Application of Competition Law on Government's Authority (Act dAutorite) and Incumbency (Act dGestion) Acts.

In this article we will attempt to answer this question that، Is it necessary and appropriate to government''s actions being follower of inspections of competition law or not? Therefore، First we will describe the literature related to question، then we will answer to mentioned question in different hypotheses and with paying attention to either performed action in general''s power area of authority or merely being a commercial and economical act. At last we will present comparative evidences with emphasizing on the US''s legal system. Findings of this article are practicable in both area of internal competition law& int''l competition law. Because up to now، concerning in extraterritorial anticompetitive acts have not been enacting any common treaty or regulation. Therefore، pursuing of anticompetitive acts generically with int''l dimensions or purely was done in the internal market، will accomplish in national legal system.
