    زمینه و هدف

    حفظ نهاد خانواده به مثابه یکی از مهم ترین بنیادهای اجتماعی در بسیاری از جوامع به خصوص جامعه ایرانی- اسلامی مورد تاکید بسیار قرار گرفته آن طور که در قانون اساسی به آن توجه ویژه ای شده است. فرزندان از عناصر اصلی این نهاد بنیادین و حافظان ارزش های خانواده و عامل استمرار و بقای آن هستند. از طرفی اینستاگرام به مثابه یکی از شبکه های اجتماعی محبوب دنیای امروز بستری برای تبادل اطلاعات و تصاویر، تبلیغات و کسب درآمد، اشتراک گذاری مطالب علمی، آموزشی، سرگرمی، گذران اوقات فراغت و آشنایی با افراد جدید و فرهنگ های متفاوت است؛ لیکن این ابزار روزآمد تکنولوژی در عین سودمندی و محبوبیت، به ویژه برای نهاد خانواده و کودکان و نوجوانان، می تواند مخرب و خطرناک باشد. هدف این مطالعه بررسی آثار سوء شبکه اجتماعی اینستاگرام بر انحراف از الگوی مطلوب خانواده مورد توجه قانون اساسی با تاکید بر وضعیت کودکان است.

    روش

    این تحقیق به صورت توصیفی و با استفاده از شیوه کتابخانه ای به انجام رسیده است.

    یافته ها: 

    اینستاگرام، بستری فراملی و محل تقابل فرهنگ ها و هنجارها و ارزش های متفاوت و گاهی متناقض است. معایب غیرقابل انکار فضای مجازی و بالاخص محیط اینستاگرام مانند: جذابیت پوشالی و به دور از واقعیت آن و به دنبال آن کاهش روابط اجتماعی حقیقی و دوری از محیط خانواده و ایجاد و القای احساس نارضایتی، دل زدگی، و... می تواند بنیاد خانواده مطلوب را که بسیار مورد توجه و اهتمام قانون اساسی جمهوری اسلامی ایران است مورد هدف قرار داده و بر پیکره آن صدمات غیرقابل جبرانی وارد آورد.

    نتیجه گیری:

     محیط اینستاگرام می تواند زمینه مساعدی برای بهره کشی نوین اقتصادی (استفاده از کودکان برای کسب درآمد) یا تاثیرگذاری فرهنگی باشد و از این طریق منجر به ورود آسیب به حریم شخصی و استقلال کودک و تربیت سالم او و در نتیجه تضعیف جایگاهش در خانواده شود.

    زمینه و هدف

    حقوق اقتصادی آن دسته از حقوق مدون در میثاق بین المللی حقوق اقتصادی، اجتماعی و فرهنگی (1966) است که برای اولین بار در اعلامیه جهانی حقوق بشر در سال 1948 مورد توجه قرار گرفته است. حقوق بین الملل کار نیز در کنوانسیون سازمان بین المللی کار (ILO)، به عنوان موسسه تخصصی سازمان ملل، کانون توجه بوده است. در رابطه با کودکان، کنوانسیون حقوق کودک در سطح بین المللی و قانون حمایت از اطفال و نوجوانان در سطح داخلی، حمایت های مشخصی را منظور داشته اند. مطالعه حاضر با هدف بررسی نقش حقوق اقتصادی در حمایت از حقوق کار کودکان و تحلیل مشکلات اصلی محافظت از حقوق اقتصادی و کارگری کودکان در حقوق ملی و بین الملل انجام گردید.

    روش

    این تحقیق به روش توصیفی- تحلیلی و با استفاده از منابع کتابخانه ای به انجام رسیده است.

    یافته ها:

     حمایت از حقوق کودک در برابر استثمار اقتصادی و انجام هرگونه کار زیان بار در کنوانسیون حقوق کودک (1989)  مورد تاکید قرار گرفته است. متاسفانه در اسناد بین المللی به عوامل ایجاد کار کودکان و پیش بینی ضمانت اجرا یا سازوکاری برای حل این معضل توجهی نشده است. پیرو اسناد بین المللی، قانون حمایت از اطفال و نوجوانان مصوب 1399 در ایران، نه تنها بهره کشی اقتصادی را تعریف کرده بلکه وادار کردن طفل یا نوجوان به فعالیت هایی نظیر تکدی گری و قاچاق و هرگونه فعالیتی که موجب ورود آسیب به سلامت جسمی، روانی و اجتماعی، اخلاقی، امنیت یا وضعیت آموزش وی گردد را به عنوان وضعیت مخاطره آمیز محسوب کرده است که موجب مداخله فوری و حمایت قانونی خواهد شد.

