Provability of Midhaq-i Shariat; Contemplations and New Insights

In the field of jurisprudential reasoning, midhaq-i Shariatifaces two approaches one of which negates it and the other believes it can be regulated. Inability to find midhaq-i Shariat, impossibility to criticize such a midhaq and its making false certainty are among the most important considerations which have prepared the grounds for jurists to
issue a fatwa to remove it from the jurisprudential discussions and replace it with a framework of reasons; nevertheless, through reinvestigation of midhaq-i Shariat, the reasons of its validity can be reflected and through its regulation, remove the questions and ambiguities so that this issue comes out of personal reasoning and its foundations among the jurisprudential principles are clarified. This paper sheds a new light on
the provability of midhaq-i Shariat and criticizing the idea of its negation.
