Some reflections on presumption of "legislator's wisdom"

Abstract:

Although all jurists are agree on the issue of the wisdom of the legislator, the concept of the legislator’s wisdom needs to be further explored. In this editorial, the issue cannot be explored as it should be. It can only provide an opportunity for researchers and experts to take further steps. The importance of the debate becomes even clearer to us when we consider that our legislator (in Iran) and our legislation system is in a hurry to produce law and regulation: a draft of law presented by some Majlis representatives entitled "protection of the rights of internet users" is one of the newest law that, in a situation where different systems are competing with each other over increasing bandwidth and speeding up the Internet service, have come up with the idea of reducing and blocking the free flow of information in order to protect "users' rights". On the other hand, not only is it often not seen a sign of the legislator's wisdom, but the whole system of hierarchical norms has dealt with the phenomenon of parallel regulation, which needs to be explained more broadly elsewhere.
