    «الزام آوری» اراده قدرت حاکم، باید از مشروعیت برخوردار باشد که اساس قدرت حاکم و ماهیت آن را تشکیل می دهد. این با مشروعیت رفتار ارادی یا مشروع بودن اراده (که از رفتار انسانی ناشی می شوند) تفاوت می کند؛ زیرا مشروعیت رفتار انسانی به مشروع بودن اراده انسان و میزان انطباق اراده بر معیارهای «حق» و «عدالت» بستگی دارد. حال آنکه در مساله الزام آوری اراده قدرت حاکم، برای مشروعیت، فقط مشروع بودن اراده ای که قدرت، برآمده از آن است، کافی نیست. در این راستا مکاتب مختلف فلسفه سیاسی، هر کدام مبنایی برای این مهم ارائه داده اند و اسلام نیز در این میان مبنایی دارد که باید مورد تحلیل فلسفی و عقلانی قرار گیرد. برای تحقق این امر، قدرت حاکم باید از دو جهت، مشروعیت داشته باشد: اراده بودن و ملزم کردن دیگران، اما خرد انسان نمی تواند، خاستگاه مشروعیت اراده قرار گیرد؛ زیرا خرد به نوبه خود به معیار و مرجع دیگری نیاز دارد تا در رفتار ارادی انسان، درستی را از نادرستی، عدل را از ستمگری و حسن را از قبیح متمایز گرداند. در تفکر الهی، عقل و خرد الهی به دلیل احاطه کامل بر امور و عصمت ذاتی اش، می تواند معیار بنیادین کامل و واقعی برای قضایای علمی قرار گیرد. اراده الهی نیز از همین خرد الهی بر می خیزد. ازاین رو، این اراده به دلیل انطباق با معیارهای بنیادین حسن و عدالت که همان عقل الهی است، همیشه با عدالت و حسن و درستی منطبق خواهد بود. بر این پایه، وحی الهی تنها خاستگاه مشروعیت اراده بشری و تصمیم انسانی می شود.

    در سالهای اخیر گفتمان «اصولگرایی عدالتخواه» در عرصه سیاست خارجی نمود ویژه و قابل توجهی داشته است. در نوشتار حاضر، نویسنده تلاش نموده است تا بر اساس نظام معنایی گفتمان مزبور و دالهای آن، به شناسایی مؤلفه های سیاست خارجی این گفتمان بپردازد و بر اساس این نظام معنایی و توصیه های مقام رهبری، برای رسیدن به اهداف نظام جمهوری اسلامی ایران در دهه چهارم انقلاب اسلامی، دالهای جدید و کارآمدتری را برای گفتمان مزبور و به ویژه در عرصه سیاست خارجی پیشنهاد نماید.

    برخی بحث ولایت فقیه را بحثی کلامی و برخی آن را فقهی و گروهی دیگر آن را کلامی- فقهی می دانند و هر یک نیز برای اثبات نظر خود ادله ای را بیان می کنند. در این نوشتار پس از بیان ثمرات فقهی یا کلامی بودن این بحث و بررسی آن ثمرات، معلوم خواهد شد که اساسا طرح این مساله که بحث ولایت فقیه، بحثی کلامی است یا فقهی، انحرافی می باشد و ثمری ندارد؛ چرا که بحث ولایت فقیه، هم می تواند در علم کلام مورد بحث قرار گیرد و هم در علم فقه، با این تفاوت که در علم کلام، چون تنها درباره فعل خداوند بحث می شود، به سؤالاتی از بحث ولایت فقیه پاسخ داده می شود که مربوط به فعل خداوند باشد. در عین حال که در علم فقه به سؤالهایی از بحث ولایت فقیه که مربوط به حکم افعال انسانها است، پاسخ داده می شود.

    فلاسفه، همواره به دنبال پاسخ گویی به پرسش های اساسی انسان و ارائه راه حل برای سرنوشت بشری بوده اند. در این راستا پرداختن به مسائل اساسی همچون سعادت، زندگی سیاسی مطلوب و رهبری فاضله، دغدغه اصلی آنان بوده است. فلاسفه اسلامی اعم از مشائی و متعالیه، نیل به سعادت و نظم سیاسی مطلوب را متوقف بر وجود رهبر و ریاست فاضله می دانند که آن را بر امام7 (انسان کامل) تطبیق داده اند؛ اما افتراق اساسی آنها در این است که امام، نزد فلاسفه مشاء، بیشتر کارکرد سیاسی (راهبری جامعه سیاسی به سوی تخلق افراد جامعه به کمالات) دارد و نزد فلاسفه متعالیه، بیشتر کارکرد عرفانی و معنوی دارد، هر چند در هر دو رویکرد، امام، کامل ترین فرد در میان افراد جامعه است.

