constitutional system from the perspective of Islamic political theory
The legal system of the Islamic Republic has two properties simultaneously. On one hand, as it is the result of the Islamic Revolution of Iran in 1978 with the aim of establishing Islamic State, its nature is ideological and based on intellectual foundations and beliefs of Shi'ite; and on the other hand, the principles of democracy and people's decisive role in the selection of government officials and comprehensive participation in the government of the country have been involved. Although democracy determines the political system of Iran, basically the Islamic system directs its nature and content. Accordingly, in addition to compliance with criteria relating to the political system, the institutions, structures and facilities of the system must necessarily be compatible with the rules and regulations governing its content. This study shows how the criteria of selecting government officials in the Islamic political theory have emerged in the legal system of Iran.
