Componentology of Selling (Juridical - Legal Critique of the Article 338 of the Civil Code)

For the realization of a contract in the Iranian legal system, some elements are necessary. The legislator has attempted to incorporate these elements in Article 338 of the Civil Code. Accordingly, it is stated in the article as the definition of a marriage contract: "a marriage is the same obedience in return for what is known." According to this article, the elements of the bee are: "propriety", "exchangeability", "objectivity", "the ability to possess any property", and "the certainty of the consequence". Since the above definition is not sufficiently accurate in listing the elements of the termination, the present article attempts to describe the defects in the legal system of Iran based on the customary fact of the termination contract in a descriptive-analytical approach. And eliminate ambiguities in this regard.