    این مقاله درصدد بررسی نوع تعامل و ارتباط میرزای قمی با حکومت قاجاری، عوامل این تعامل و دیدگاه وی نسبت به حکومت وقت است. در این مقطع تاریخی(ابتدای دوره قاجار مصادف با دوره آغامحمدخان و به ویژه دوره فتحعلی شاه قاجار) بسیاری از علما با حکومت قاجار ارتباط نزدیکی داشتند، اما ارتباط و تعامل میرزا ابوالقاسم قمی - که از برجسته ترین علمای این دوره بود - با حکومت وقت، بسیار مهم و تاثیرگذار بود. با توجه به سابقه تاریخی عدم ارتباط یا تقابل علمای شیعه با پادشاهان و حکومت های آنها، اگر در موارد و مقاطعی که بین علما و حکومت های وقت، ارتباط و تعامل نزدیک برقرار شده است، این سؤال مطرح می گردد که چه علل و عواملی باعث ایجاد این ارتباط و تعامل شده است؟ این ارتباط با دیدگاه علما در خصوص عدم مشروعیت حکومت وقت چگونه سازگار است؟ در این نوشتار بیان گردیده است که رویکرد مذهبی حکومت وقت و بحرانها و مشکلات داخلی و خارجی ای که اساس کیان اسلام و دین مردم و مذهب تشیع را تهدید می کرد، باعث شده بود که عالمانی همچون میرزای قمی از راه ارتباط با حکومت وقت از ابزار قدرت در راه مقاصد شریعت اسلام و حفظ کیان اسلامی، گسترش اسلام و مذهب تشیع نهایت استفاده را بنمایند.

    با توجه به مبانی فقهی شیعه، سرپرست حکومت، در درجه نخست، شخص معصوم می باشد و در زمان غیبت بر اساس دلایل ولایت فقیه، این مسؤولیت بر عهده فقیه است. برخی از فقها حکومت فقیه در عصر غیبت را از باب حسبه دانسته اند. بر اساس این اندیشه و با توجه به ضرورت حکومت و اینکه حکومت از امور حسبی می باشد، فقیه از باب قدر متیقن، حکومت را بر عهده می گیرد. اما در صورت تعذر فقیه، بر مبنای این اندیشه نوبت به مؤمن عادل می رسد تا زمام حکومت را در اختیار بگیرد. این نظریه، مستندات فقهی خاصی دارد که در این مقاله، دلایل ولایت عدول مؤمنان، قلمرو صلاحیت و شرایط تصدی آنان مورد بحث قرار گرفته است.

    بر اساس اسناد و شواهد تاریخی، رژیم طاغوت منکرات گوناگونی را در سطح کلان و در ابعاد سیاسی، فرهنگی و اقتصادی مرتکب گردید. این رژیم در سیاست های داخلی و خارجی خود، تحت تاثیر قدرتهای خارجی به ویژه ایالات متحده آمریکا قرار داشت؛ به گونه ای که حکومت شاه به یک حکومت وابسته و تحت سلطه تبدیل شده بود. همچنین این حکومت، ظلم های گوناگونی را بر ملت ایران در عرصه های سیاسی، فرهنگی، اجتماعی و اقتصادی تحمیل کرد. در چنین شرایطی امام خمینی1 مبارزه با اصل سلطنت را بر حسب مبانی دینی در بستر فقه اسلامی واجب می شمرد که بر اساس آن موفق شد رژیم پهلوی را سرنگون نموده و حکومت اسلامی را تاسیس نماید. مبانی فقهی انقلاب اسلامی در اندیشه ایشان، امر به معروف و نهی ازمنکر، وجوب نفی سلطه اجانب و وجوب مبارزه با ظلم و اعتقاد به انفکاک ناپذیری دین از حکومت است.

    A sovereign’s will cannot be binding without being legitimate, a condition which constitutes the basis of a sovereign's power and its nature. This differs from the legitimacy of man’s voluntary behavior or the legitimacy of man’s will (stemming from human behavior). The reason is that the legitimacy of human behavior depends on thelegitimacy of man's will and on the extent to which the will corresponds with such standards like "right" and "justice" whereas in the question of a sovereign’s will's being binding, the legitimacy of the will from which sovereignty stems is not sufficient for ensuring legitimacy. Different schools of political philosophy have proposed different bases for this important question, and Islam has introduced its basis, as well, which needs to be analysed rationally and philosophically. For this purpose, a ruler's sovereignty should be legitimate from two aspects;namely, existence of the will and obliging others. As for man's intellect, it cannot be regarded as an origin of legitimacy because intellect in turn needs another criterion and authority in order to discern whether man's voluntary behaviour is right or wrong, just or unjust, good or not.

