A different approach to anti-modesty crimes

Abstract:
Based on the Islamic penal law, the substantiation of some anti-modesty crimes requires the existence of certain legal proofs and if they are not available the committed anti-modesty crime is not legally substantiatable. This results in the impossibility of substantiating the crime in some cases because the collection of the proofs required by the legislator is either not easily possible or basically impossible. As a result, the rights of the private plaintiffs and the victims of the crime are neglected in the case of anti-modesty crimes, with the society being exposed to more severe unlawfulness. This paper analytically studies anti-modesty crimes, the substantiating proofs of penal complaints, and the specific proofs of anti-modesty crimes, trying to identify the existing practical strategies for eradicating these predicaments so that the victims of anti-modesty crimes are helped to defend their legal and legitimate rights.
