Abstract:
Background and Aim

Information protection officers as military officers have duties and responsibilities in the trial process. In the new Code of Judicial Procedure, the legislature has assigned military officers several duties from the first moments after the crime, especially in the preliminary investigation stage, to the last minutes of the execution of the sentence. The present study seeks to identify the innovations of the Code of Criminal Procedure adopted in 1392 and its subsequent amendments, in fulfilling the criteria of a fair trial resulting from the performance of duties of law enforcement officers in the position of military officer. 

Research Method:

This research is a descriptive-analytical type and the library method has been used to collect information by referring to the laws of criminal procedure.

Findings

Commitment to respect for human rights in the judicial process, and especially in the preliminary investigation and crime detection phase, with the care of those in charge to comply with their duties, including; Timely detection of a crime, reporting its occurrence to the prosecutor's office, preventing the disappearance of the causes and effects of the crime, paying attention to the defendant's defense rights such as the right to a lawyer, informing the accused's family, etc. protect the rights of individuals and society. Prevents further actions such as execution of punishment. Recognition of the legal duties and good performance of the duties of the officers completes the links in the chain of judicial justice, and any damage to the duties of the officers may lead to the acquittal of the perpetrators or the conviction of the innocent. The Code of Criminal Procedure adopted in 1392 and its amendments, by enumerating the duties of officers, to some extent has achieved the observance of the rights of individuals from the perspective of a fair trial.
