The position of official contract registration in default Pre-sale Building Act 2010
As article 22 of Property Registration Law had made dispersion for the judicial procedure and doctrine in the position of official registration of immovable transactions, now the Pre-sale Building Act approval of 2010 has emphasized the necessity of registration of the contracts and has made doubts for sanction and the position of registration in the said law. Based on the basics and general legal principles with the analysis of similar situations, in which the legislator has emphasized registration or necessity of observance of particular formaliti4es in contractual documents, and with analysis of the specifications of special contracts of private law, in which the parties are in unequal positions, the study has applied descriptive-analytical method and has found that necessity for registration and criminal sanction of them is not just a supportive instrument for the pre-buyer. It is not aimed at protecting public order, and lack of registration can’t exclude it from the inclusion of the act of 2010.
