyah jurisprudence, it seeks to answer the question of whether or not women are licensed or permitted to have Ihram vowels before the Mejah. And what has finally come to light through the study of the Quranic verses, traditions, and researches in authentic jurisprudential books is that women in religious excuse can not be restrained by their husbands' permission before reaching the appointed meetings.

    The view and practice of the Fatimids in the Maghreb (297-362 AH) and Egypt (632-567 AH) were different in different ways. This study seeks to answer the question of what were the differences between the Fatimids in the Maghreb and Egypt periods regarding the rituals related to Hajj and the two holy shrines and why there were differences. The findings of this study show that Hajj was the common point of the Islamic Ummah and the two holy shrines as areas of respect for all Muslims, but this was for the Fatimids of the Maghreb as a local government far from the center of the Islamic world and the Fatimids of Egypt as a caliphate / empire. The Abbasid rival was not on the same footing. The Fatimids of the Maghreb had social problems and conflicts with the Umayyads of Andalusia, and Hajj and the two holy shrines were not a priority for this government; The geographical distance from the center of the Islamic world also intensified it. On the other hand, the Fatimids of Egypt, due to their establishment in the center of the Islamic world and their rivalry with the Abbasids, sought political domination over the Hajj and the two holy shrines and the holding of related social rituals. The global perspective and the resulting strategic measures were also effective in addressing this issue. On the other hand, the necessity of demarcating the border with Qaramah and approaching the public opinion of the Islamic Ummah, especially the Sunnis.

    To research the legal issues governing Hajj, before referring to treaties, customs, and international law and before studying Saudi Arabia’s domestic law, it is necessary to recite the special rules of the Holy Mosque (Masjid al-Haram) and the capacities of the law and jurisprudential teachings related to Hajj, such as the sanctity of fighting, the security of the Shrine, the declaration of innocence, the impossibility of performing the worship of the Holy Mosque, and the equality of the pilgrims. These teachings are from revelation, absolutely correct, and accepted by all Muslims. Referring to these Islamic rules will definitely pave the way to achieve the pilgrims’ rights while performing this great worship.
