Abstract:
Nowadays, the growth of the population and the need for land has become one of the common concerns; therefore, jurisprudential investigation of the uncultivated lands is necessary, since the rules, conditions, differences, and its features in the Shiite and Sunni jurisprudence have not been systematically described in a descriptive-analytical way, Approximation of the opinions of the Islamic khumse religions has been considered. The results indicate that the uncultivated lands of the neighboring Islamic republics are referred to as lands that are not for profit. In their property, the jurisprudents of the Imamiyeh, Hanifa and Malikia considered Imam's permission necessary, but the promise of ownership was based on a theory that the right to exploit the land and the payment of taxes and the other right to property And capture it, and in the nature of the restoration and conditions of that Imamiyeh, and the Sunni are considered.
