    پژوهش در حقوق بین الملل، ممزوج با الگوهای فکری نهادینه شده و گاه نااندیشیده است که در ذهن پژوهشگر، بدیهی جلوه می کند. روش شناسی، ابزاری برای انتخاب آگاهانه الگوی تفکر علمی و عرضه استدلال معتبر بر اساس آن چارچوب است. ازجمله دلالت های مفهومی تقریبا ناشناخته روش شناسی در ادبیات دانشگاهی کشور، کاربرد این مفهوم به مثابه «اعمال آموزه های مکتب محور بر موقعیت های عینی» است. در این مقاله، متعاقب تبیین دریافت های کلاسیک از مفهوم روش شناسی، به تبیین محتوا و امتیازات کاربرد روش شناسی به مثابه اعمال آموزه های مکتبی پرداخته می شود تا از این رهگذر، زمینه ای برای ترغیب دانش پژوهان ایرانی به اتخاذ رویکردهای روش شناسانه مکتب محور در پژوهش های حقوقی فراهم شود. افزون بر مورد فوق، با ارایه نمونه آماری در خصوص جایگاه روش شناسی تحقیق در رساله های دکتری دانشگاه های دولتی تهران، یافته هایی ارایه می شود که بر اساس آن می توان اظهار داشت در عالی ترین پژوهش های دانشگاهی کشور نیز مقوله روش شناسی از مرتبت شایسته ای برخوردار نیست.

    یکی از علل اهمیت ویژه کمیته حقوق بشر در حمایت و ارتقای حقوق بشر، ماموریت این نهاد مبنی بر تصویب نظرات تفسیری است. با وجود اینکه کمیته، صالح به تصویب و انتشار نظرات تفسیری وفق بند 4 ماده 40 میثاق بین المللی حقوق مدنی و سیاسی است، ماهیت و جایگاه قانونی این تفاسیر، همواره محل بحث بوده است. قدر متیقن آنکه نظرات تفسیری کمیته حقوق بشر که عصاره تمامی دانش ها، یافته ها و تجارب کمیته در خلال انجام ماموریت ها هستند، اگرچه به لحاظ قانونی الزام آور نیستند، دارای جایگاه حقوقی در سلسله منابع غیرحصری حقوق بین الملل بوده و می توان آن ها را در زمره منابع فرعی یا کمکی حقوق بین الملل به شمار آورد. در این چارچوب، مسیله اصلی مقاله حاضر، جایابی نظرات تفسیری در سلسله منابع حقوق بین الملل، تبعیت از آن ها به دلیل جایگاه قانونی و متعاقبا توسعه و ارتقای حقوق بشر از دریچه تصویب آن ها بود.

    یکی از موضوعات اصلی در حقوق بین الملل سرمایه گذاری، تامین حقوق سرمایه گذار از طریق وضع استانداردهای حقوقی بین المللی، ازجمله اتخاذ رفتار منصفانه و برابر از سوی دولت با سرمایه گذار است که در صورت نقض آن، سرمایه گذار می تواند مستقیما در مرجع داوری بین المللی ذی ربط علیه دولت میزبان طرح دعوا کند. اما در دعوای انکار عدالت، سرمایه گذار ناگزیر است ابتدا به مراجع داخلی کشور سرمایه پذیر مراجعه و دادخواهی کند و اگر دادخواهی او به نتیجه نرسید و عدالت در حق او اجرا نشد، می تواند به مرجع بین المللی رجوع کند. هدف این مقاله، ارزیابی ضرورت اجرای قاعده دادخواهی نزد محاکم داخلی در دعوای انکار عدالت با تاکید بر رای پرونده لوون علیه ایالات متحده امریکا به عنوان مهم ترین پرونده موجود است. یافته اصلی در این مقاله آن است که تحلیل قاعده دادخواهی نزد محاکم داخلی در این رای به تشتت آرا در این باره دامن زده است و برای رفع این ابهام و تشتت در رویه داوری سرمایه گذاری در زمینه قلمرو اجرای قاعده در انکار عدالت، باید منتظر رویه معاهداتی دولت ها در معاهدات دو یا چند جانبه تشویق و حمایت متقابل از سرمایه گذاری بود.

