The governing principles on the punishment justice in Iran's law

Abstract:
Justice is one of the oldest concepts that humans know from the beginning of their civilization and they strive for its maintenance. Justice has different forms that can be mentioned as social, political, economical, and punishment. Scientists and scholars of law consider different principles effective for punishment justice. Amongst them principles such as exemption, legal crimes and punishment, ethical responsibility, and personal responsibility punishment are considered as the most important principles. The precise observing of the above principles in the investigation of defendant is the sign of justice certainty and ignoring them weakens the right of clients to judiciary force and facilitates the injustice causes. Paying attention to personality and human dignity of people, the complete observance of criminal rights make peoples’ life, property, and chastity immune can be regarded as distinct results of observing these principles.