    نتیجه گیری: 

    حمایت از کودکان در محیط کار و حفاظت در برابر بهره کشی اقتصادی زمانی به اهداف عالی خود می رسد که سایر حقوق آن ها که در کنوانسیون مورد تصریح قرار گرفته است، از جمله حق بهره مندی از تامین اجتماعی (ماده 26)، حق داشتن استاندارد زندگی مناسب برای رشد جسمی، روحی، معنوی، اخلاقی و اجتماعی (ماده 27) و حق محافظت در برابر کارهایی که سلامت، تحصیلات یا پیشرفت کودک را تهدید می کند (ماده 32)، برای تمام کودکان به طور برابر و یکسان و با هر شرایط سنی تحقق یابد.

    زمینه و هدف

    حق نشاط را می توان به عنوان سلامت روانی در مقابل حق بر سلامت جسمانی تلقی کرد؛ حقی که به عنوان یکی از حقوق مسلم بشر آورده شده است. این حق در مورد کودکان از اهمیت مضاعفی برخوردار است. هدف این نوشتار، بازشناسی و تمیز مفهوم حق نشاط کودک و بررسی انواع و مصادیق آن است.

    روش

    ارایه و تحلیل مباحث با استفاده از روش توصیفی تحلیلی و جمع آوری اطلاعات به صورت کتابخانه ای (اسنادی) انجام پذیرفته است.

    یافته ها: 

    برخلاف لذت، نشاط مقوله ای است که به رغم تاثیرپذیری از محیط، به آن وابسته نمی باشد و در حقیقت، نشاط چهره ای از سلامت روانی و معنوی است که زمینه مدیریت مطلوب احساسات در مواجهه با عوامل محیطی را فراهم می آورد. این موضوع مهم در رابطه با کودکان اهمیت ویژه ای پیدا می کند، زیرا زندگی کودک تابعی از زندگی خانوادگی و محیط پیرامونی وی است که در انتخاب آنان نقشی ندارد. بنابراین مسیولیت قانونگذار و مجریان برای تلاش در راستای فراهم نمودن محیط بانشاط برای کودکان، دوچندان می شود.

    نتیجه گیری:

     دولت ها در راستای فراهم آوردن نشاط معنوی برای کودکان مسیولیت مهمی دارند. بر اساس کنوانسیون حقوق کودک، کودک باید در محیط خانوادگی با فضایی که در آن شادی، عشق و درک متقابل موجود است بزرگ شود. به نظر می آید در این مورد که شادی را از جمله حقوق کودکان آورده است، بتوان هم نشاط معنوی و هم نشاط مادی را در نظر گرفت. در این میان، با تفسیر موسع از حق آموزش، این حق را می توان عاملی موثر برای تحقق نشاط معنوی و ابزاری برای تضمین آن دانست.

    زمینه و هدف

    سنجش آمادگی تحصیلی در بدو ورود به مدرسه برای تعیین وضعیت و تشخیص نیازهای آموزشی و انطباق دوره های آموزش در مدرسه عادی یا استثنایی با شرایط کودک صورت می گیرد. این برنامه برای رسیدن به اهداف خود در نظام آموزش نیازمند اجرای صحیح است. مطالعه حاضر با هدف بررسی مشکلات و چالش های موجود در فرایند سنجش تحصیلی کودکان دارای اختلالات یادگیری و مبتلایان به اوتیسم با ملاحظه الزامات حق بر آموزش به انجام رسید.

    روش

    این تحقیق با استفاده از بررسی های میدانی و ثبت شواهد ناشی از بررسی یک نمونه موردی در فرایند سنجش تحصیلی و همچنین بهره گیری از اسناد کتابخانه ای و منابع اینترنتی به انجام رسید.

    یافته ها: 

    عواملی نظیر اطلاع رسانی ناکافی، تراکم مراجعین، زمان کوتاه ارزیابی، طولانی شدن رسیدگی، جداسازی کودک از والدین، فقدان مشاوره و ارایه توضیح کافی، عدم حق اعتراض به نتیجه سنجش و بی توجهی در نتیجه ارزیابی به زیرساخت ها و امکانات آموزشی در منطقه، چالش هایی را در فرایند سنجش تحصیلی خاصه برای کودکان دارای اختلالات یادگیری (به ویژه کودکان با اختلالات خفیف و عملکرد هوش مرزی که تشخیص وضعیت آن ها و دوره آموزشی مناسب، از حساسیت بیشتری برخوردار می باشد)،  ایجاد نموده است که خود به طور مستقیم یا غیرمستقیم کیفیت تحقق حق بر آموزش این کودکان را تحت تاثیر قرار می دهد.

