Assessing Possibility of Buying Intellectual Rights from Jurisprudential and Legal Perspectives

Abstract:
The transfer of intellectual rights is the need of society and on the rise. Among certain contracts, the contract of sale is more rampant and applicable and the rules governing it enjoy special importance. The question is whether or not it is possible to incorporate the transfer of these rights into the contract of sale and consider it as having the rules and impacts of a sale contract. Speaking from a legal perspective, some experts of law have presented analyses trying to argue that these rights are transferable to the contract of sale but this opinion is not acceptable because according to a legislator and in view of the nature of these rights, it can be said that as per the law, the transfer of these rights is not possible within the framework of the contract of sale and that it can be accepted in the form of sulh(amicable settlement) or indefinite contract. From a jurisprudential point of view, the contemporary jurisprudents have flexibly considered the rights to be a kind of property and this attitude about the transfer of rights being a kind of sale is now so well-known among jurisprudents.