    Since the question of justice is regarded the focal point of the discourse of the nineth-term and tenth-term governments, the present government is known as "justice-seeking fundamentalist government." The presence of this discource in the realm of foreign policy is very striking. The present article seeks to specify the components of the foreignpolicy of this discourse by examining the semantic syestem of this discourse and what signifies it. Taking into account this semantic system and observing the Supreme leader's recommendations and in order to achieve the goals of the fourth decade of the Islamic Revolution, the author proposes new and more effective signifiers for this discoursespecially in the realm of foreign policy.

    Some say that the question of "guardianship of a Muslim jurist" is related to fiqh, others say it is an issue in kalām (Islamic theology), still others consider it as both a theological and fiqhi question. Each of the three introduces some evidence to justify their claim. After the author of this article explains whether making a distinction between the fiqhi and theological nature of this question is of any consequencies, it becomes evident that proposing the question of "guardianship of a Muslim jurist" as a theological or fiqhi issue is misleading, because it can be discussed both in theology and in fiqh. The difference between the two is that in theology, the answers to the questions about "the guardianship of a Muslim jurist" have to do with the Divine actions, whereas in fiqh, the answers to such questions are related to the judgements on man's actions.To sum up, the assumption that if the question of "guardianship of a Muslim jurist" is not related to theology it has to fall into the province of fiqh and the assumption that if this question is not related to fiqh it has to fall into the province of theology, are of no avail.

    Philosophers always seek to find answers to man's fundamental questions and present solutions for determining man's destiny. Their major concerns were such questions like happiness, ideal political life and utopian leadership. Muslim philosophers, from among those who advocate transcendent theosophy or those who are in favour of peripateticphilosophy hold that achieving happiness or a desireable political order requires a utopian leader and these characteristics are found only in the Infallible Imam, i.e. the perfect man.The main difference between these two philosophical schools is that peripatetic philosophers think that Imam mainly has a political function (leading political society to the state in which individuals can take on of perfections), but according to the philosophers who advocate transcendent theosophy, the main function of Imam is gnostic and spiritual. However, each of them considers Imam as the most perfect individual in society.

    dynasty, that is, during the rule of Aghā Muhammad Khān and the rule of Fath Ali Shāh in particular, many religious scholars had close relations with the Qajār government. But the relations which Mirzā Abu al-Qāsim of Qom – a most eminent religious scholar of the day – had with that government was of special importance and influence.Taking into account the fact that throughout recorded history Shii scholars did not have relations with or opposition to the kings and their governments, if they were inclined to establish on certain occasions or in some periods close relations with the governments of the day, what are the factors involved in establishing such relations? How does thisposition of scholars accord with their view that the government of the day was illegitimate?The author points out that the religious attitude of the government of the day along with the domestic and foreign problems which threatened the foundations of Islam, people's faith and Shiism, pushed some religious scholars including Mirzā of Qom to make use of thier authority by cultivating close relations with the government of the day in attempt to safeguard Islamic law and the edifice of Islam and contribute to theprevalence of Islam and Shiism.

    According to the basic principles of Shiah fiqh, the leader of a government has, in the first place, been an infallible person and during the occultation period (i.e. when the Imam is hidden) this responsibility is, on the basis of the proofs confirming the principle of the guardianship of a Muslim jurist, entrusted to a Muslim jurist (faqih). Some faqihs consider that one of the proofs for the guardianship of a Muslim jurist is connected to non-litigious affairs. Given this, and due to the necessity of having a government, the faqih is the most suitable one for holding the responsibility of governance. But, according to the above mentioned principles, if a faqih provides every excuse to avoid holding the responsibility of governance, then the mamagement of the affairs is entrusted to a just believer. The stated view is based on certain fiqhi evidence. The present article discusses the idea of the guardianship of just believers, and the jurisdiction and conditions of their responsibility.

    Historical evidence and documents acknowledge that the Shāh's tyrannical regime has committed large-scale offences of various kinds in political, cultural and economic aspects. This regime was under the control of foreign powers especially the United States in such a way that Shāh's government became dependent on and controlled by the foreigners. Under Shāh’s government, the Iranian nation suffered from political, cultural, social and economic oppression. Such were the circumstances which drove Imam Khomeini, who found that it was his duty – prescribed by Islamic law – to combat the reign of a tyrant, and to topple Pahlawi's regime and establish an Islamic government. Imam Khomeini's thought was based on such principles like enjoining good and forbidding evil, necessity of rejecting foreign hegemony, necessity of combating injustice and oppression, and the belief in the inseparability of religion and government.