    نتیجه گیری: 

    مشکلات موجود در فرایند سنجش تحصیلی می تواند زمینه امکان تصمیم گیری های ناصحیح و غیرمنطبق با شرایط و امکانات موجود را برای کودکان دارای اختلالات یادگیری و مبتلایان به اوتیسم، در پی داشته باشد. با توجه به ابعاد و الزامات حق بر آموزش کودکان در اسناد داخلی و بین المللی و اهمیت دریافت آموزش باکیفیت و موثر و تامین منافع کودک، رفع نقایص و بهبود وضعیت کیفی سنجش تحصیلی دانش آموزان در بدو ورود به مدرسه ضروری به نظر می رسد.

    زمینه و هدف

    پدیده بزه کاری کودکان از مهم ترین چالش های جوامع می باشد که تاثیرات مخربی را بر خانواده و جامعه تحمیل می کند. از طرفی رسانه ها نقش بسیار موثری را در کاهش یا افزایش بزه کاری در سطح جامعه ایفا می کنند. هدف از انجام این پژوهش، تبیین میزان اثرگذاری رسانه های جمعی بر رفتارهای بزه کارانه کودکان است.

    روش

    این پژوهش با استفاده از روش توصیفی تحلیلی از طریق مطالعه کتابخانه ای انجام پذیرفت.

    یافته ها: 

    یافته ها حاکی از آن است که نمی توان رسانه های جمعی را به عنوان عامل مستقیم بزه کاری دانست، اما می توان گفت که این رسانه ها موجبات بالفعل شدن استعدادهای بالقوه جنایی کودک می شود. در این میان رسانه های تصویری و مجازی از طریق نمایش خشونت و ارتباطات ناسالم و منحرفانه در بزه کاری کودکان موثر واقع می شوند.

    نتیجه گیری: 

    نتایج نشان می دهد که تاثیر هر یک از رسانه های جمعی در کاهش یا افزایش بزه کاری کودکان متغیر می باشد، به طوری که تا پیش از ایجاد و ورود ماهواره و فضای مجازی به زندگی شهروندان، تلویزیون تاثیر زیادی در کاهش و افزایش بزه کاری کودکان داشته است، البته در ایران، با توجه به نظارت و کنترل حاکمیت بر محتوای برنامه های تلویزیون، این رسانه بیشتر در جهت کاهش بزه کاری اطفال گام برداشته است. در مقابل رسانه هایی نظیر ماهواره و شبکه های مربوط به فضای مجازی با توجه به عدم وجود چارچوب تقنینی منظم و عدم کنترل و نظارت کافی بر محتوای آن ها تاثیرگذاری فراوانی بر رشد بزه کاری کودک داشته است.

    زمینه و هدف

    پژوهش حاضر به دنبال شناسایی وضعیت کودکان ایرانی بر اساس تحولات نهاد خانواده است. چنین مطالعه ای مقدمه ای بر مطالعات پیرامون آینده کودکی در ایران است، زیرا چشم اندازی از وضعیت آن ها در چند سال آینده به ما ارایه می کند.

    روش

    رویکرد پژوهش کیفی است و از روش های تحقیق چندگانه همچون تحلیل اسنادی، تحلیل ثانویه اطلاعات و فراتحلیل برای گردآوری و تجزیه و تحلیل یافته ها استفاده شده است.

    یافته ها: 

    یافته ها نشان می دهند که کودکان، کودکی آن ها و حقوق کودکان به عنوان سه پایه اصلی مطالعات کودکی، در درون فضای تحولی نهاد خانواده در ایران به سرعت در حال دگرگونی هستند. کمترین تحول آن ها در: 1 سطح پایه اول یعنی کاهش جمعیت کودکان به دلیل کاهش ازدواج و نرخ موالید است؛ 2 تحول کودکی با محوریت تحول مفهومی از معنایی جمع گرایانه و مبتنی بر خانواده به فضای مفهومی فردیت یافته، آسیب مندتر و محدود به فضای مجازی پیش می رود؛ 3 تحول حقوق کودک از مبانی و مواد مبتنی بر محوریت نهاد خانواده به سمت حقوقی فردگرایانه تر رفته و با کاهش انسجام و همبستگی نهاد خانواده و کاهش نقش حمایتی و نظارتی خانواده نسبت به کودکان، اهمیت وجود ساختار حقوقی با ضمانت اجرایی دقیق تر برای کودکان روز به روز بیشتر می شود.