    دو نهاد بین المللی، یکی دیوان کیفری بین المللی و دیگری شورای امنیت سازمان ملل متحد با توجه به روابطی که با یکدیگر دارند، موضوع مباحث در عرصه حقوق بین المللی قرار گرفته اند. اولی کار قضایی و دومی کار سیاسی می کند. همزیستی این دو نهاد نیز اگرچه مبتنی بر مقررات اساسنامه دیوان کیفری بین ا لمللی (مواد 12 تا 16)، است چالش هایی به همراه داشته است. با وجود تلاش برای تدوین اساسنامه دیوان، و پیشرفت های حقوق بین الملل، نظر به ارتباط آن با شورای امنیت، هنوز برخی نویسندگان حقوقی کیفری بین المللی به آن به عنوان موضوع سیاسی نگاه می کنند. اگرچه صرف ارتباط شورای امنیت با دیوان باعث تقابل و سیاسی شدن دیوان نخواهد شد، دیوان برای حفظ کارایی و مشروعیت و استقلال خود، ضمن وفاداری به اساسنامه در برخی موارد (همانند تعویق تعقیب یا تحقیق) باید از شورای امنیت نیز تبعیت کند. آنچه در روابط بین این دو نهاد می گذرد، در این تحقیق مورد مطالعه قرار گرفته و یافته های تحقیق، حکایت از آن دارد که شورای امنیت می تواند با استفاده از ابزارهایش به دیوان اثر سیاسی بگذارد. اما سوال مهم این است که شورای امنیت از چه طریق و بر مبنای چه معیارهایی قادر به اعمال نفوذ سیاسی بر دیوان است؟ به نظر می رسد شورای امنیت و در راس آن قدرت های بزرگ دنیا با توجه به منافعی که دارند از طرق مختلفی ازجمله هدایت شیوه ارجاع دهی و کنترل دیوان بتوانند بر این نهاد قضایی اثر سیاسی بگذارد.

    یکی از پیامدهای گزیرناپذیر مسیولیت بین المللی برای دولت ها، تعهد به جبران کامل خسارات ناشی از عمل متخلفانه است. برخلاف اعاده و غرامت که عمدتا برای جبران زیان مادی کاربرد دارند، رویه دولتی، رویه قضایی و به ویژه کمیسیون حقوق بین الملل، جلب رضایت را روش مناسب جبران زیان غیرمادی می دانند. بررسی این رویه ها نشان می دهد که جلب رضایت عموما از طریق فراگردهایی همچون عذرخواهی، اعلام متخلفانه بودن عمل و تعقیب و کیفر خاطیان صورت می پذیرد. در مقابل، جلب رضایت به روش مالی با چالش های جدی مواجه است اما بررسی های این مقاله نشان می دهد که به طور استثنایی در صورت ایراد زیان غیرمادی شدید و نظام مند به موجودیت های غیردولتی پذیرفته شد. رای 9 فوریه 2022 دیوان بین المللی دادگستری در قضیه جبران خسارت (کنگو علیه اوگاندا) فرصتی بود تا دیوان ابهام های موجود درباره جلب رضایت را برطرف کند. اما همان گونه که این مقاله نشان خواهد داد، این رای تردیدها را عمیق تر کرده و دیوان به یافته هایی رسیده است که هیچ سابقه ای برای آن ها در دست نیست.

    الحسن آغ عبدالعزیز آغ محمد آغ محمود از رهبران انصارالدین در جنگ داخلی مالی، اکنون با دو اتهام جنایت علیه بشریت و جنایت جنگی در دیوان کیفری بین المللی مواجه است. ازجمله اقدامات ضدبشری وی می توان به اجرای کیفرهای بدنی اشاره کرد. این پرسش مطرح است که جنایت انگاری اجرای کیفرهای بدنی از منظر اساسنامه دیوان، چگونه تحلیل می شود؟ همچنین باید گره از این معما گشود که چگونه می توان در پرتو پرونده اخیر، در نظام کیفرهای بدنی در حال اجرا در کشورهای اسلامی بازاندیشی کرد؟ تحقیق حاضر دریافته است که اجرای کیفرهای بدنی توسط الحسن با عناصر زمینه ای مادی و معنوی (روانی) جنایت علیه بشریت و جنایت جنگی انطباق دارد. وانگهی اجرای مجازات های جسمانی به دست کشورهای اسلامی جز در صورت وجود عناصر سازنده نمی تواند جنایت بین المللی تلقی شود. با این حال آن ها باید با خوانشی پیام محورانه از پرونده مورد بحث و توجه به کارکرد بیانی دیوان، در تکاپوی بازاندیشی در کیفرهای بدنی برآیند. این موضوع مهمی است که نه تنها قواعد اصولی و فقهی گوناگونی همچون «ملازمه» و «نفی سبیل» آن را تایید می کنند، بلکه در پرتو اعتراضات و واکنش های سازمان های حقوق بشری بین المللی، یکسا ن پنداشته شدن کشورهای اسلامی با گروه های تکفیری در انظار بین المللی و نیز رشد پدیده اسلام هراسی ضرورت می یابد.

    Research in international law is mixed with stereotypes and dogmatic beliefs that seem obvious to the researcher. Methodology is a tool for consciously choosing a scientific framework of thinking and presenting authentic reasoning within the framework. Methodology as application of thought school to concrete situations is one of the conceptual implications of methodology that is almost unknown in Iranian academic literature. In this article, following the explanation of the classical perceptions of methodology, the content and advantages of methodology as the application of school are explained. It is hoped that this article provides a basis for encouraging Iranian scholars to adopt thought school methodological approaches in their legal researches. Furthermore, based on a statistical study regarding the dissertations of Ph.D. students of Tehran public universities, it will be argued that even in the best legal researches in Iran, no proper attention has been paid to the methodological issues.

