The Need for Implementing a Policy towards Reducing the Execution of Divinely Prescribed Penalties; Imamiyyah jurisprudence strategies to achieve it
The policy of reducing the execution of punitive penalties is the use of measures and methods within the jurisprudence to reduce the execution of the penalties, although they may have been proven and established with the qualified authority. The reason why such a strategy needs to be adopted in the modern time is the growing phenomenon of Islamophobia across the globe because those who are antagonistic to Islam give the examples of the punishments carried in Islamic country, so they continue to present and portray a violent, retrogress and inauspicious image of this beautiful religion. Obviously, failure to pay attention to this fact and to work out solution to this problem will entail numerous consequences, including denial of the religion of Islam, blasphemy, isolation and destruction of the religion. Considering the jurisprudential foundations of the Imamiyyah School of law and the opinions of Shia jurists, to minimize and reduce the said problems, it is quite possible to make use of the "expansion of repentance institution", "tolerance and leniency towards criminals", "attention to the fundamental principles of criminal law" and "the use of arbitrary institutions in punitive punishments". The result is that the application of this policy will, to some extent, curtail the phenomenon of Islamophobia and its negative consequences, and that the divinely prescribed punishments will not be cancelled either.