    نتیجه گیری:

     آینده کودکان و کودکی آن ها در ایران پیرو تحولات خانواده به سمت کاهش جمعیت کودکان، فردیت بیشتر کودکان، آسیب مندی بیشتر و انزوای آن ها، افزایش اهمیت حقوق کودکان و تدقیق مواد قانونی در همه ابعاد و تا بیشترین سطح و همچنین افزایش ضمانت اجرایی مواد مرتبط با حقوق کودک، سوق می یابد.

    Background and Aim

    Protection of the family as one of the most important social foundations in many societies, especially the Iranian-Islamic society, has been emphasized strongly, as it has been given special attention in the Constitution. Children are one of the main elements of this fundamental institution and the guardians of family values ​​and the factor of its continuity and survival. On the other hand, ‘Instagram’, as one of the popular social networks in today's world, is a platform for exchanging information and images, advertising and making money, sharing scientific, educational, entertainment contents, spending free time and getting to know new people and different cultures; But this modern tool of technology, while useful and popular, especially in relation to the family and children, can be destructive and dangerous. The purpose of this study is to examine the negative effects of the Instagram social network on the deviation from the ideal family model considered by the Constitution, with an emphasis on the situation of children.

    Method

    This study was done by descriptive method and using library resources.

    Results

    Instagram is a transnational platform and a place where different and sometimes contradictory cultures, norms and values meet. Undeniable disadvantages of the virtual space and especially Instagram, such as: its fake attraction and far from reality, followed by the reduction of real social relationships and distance from the family environment, and creating and inducing feelings of dissatisfaction, boredom, etc. can threat the ideal family foundation in the Constitution of the Islamic Republic of Iran and caused irreparable damage to it.

    Conclusion

    Instagram can be a ground for new economic exploitation (using children to earn money) or cultural influence and thus lead to damage to the privacy and independence of the child and his/her healthy upbringing and as a result weaken the position of child in the family.

    Background and Aim

    Economic law is one of the rights enshrined in the International Covenant on Economic, Social and Cultural Rights (1966), first enshrined in the Universal Declaration of Human Rights in 1948. International labor law is also enshrined in the International Labor Organization (ILO) Convention as a specialized agency of the United Nations. In relation to children, the Convention on the Rights of the Child at the international level and the Law on the Protection of Children and Adolescents at the domestic level have provided specific protections. This study aims to examine the role of economic rights in protecting children's labor rights and analyze the main problems of protecting children's economic and labor rights in national and international laws.

    Method

    The present study has been done using descriptive-analytical method and using library resources.

    Results

    Protecting the rights of the child against economic exploitation and doing any harmful work is emphasized in the Convention on the Rights of the Child (1989). Unfortunately, international documents do not pay attention to the factors that create child labor and provide enforcement guarantees or mechanisms to solve this problem. Following the international instruments, the Law on the Protection of Children and Adolescents (1399) of the Islamic Republic of Iran not only defines economic exploitation but it also considers forcing a child or teenager to engage in activities such as begging and trafficking, and any activity that causes damage to his physical, mental, social and moral health and security, or educational status, as a risky situation which will cause immediate intervention and legal support.

    Conclusion

    Protection of children in the work environment and protection against economic exploitation will reach their high objectives if the other rights specified in the convention, including the right to benefit from social security (Article 26), the right to have a standard of living suitable for growth physical, mental, spiritual, moral and social rights (Article 27) and the right to protection against actions that threaten the child's health, education or development (Article 32), should be realized equally for all children with all age conditions.

    Background and Aim

    "The Right to Happiness" can be considered as mental health in contrast to the right to physical health; A right that is one of the definitive rights of human beings. This right is especially important for children. The purpose of this article is to recognize and distinguish the concept of the child's right to happiness and examine its types and examples. 

    Method

    The presentation and analysis of discussions has been done using the descriptive-analytical method and data collection was in a library (documentary).