    One of the reasons for the special importance of the HRC in the protection and promotion of human rights is due to the mission of this institution to adopt GCs. Despite the fact that the committee is competent to adopt GCs according to Art.40 (4) ICCPR, the legal status of these GCs is always the subject of debate. The GCS, which are an extract of all the knowledge, findings and experiences of the Committee during its mandates, have a legal status in the series of non-exclusive sources of international law, although they are not legally binding. They can be considered as secondary or complementary sources of international law. The main issue of this article was the placement of GCs in the normative hierarchy and sources of international law, their compliance due to their legal status, and subsequently the development and promotion of human rights through the lens of their ratification.

    The cornerstone of international investment law is to ensure the foreign investor's rights through international law standards including fair and equitable treatment. If the host state violates the standards, the foreign investor will not be obliged to raise a claim before local courts prior to international settlement of dispute. In contrast, in denial of justice, the investor must exhaust local remedies before seeking international redress. So in this respect, The Loewen case as an important arbitral practice on the relationship of denial of justice and exhaustion of local remedies will be analyzed in this article. The approach of Investment treaties will also be evaluated. This article concluded that arbitral tribunal in Loewen has made mistake by distinction between local remedies and finality rule. In order to resolve this ambiguty and confusion in investment arbitration in the field of denial of justice, one should wait for the treaty procedure of the states in bilateral or multilateral treaties for mutual encouraging and supporting of investment

    Two international organizations, the International Criminal Court and the United Nations Security Council, due to their relationship with each other, have become the subject of discussions in international law. The first one has judicial duties and the second one has political ones. Although the coexistence of these two organizations is based on the provisions of ICC Statute (Articles 12 to 16), it has brought challenges as well. Despite the efforts to compile ICC Statute, and thedevelopments in international law, considering its connection with the Security Council, some international criminal law writers still view it as a political issue. Although the mere connection of the Security Council with the Court will not causes confrontation and politicization of the Court, in order to maintain its efficiency, legitimacy, and independence while remaining loyal to the Statute, in some cases (such as deferral prosecution or investigation), the court must obey the Security Council. What happens in the relationship between these two organizations has been studied in this research and the findings of the research indicate that the Security Council can use its tools to exert a political influence on the Court. But the important question is that in what way and based on what criteria is the Security Council able to exert political influence on the Court? It seem that the Security Council and the world's great powers at the head of it, considering their interests, can exert a political influence on this judicial organization in various ways, such as guiding the way of referrals and controlling the Court.

    One of the inalienable effects of international responsibility of States is the full reparation of the consequences of wrongdoing. Unlike restitution and compensation, which are mainly used to compensate material damage, satisfaction has been considered as an appropriate method of compensating non-pecuniary damage by State practice, case law and especially the ILC. The study of these procedures shows that satisfaction is generally obtained through processes such as apologizing, declaring the act as a wrongful act, punishing the perpetrators, and so on. On the other hand, financially satisfaction faces serious challenges, but the studies of this article show that it is exceptionally accepted in case of severe and systematic moral damage to non-State entities. The February 9, 2022 judgment of the ICJ in the case of Congo v. Uganda was an opportunity for the Court to resolve the ambiguities of satisfaction. However, as this article will show, this ruling has deepened these doubts, and the Court has reached findings for which no record is available.

    “Al Hassan Ag Abdoul Aziz Ag Mohamed Ag Mahmoud”, one of the leaders of the Ansar al-Din organization in Mali’s civil war, is now facing two charges of crimes against humanity and war crimes in the International Criminal Court.The implementation of corporal punishments is among his brutal acts. In this respect, we are facing this question that how the criminalization of corporal punishment should be analyzed from the court statute perspective? It is also necessary to unravel the mystery of how to rethink the corporal punishment system in Islamic countries in the light of the recent case. Present research concludes that the nature of corporal punishment implemented by Al-Hassan is compatible with the actus reus and mens rea of crimes against humanity and war crimes. Therefore, the implementation of corporal punishment by Islamic countries cannot be considered an international crime unless there are defined matching elements. However, in line with rethinking corporal punishments, they should come up with a message-oriented perception about the discussed case and pay attention to the expressive function of the court. With regard to various principles and jurisprudence rules such as Mulazeme rule (combination of reason and Sharia) and the Rule of Nafy Sabil (Denying the Domination of Unbelievers over Believers), there will be no doubt that this is an important issue. The importance of this issue and an urgent need for a solution increases with the international human rights organizations’ reactions and protests, considering Islamic governments in the same category as Takfiri groups in the international eyes, as well as the growth of the ohenomenon of Islamophobia.

    Procedural environmental law, also known as environmental democracy consists of three Pillars, which include the right of access to environmental information, the right of participation in environmental decision-making procedures and the right of access to justice. Environmental democracy is granted to citizens for their empowerment in order to protect their health against environmental damage and to ensure the environment. The aim of this study is to investigate the above rights in the international documents, jurisprudence and domestic legal systems of some leading states and then analyse the Iranian legal system through descriptive-analytical method. We found that Iranian legal system still suffers from some gaps despite the positive efforts to achieve environmental democracy in recent years. The most important issues are the lack of specific rules on people’s access to environmental information, a favorable system for citizen participation in environmental decisions, and a dedicated environmental court.