    Results

    Contrary to pleasure, happiness is a concept that is not dependent on it despite being influenced by the environment and in fact, happiness is a face of mental and spiritual health that provides the basis for the optimal management of emotions in the face of environmental factors. This issue becomes especially important in relation to children because the life of a child is a function of his family life and his surrounding environment, which does not play a role in their choice and therefore the responsibility of the legislator and executives to try to provide a happy environment for children is more.

    Conclusion

    Governments have an important responsibility in providing spiritual happiness for children. According to the Convention on the Rights of the Child, a child should grow up in a family environment with an atmosphere of happiness, love and mutual understanding. It seems that in this case, which brought happiness among children's rights, both spiritual and material happiness can be considered. In the meantime, with a broad interpretation of the right to education, this right can be seen as an effective factor for the realization of spiritual happiness and a means to ensure it.

    Background and Aim

    Educational assessment is done at the beginning of entering the school to determine the status and identify the educational needs and adapt the education courses in the normal or exceptional schools to the child's conditions. This program needs proper implementation to achieve its goals in the education system. The present study was carried out with the aim of investigating the problems and challenges in the process of educational assessment of children with learning disorders and those with autism, taking into account the requirements of the right to education.

    Method

    This research was carried out by using field investigations and recording evidence from the examination of a case sample in the process of educational evaluation, as well as using library documents and internet resources.

    Results

    Factors such as insufficient information, crowding of referrals, short assessment time, delay in processing, separation of the child from parents, lack of counseling and adequate explanation, lack of right to protest the assessment result, and inattention to the infrastructure and educational facilities in the region as a result of the assessment, are challenges in the educational assessment process which in relation to children with learning disorders (especially children with mild disorders and borderline intellectual functioning,, whose condition diagnosis and appropriate training course is more sensitive), can directly or indirectly affect the quality of fulfilling the right to education.

    Conclusion

    The problems in the educational assessment process can lead to the possibility of making incorrect decisions that are not in accordance with the existing conditions and facilities for children with learning disorders and children with autism. Considering the dimensions and requirements of children's right to education in domestic and international documents and the importance of receiving high-quality and effective education and protecting the child's interests, it seems necessary to eliminate the defects and improve the quality of the students' assessment upon entering the school.

    Background and Aim

    The phenomenon of juvenile delinquency is one of the most important challenges in societies that imposes destructive effects on the family and society. On the other hand, the media play a very effective role in reducing or increasing crime in society. The purpose of this study is to explain the impact of mass media on juvenile delinquent behaviors.

    Method

    This research was done using the descriptive-analytical method in the way of library study.

    Results

    The findings indicate that the mass media can not be considered as a direct cause of crime. But it can be said that these media outlets bring out the potential of children's criminal talents. Meanwhile, video and virtual media are effective in juvenile delinquency through the display of violence and unhealthy and perverted communication.

    Conclusion

    The results show that the impact of each mass media in reducing or increasing juvenile delinquency is variable. Before the creation and entry of satellites and cyberspace into the lives of citizens, television had a great impact on reducing and increasing juvenile delinquency. Of course, in Iran, due to the government's control and control over the content of television programs, this media has taken more steps to reduce juvenile delinquency. In contrast, media such as satellite and networks related to virtual space, due to the lack of a regular legislative framework and lack of adequate control and monitoring of their content has had a great impact on the growth of juvenile delinquency.

    Background and Aim

    This study, seeks to identify the situation of Iranian children based on changes in the family institution. This study is an introduction to studies on the future of children in Iran because they provide us with an overview of their situation in the next few years.

    Method

    The research approach is qualitative and multiple research methods such as documentary analysis, secondary information analysis and meta-analysis have been used to collect and analyze the findings.

    Results

    Findings show that children, their childhood and children's rights, as the three main pillars of childhood studies, are rapidly changing within the transformational environment of the family institution in Iran. Their least change is in the first level (1), i.e. the decrease in the population of children due to the decrease in marriage and birth rates; 2- Child development with the focus on conceptual development goes from a collectivist and family-based meaning to an individualized conceptual space, more harmful and limited to cyberspace; 3- By the evolution of children's rights from principles and materials based on the centrality of the family institution to a more individualistic law and with the reduction of cohesion and solidarity of the family institution and reducing the role of family support and supervision over children, the importance of legal structure with more precise executive provisions for children is increasing.

    Conclusion

    The results show that the future of children and their childhood in Iran follows the family changes towards reducing the population of children, more individuality of children, more vulnerability and isolation, increasing the importance of children's rights and refining its materials in all dimensions and up to the highest level as well as the increase in the executive guarantee of articles related to child rights.
